Beijing, 15 Dec (Xinhua) -- Ma Xiaoguang, spokesman for the Taiwan Affairs Office of the State Council, said at a regular news conference on 15 December that on 14 December, the Supreme People's Court issued the "Ten Typical Cases of Protecting the Rights and Interests of Taiwan Compatriots in the People's Courts." In recent years, the people's courts at all levels have implemented a number of measures to provide judicial services for deepening cross-strait integration and development, and have effectively safeguarded the legitimate rights and interests of Taiwan compatriots, thus providing specific guidance for the people's courts in handling Taiwan-related cases.

Ma Xiaoguang said: These cases reflect the characteristics of the people's courts in handling Taiwan-related cases in three aspects. The first is to strengthen comprehensive and equal protection. Courts in Zhejiang, Anhui, Fujian, Henan, Guangxi, Sichuan, and other localities promptly issue specific work opinions or implementation rules, safeguard the equal procedural rights of Taiwan compatriots, and promptly provide judicial relief for disputes encountered by Taiwan compatriots in the course of enjoying various policy preferences, subsidies, rewards, incentives, access, and other equal treatment on the mainland. The second is to focus on optimizing the business environment. The people's courts in Liaoning, Heilongjiang, Jiangsu, Zhejiang, Fujian, Shandong, Guangdong, Guangxi, and other places with a large number of Taiwan-related cases have all set up special Taiwan-related trial organizations to ensure the safety of Taiwan compatriots' investment and property in the mainland in accordance with law. The third is to insist on providing high-quality litigation services. Beijing, Tianjin, Fujian and other 18 local courts have cooperated with the local Taiwan Affairs Office to establish a coordination and resolution mechanism for Taiwan-related disputes, giving full play to the role of mediation and other non-litigation dispute resolution mechanisms. Seven local courts, including Liaoning, Jiangsu and Fujian, explored Taiwan compatriots serving as people's assessors, specially invited mediators, and consulting experts to participate in the trial of Taiwan-related cases, conveying judicial temperature. The Supreme People's Court issued judicial documents that provide cross-border online case filing services and online litigation guidelines for parties, including Taiwan compatriots, so that Taiwan compatriots can enjoy convenient and efficient judicial services.

Ma Xiaoguang also gave a briefing on the procuratorial organs' Taiwan-related work. He said: As judicial organs and legal supervision organs, procuratorial organs have played an important role in safeguarding the legitimate rights and interests of Taiwan compatriots and Taiwan enterprises in accordance with the law and creating a good business environment based on the rule of law. This includes giving full play to the role of procuratorial functions and unique advantages, refining and implementing Huitai's institutional arrangements and service measures; further intensifying supervision over criminal, civil, and administrative litigation involving Taiwan compatriots and Taiwan enterprises, and enhancing the effectiveness of supervision; accurately grasping the boundaries of laws and policies, making fewer arrests and prudent prosecutions in accordance with the law, and focusing on ensuring the compliance of Taiwan-funded enterprises on the basis of punishing crimes according to law; establishing normalized mechanisms such as Taiwan-related procuratorial liaison offices, contact points, and liaison hotlines in Fujian, Jiangsu, Zhejiang, and other places, and hiring Taiwan compatriots as liaison officers. Earnestly help Taiwan compatriots and Taiwan enterprises solve their worries and difficulties.

He said: Recently, the book "'Pro-Qing' Procuratorial Blue -- A Manual for Procuratorial Organs Serving Taiwan Compatriots and Taiwan Enterprises" organized and compiled by the Supreme People's Procuratorate was officially published. Proceeding from the actual needs of Taiwan compatriots and Taiwan enterprises in production, life, and entrepreneurship on the mainland, and from the four aspects of state system policies, procuratorial duties and functions, Taiwan-related service measures, and Taiwan-related case-handling practice, the book sorts out and answers more than 60 legal issues that Are of great concern to Taiwan compatriots and Taiwan enterprises, lists more than 30 real cases that are close to the lives of Taiwan compatriots, deeply explains the main laws and regulations related to Taiwan and the judicial policies and institutional measures of procuratorial organs to protect the legitimate rights and interests of Taiwan compatriots and Taiwan enterprises according to law, and provides the vast number of Taiwan compatriots and Taiwan enterprises with detailed content, vivid and practical rule of law tools.

According to Taiwan media reports, Taiwan businessman Wang Jinquan claimed that his factory in Xinjiang was demolished by the local government without warning. In this regard, Ma Xiaoguang introduced: The mainland has always attached great importance to protecting the legitimate rights and interests of the vast number of Taiwan compatriots and Taiwan enterprises in accordance with laws and regulations. After verification, the situation described by Wang Jinquan was inconsistent with the facts. First, in March 1998, the application land of mainland resident Shang Xiaomei in Karamay, Xinjiang, was not used for planting and breeding as agreed, but was used for leasing and construction station operation in violation of the law, which had serious safety and fire hazards; second, the legal land approval procedures were not handled; third, in September 2018, Shang Xiaomei continued to use the land in violation of the law after registering her marriage with Taiwan resident Wang Jinquan. In order to eliminate safety and fire hazards, the competent department demolished the illegal buildings in accordance with laws and regulations after repeated communication failures. We hope that the parties will actively cooperate with the local government to properly handle subsequent matters in accordance with laws and regulations, and jointly safeguard the legitimate rights and interests of all parties.

The mainland side attaches great importance to and is conscientiously responsible for cases concerning the life, health, and safety of people on both sides of the strait, handles them in a timely and proper manner in accordance with the law, and does its utmost to safeguard the legitimate rights and interests of compatriots on both sides of the strait. With regard to the repatriation of Taiwanese criminals and criminal suspects, the mainland side has done its part to do its part, and there is no problem of shielding or selective repatriation.
