The vast majority of small and medium-sized enterprises in China are private enterprises. The development of private enterprises requires a fair and just market environment. In December 2019, the CPC Central Committee and the State Council issued the Opinions on Creating a Better Development Environment to Support the Reform and Development of Private Enterprises (hereinafter referred to as the Opinions), which is the first central document in the field of private enterprise reform and development, and proposes a series of reform measures around creating a market-oriented, law-based and international business environment. The "Opinions" proposes to further liberalize the market access of private enterprises, implement a fair and unified market supervision system, strengthen the rigid constraints of the fair competition review system, and break down the hidden barriers to bidding and bidding, so as to optimize the market environment for fair competition.

In the two years since the implementation of the "Opinions", what policies and measures have been adopted from the central to the local level, and what have been the results? The reporter conducted an interview.

Reduce the burden and facilitate access to the camp

The "Opinions" call for further liberalization of market access for private enterprises. Over the past two years, all localities have strictly implemented the negative list of market access, and in accordance with the principles of "non-prohibited entry" and "non-limited entry", they have broken all kinds of "roller shutter doors", "glass doors" and "revolving doors" to create sufficient market space for the development of private enterprises.

Ma Bin, executive vice president of the China Association of Small and Medium-sized Enterprises, said that in the two years since the release of the "Opinions", various policies and measures have been intensively introduced, the development environment of private enterprises has continued to improve, and the export of private enterprises has accounted for more than 55%, the tax contribution has exceeded 50%, the investment has accounted for more than 60%, and the proportion of invention and innovation has exceeded 70%.

Lower the threshold and facilitate access to the camp. All regions and departments have expanded their connotations and innovated ways in optimizing government services, reducing the burden on private enterprises and creating a better business environment.

Stimulate vitality and maintain fair competition

"We require all law enforcement personnel to treat all types of market entities equally and fairly in the process of law enforcement, and at the same time thoroughly implement the fault tolerance mechanism for minor illegal acts." Chen Wei, head of the inspection office of the Taizhou Municipal Market Supervision Bureau in Jiangsu Province, said.

In the past two years, the Taizhou Municipal Market Supervision Department has investigated and handled a number of cases involving epidemic prevention and control products. Chen Wei introduced that in the process of handling the case, under the principle of adhering to the bottom line of safety and administering according to law, in a number of cases such as the case of a pharmaceutical chain limited company selling masks without any markings, and the case of price gouging by a pharmaceutical chain company, because the parties actively cooperated with the investigation, actively rectified, and took measures to announce the recall to actively eliminate the harmful consequences, in line with the provisions on exemption from punishment for minor violations in the field of market supervision in Jiangsu Province, they were ordered to rectify first and were exempted from administrative punishment.

In terms of implementing a fair and unified market supervision system, the Opinions require detailed and clear administrative law enforcement procedures, standardizing law enforcement discretion, and strictly regulating fair and civilized law enforcement. Further standardize the standards and procedures for the inclusion of targets of joint disciplinary action for untrustworthiness, establish and improve credit restoration mechanisms and objection systems, and standardize credit verification and joint disciplinary action.

Wang Wei, director of the Civil and Commercial Economic Law Office of the Political science and Law Department of the Central Party School (National Academy of Administration), believes that for serious violations of the law and untrustworthy behavior, high-intensity management and punishment are carried out; for honest and trustworthy enterprises, by giving credit incentives such as green channels, reducing the frequency of inspections, and facilitating customs clearance, the practice of regulatory departments preferring to adopt high-intensity management methods such as administrative licensing, supervision and inspection, and administrative punishment under the traditional supervision model has been greatly changed.

"We are not afraid of competition, we are afraid of unfair competition." Chen Zhipeng, operating partner of Beijing Wangwenwenqie Information Technology Co., Ltd., said. In recent years, China has made great efforts to improve the fair competition system. The State Administration for Market Regulation has promoted the acceleration of the revision of the Anti-Monopoly Law and the revision of the Anti-Unfair Competition Law twice, further enhancing the pertinence, scientificity and predictability of the anti-monopoly and anti-unfair competition legal system. Efforts should be made to strengthen anti-monopoly and anti-unfair competition supervision and enforcement. Since the promulgation and implementation of the Anti-Monopoly Law, a total of 741 cases of various types of monopoly have been investigated and handled, with fines and forfeitures of 31.684 billion yuan, and nearly 4,000 cases of concentration of undertakings have been concluded; since the promulgation and implementation of the Anti-Unfair Competition Law, a total of 755,000 cases of various types of unfair competition have been investigated and handled, and 12.03 billion yuan has been fined and confiscated.

The regulatory authorities have severely cracked down on monopoly and unfair competition behaviors with strong social repercussions, created a fairer market competition environment, and stimulated the innovation and development vitality of various enterprises.

Increase confidence and break down hidden barriers

"Since the end of 2019, the development of electronic bidding has accelerated, and our business has covered more than 20 provinces." Liu Yongqing, vice president of China Recruitment United Information Co., Ltd., said that compared with traditional bidding, electronic bidding has enhanced information transparency through technical means, realized that the encryption of bidding documents cannot be changed, the results of the evaluation process leave traces, and digital supervision, which fully embodies the principle of fair, open and fair competition, and curbs the occurrence of local protectionism, industry monopoly and administrative intervention to a certain extent, avoids rent-seeking due to information asymmetry, and is also conducive to post-event supervision and audit, and realizes sunshine transactions.

Bidding is an important part of the whole life cycle management of investment and construction projects. The "Opinions" particularly emphasize the removal of hidden barriers to bidding and bidding. For enterprises with corresponding qualifications and conditions, the scale threshold of the enterprise that has nothing to do with the business capacity and the performance threshold that clearly exceeds the requirements of the bidding project shall not be set.

At the end of 2021, the State Council issued the Opinions on Carrying out Business Environment Innovation Pilot Work, which clearly defined the pilot business environment innovation in six cities: Beijing, Shanghai, Chongqing, Hangzhou, Guangzhou and Shenzhen. The pilot cities have done a lot of fruitful work in the construction of the bidding system and the application of electronic bidding.

For example, Beijing has formulated functional standards for electronic trading platforms, and bidding, bidding, bid opening, bid evaluation, contract signing and other links can be standardized online. Shanghai has built a smart supervision system for big data in bidding and bidding, and promoted unified online supervision, complaint handling, and credit rewards and punishments. Through the city's unified bidding credit system, Chongqing has included all bidding transaction information into the scope of supervision. Hangzhou vigorously regulates the business process of remote remote bid evaluation. Guangzhou actively discloses the whole process of bidding and bidding information, and guides market entities to participate in the supervision of the bidding process. Shenzhen normalizes the collection of clues to problems in the field of bidding and bidding, and eliminates the hidden barriers set up for enterprises of different ownership systems in the bidding process.

In the next step, the relevant departments will also establish and improve the system for the early release of bidding plans, and create a market environment of equal treatment and fair competition for domestic and foreign-funded enterprises with more transparent, standardized and efficient bidding system rules and standards.

Ma Bin said that it is also necessary to further eliminate the unfavorable factors that affect private enterprises and small and medium-sized enterprises in equal access to key resource elements such as land, capital, and technology transfer, and form a social atmosphere of respecting and encouraging entrepreneurs and officials to start a business in the whole society.
