The Dior T-shirt priced at 6400 yuan was fined for not being of good quality, and the penalty letter revealed this information

Beijing News Express (reporter Chen Lin) Recently, the famous French luxury fashion brand Dior (Dior) broke out product quality problems in the Chinese market. According to the website of the Shanghai Municipal Bureau of Market Supervision and Administration, the fourth store of Christine Dior Commercial (Shanghai) Co., Ltd. was confiscated by the Shanghai Pudong New Area Market Supervision and Administration Bureau for selling unqualified T-shirts and violating the relevant provisions of the Product Quality Law of the People's Republic of China, and was confiscated by the Shanghai Pudong New Area Market Supervision and Administration Bureau for illegal gains of 4,007.72 yuan and fined 19,200 yuan.

The reporter carefully read the "Administrative Punishment Decision Letter" and found some interesting information. First of all, the decision shows that the T-shirts that failed this test were as high as 6400 yuan.

According to the Decision Letter, on September 25, 2020, the parties sold one T-shirt 170/88A, 165/84A and 160/80A shipped by Christine Dior Commercial (Shanghai) Co., Ltd. with the goods number 843T03TA428. On November 17, 2020, the National Silk and Clothing Product Quality Supervision and Inspection Center went to the parties to sample one T-shirt 170/88A and one sample of 165/84A, and issued the Inspection Report on December 30, 2020.

After sampling and testing, the product quality supervision and random inspection of a total of 14 items, of which the use of instructions and fiber content items do not meet the relevant regulations, the comprehensive judgment is unqualified. The parties submitted a re-examination of the above-mentioned test report results. On March 10, 2021, Shanghai Textile Group Testing Standard Co., Ltd. re-inspected the T-shirt 165/84A of the above-mentioned quality sampling sample product, and the "Test Report" issued the next day concluded that it was also "comprehensively judged to be unqualified".

The parties purchased a total of 3 T-shirts that were judged to be unqualified by inspection, and the sales unit price was 6400 yuan / piece (including tax, tax rate of 13%). One T-shirt with a size of 170/88A sold was purchased at the time of sampling, one T-shirt with a size of 165/84A was used as a backup sample and was used for re-inspection, and one T-shirt with a size of 160/80A was in stock, which was discontinued from the shelves and destroyed on March 18, 2021. By the time of the case, the value of the unqualified products sold by the parties was 19,200 yuan, and the sales profit was 4,007.72 yuan, so the illegal income was determined to be 4,007.72 yuan.

Through the above information, the reporter learned that the 3 T-shirts sold on the shelves have not yet had time to sell to consumers. The illegal income of 4007.72 yuan was generated by the purchase of samples by the Market Supervision Bureau when sampling.

According to the Interim Measures for the Administration of Product Quality Supervision and Spot Checks of the State Administration for Market Supervision and Administration, the Market Supervision Bureau needs to purchase samples and pay the price according to the market price.

The Decision Letter shows that the Market Supervision Bureau purchased one piece, along with a spare sample. The reporter learned from the market supervision department that according to the requirements, the spare sample is sealed on the spot when sampling, the market supervision bureau does not have to pay, if the parties have no objection to the preliminary inspection results, the spare sample will be returned.

However, in this case, Diordian was not satisfied with the initial inspection and applied for a re-inspection. Retesting requires the use of spare samples. A law enforcement officer of the market supervision department told reporters that since the re-inspection in this case was proposed by the enterprise, the cost of the re-inspection was first paid by the enterprise, and if the re-inspection was qualified, it was borne by the Market Supervision Bureau, and the unqualified was borne by the enterprise itself.

In addition, the reporter inquired and learned that this is the second ticket received recently for the quality of dior T-shirts. On August 31 this year, Christine Dior Commercial (Shanghai) Co., Ltd. was ordered to stop the illegal behavior, confiscate illegal property, and order correction within a time limit for the production and sale of unqualified products passing off as qualified products.
