Notice of litigation rights and obligations of victims of a case in which criminal suspects Zhao Juan, Zhou Zhen, and ten others were suspected of fraud

The case of criminal suspects Zhao Juan, Zhou Zhen, Che Peiyi, Qiu Lexin, Zhou Hua, Liao Linghao, Xiao Xue, Zhao Yuanqing, Zeng Xianghao, and Xin Yefeng for fraud has been transferred by the Luohu Branch of the Shenzhen Municipal Public Security Bureau to our hospital for review and prosecution.

The investigative organs determined that:

Since March 2018, criminal suspect Zhang Jianping (who was caught by the Longhua Public Security Bureau for fraud and handled separately) and Jia Pengfei (whose real identity is unknown, who is at large) have conspired to defraud the victims of their property under the guise of a false auction by collecting handling fees. The two set up Jiaze Auction Co., Ltd. in Room 2506, Kingkey 100 Building, Luohu District, Luohu District, of which Zhang Jianping was a legal person and Jia Pengfei was the general manager, responsible for daily management, and successively recruited criminal suspects Zhao Juan, Zhou Zhen, Che Peiyi, Qiu Lexin, Zhou Hua, Liao Linghao, Xiao Xue, Zhao Yuanqing, Zeng Xianghao, Xin Yefeng and others to join the gang. The gang is divided into several departments, such as the front desk, the appraisal department, the information network department, the finance department, and the collection department. The collection department is divided into six groups, the criminal suspect Zhao Juan and Zhou Zhen are the deputy general managers of the company, responsible for the specific management of the collection department, of which Zhao Juan is responsible for managing the first group and the seventh group, Zhou Zhen is responsible for managing the second, third, fifth and sixth groups, the criminal suspect Liao Linghao is the leader of the group, the criminal suspect Che Peiyi is the leader of the seventh group, and the criminal suspects Qiu Lexin, Zhou Hua, Zeng Xianghao, Zhao Yuanqing, Xiao Xue, and Xin Yefeng are ordinary salesmen of the collection department group.

The gang's method of committing the crime is that the Information Network Department publishes false advertisements for auctioning antique collections on various websites, and when the victim registers the information, the members of the Network Department collate the information and hand it to the salesman of the Collection Department, who is responsible for contacting the victim, gradually deceives the victim's trust through words, and deceives the victim to his den in the Kingkey 100 Building, and is received by the corresponding team leader and minister of the salesman, and by the head of the identification department, Pan Guofeng (the real identity is unknown, Fugitives) conducted so-called "appraisals" of the collections carried by the victims, falsely claiming that they could be sold at auctions around the world at high prices, and defrauding the victims of their belongings in the name of charging fees. In order to deceive the victims' trust, an auction was held in Hong Kong, inviting the victims to attend the auction, and other members of the criminal gang pretended to be collectors to bid, but all the victims' collections were auctioned after no bidding. The general salesmen of the criminal gang's illegal gains can get 30%, and the remaining part is divided up by criminal suspects at other levels in a certain proportion.

After auditing, the fraud gang committed fraud totaling RMB16,880,575.70. Among them, the criminal suspects Xiao Xue, Xin Yefeng and Qiu Lexin returned some of the stolen money.

Due to the large number of victims in this case, in accordance with the relevant provisions of the Criminal Procedure Law of the People's Republic of China, after contact by this court, some victims are still unable to serve, and the litigation rights and obligations of the victims in this case are hereby informed by means of an announcement, as detailed in the "Notice of Litigation Rights and Obligations of victims of the Luohu District People's Procuratorate of Shenzhen City".
