He is Wei Qiao, deputy director of the Executive Bureau of the Longchang Municipal People's Court in Sichuan Province.
Skillful mediation, quell the self-immolation storm
From the First Civil Court to the Hu Family Court, the Jie City Court, and then to the Executive Bureau, a large number of memories of Wei Qiao's work are related to a township called Jie City. Before 2015, Jieshi Town belonged to a remote township in Longchang with relatively scarce resources. The Jieshi Municipal Court has jurisdiction over jieshi and Purun townships, mainly agriculture-related cases. During his tenure as the president of the Jieshi Municipal Court, Wei Qiao explored and summarized from years of grass-roots work the work method with "exemplary education", "cooling treatment", "hinting and inspiration", "reasonable blending" and "family and friend guidance" as the main forms of mediation, which well promoted the work of grass-roots courts.
He clearly remembers the case of plaintiff Ma x v. defendant Zeng X in a divorce dispute. Defendant Zeng was once a chef at a famous hotel along the coast and had a considerable income, and the plaintiff, Ma, was a rural woman in a northeastern province. Later, due to Zeng's illness, muscle atrophy, and inability to take care of himself, the plaintiff, Ma, filed a divorce request. The defendant, his family and surrounding villagers did not support it, believing that this was a typical realistic version of "the husband and wife were originally the same forest bird, and the great disaster was about to fly separately", and the plaintiff's divorce now filed for divorce is very immoral and should be condemned. The defendant Zeng Mou resolutely disagreed with the divorce, and was very emotional, and at the beginning he was very resistant to the work of the court, and even threatened: "As long as the court dares to rule that they are divorced, he will set himself on fire." "The defendant's family also sided with the defendant, using agitation to promote the development of the conflict.
After receiving this case, Wei Qiao put himself in the position of understanding the original and defendant's state of mind, repeatedly used the noon break time, braved the scorching sun, braved the scorching heat, went to the defendant's home, did work for the defendant and his family, moved the parties with affection and painstaking persuasion, preached the principle of freedom of divorce stipulated in China's Marriage Law and related legal provisions, laid out the facts and reasoned the defendant, and then put forward pertinent mediation suggestions. Through unremitting efforts, the defendant finally agreed to the plaintiff's divorce request, and the plaintiff also made concessions, voluntarily gave up the share of the couple's common property, and promised to pay the defendant 50,000 yuan in living support. The case took less than a week from case filing to successful mediation.
Little judge, the heart of one side is stable
On July 23, 2017, the Boundary City Court took over a case. The plaintiff was more than 200 peasant households in 7 communities in Cypress Village, Jieshi Town, and a dispute arose because the defendant had not contracted the land of the peasant household for several years and had not paid the land contract fee. The plaintiff not only filed a lawsuit, but also went to the petitioning department to petition, claiming that if the arrears of the contract fee could not be resolved as soon as possible, they would have to cross the level to petition.
After learning of this situation, Wei Qiao immediately realized that this case had the risk of triggering a mass incident, and if it was resolved in a general way, it was likely to cause the contradiction to deepen. Because the defendant has not been missing for a long time, according to the general procedure, the court will use a newspaper announcement to serve after obtaining the materials of the defendant's whereabouts, so that after the case takes effect for about half a year, it will take another period of time to apply to the court for enforcement, and when the defendant returns the land to the plaintiff, it will inevitably miss the spring ploughing production of the second year, resulting in another year's delay in the harvest of the people.
Wei Qiao immediately reported the case to the local party committee and government, and received the support of the local party committee and government. With the help of the relevant personnel, the unannounced return to the boundary town was finally notified. However, just before the copy of the document was served to The Unknown according to law, the Unknown Learned that the Court was coming to serve him a copy of the document and immediately fled by car. When Wei Qiao arrived, the defendant had not driven away for 10 minutes. The unsuccessful delivery is likely to delay the development of spring ploughing, looking at the anxious eyes of the village cadres and thinking of the disappointed looks of the villagers, Wei Qiao only has one word in his heart: "chase". Therefore, the police car was launched, the siren was sounded, and the chase began, and after surpassing one vehicle after another, it finally succeeded in forcing it to stop before driving on the highway, and successfully completed the delivery. Due to the timely delivery, the case was heard, sentenced and enforced, stabilizing the emotions of more than 200 households and avoiding the occurrence of mass incidents.
Through the judgment and enforcement, within 5 months, the people got the land contract fees that had been in arrears for many years, and also recovered the land, ensuring the smooth development of spring ploughing. Looking at the happy look of the people when they got the contract fees that had been in arrears for many years, Wei Qiao felt that all his efforts were worth it. Thinking back to the emergency activation of the siren, that time chasing the defendant's vehicle at a speed of 130 kilometers per hour to deliver the summons, he still can't suppress his inner excitement. What he was excited about was not the courage and determination to start the siren, not the tension and danger of rapid driving, nor the danger of finally forcing the chasing vehicle to stop, but the ease with which the summons was finally delivered in person, the relief that the trial was finally carried out as scheduled, and the satisfaction that the problem was successfully resolved... The case of the land circulation dispute in Cypress Village was perfectly concluded and smoothly executed, and the merit of "one stone and three eagles" was really received - the interests of more than 200 households were safeguarded, the government's pressure on letters and visits was lifted, and the power of the law was demonstrated!
Recover the loans that have been owed for many years
In November 2020, Wei Qiao was transferred from the Jieshi Municipal Court to the Executive Bureau as the deputy director of the Executive Bureau. At 6:50 on the sixth day of the first lunar month in 2021, a rapid telephone rang. Wei Qiao picked up the phone, and the anxious voice of the person on the phone came out: "Hey, Judge Wei?" I am Huang Mou, the applicant for execution, and I found the traces of the executor Xu Mou, you come quickly, otherwise he will go out again, and he will not find anyone. ”
After hanging up the phone, Wei Qiao knew that this meant that he must return to work immediately, and the Spring Festival was a day of family reunion, and it was also the best time to find the long-term fugitive dishonest executor. Although the Spring Festival holiday was not yet over, he immediately organized a police force and came to the downstairs of the executed person Xu Mou to squat downstairs.
"I didn't expect that in the New Year, you would come to the door." At 10:20, after more than 3 hours of squatting, Wei Qiao led the enforcement officers to finally intercept Xu Mou, the executor who went downstairs for breakfast. Defendant Xu borrowed 300,000 yuan from plaintiff Huang because he needed funds to do the project, and he has not returned the loan as agreed.
On December 19, 2018, the Longchang Municipal Court ordered defendant Xu to immediately return more than 300,000 yuan in principal and interest of the loan. Because the defendant Xu did not perform the payment obligation in accordance with the content of the judgment, the plaintiff Huang applied to this court for compulsory enforcement in February 2019. However, due to the fact that the person subject to enforcement, Xu Mou, had been in debt for a long time and had been hiding outside, he could not be found, and there was no other property to enforce, and the case had not made any progress.
After Xu was detained and summoned to the court, under Wei Qiao's interpretation of the law and patient mediation, the applicant and the executor finally reached a settlement agreement, agreed on the time and method of repayment of the arrears, and paid part of the execution payment on the spot. The applicant, Huang Mou, took the money in place and thanked him one after another: "After so many years, I finally received a loan that has been in arrears for many years. Thanks to the hard work of the comrades of the court during the holiday, such an efficient result was achieved. ”
In the past three years, Wei Qiao has tried a total of 694 civil and commercial cases of various types, with a case completion rate of 100% and a withdrawal rate of 72%. In 2010, Wei Qiao was awarded the title of "Top Ten Political and Legal Cadres and Policemen"; in 2017, he was named "My Favorite Grassroots Political and Legal Cadres and Policemen"; in 2018, he was awarded the third class of personal merit in the Neijiang Municipal Court System; in 2019, he was named "Advanced Individual in the Political and Legal System of Sichuan Province".
Although there were no earth-shattering major cases and important cases tried, the dripping water still hid deep in the vastness of the sea, and the light of the wisps still contained the brilliance of the sun, facing the gravel of the fingers with great efforts, and casting justice and strictness with a cautious and reverent attitude, which was deeply rooted in Wei Qiao's heart, because he knew that the interests of the masses were no small matter, and every case was someone else's life.
