Only when the people understand the law can they abide by the law. As early as 90 years ago, when Liang Baitai was working in the Soviet zone, he said: "With regard to the soviet decrees, we should do universal propaganda and interpretation work to the workers and peasants, so that the general masses can improve their common sense of the law, so as to reduce the criminal acts of the people and fight for the complete realization of all the soviet laws!" In order to publicize the rule of law, Liang Baitai opened a column on "Soviet Courts" in "Red China" to carry out legal popularization education that the masses liked to hear.
The Xinchang County Procuratorate drew on Liang Baitai's thinking on popularizing the law to build a diversified legal popularization and education model of "joint enterprises, joint townships, and joint schools", opening the era of "full rule of law publicity". The popularization of the law should be grounded in the hearts and minds of the people. The promulgation and implementation of the Civil Code involves thousands of households and is close to the people's livelihood and the people's hearts. At the beginning of this year, the Xinchang County Procuratorate sent the Civil Code, an "encyclopedia of social life," to various townships in Xinchang County. Legal issues such as private lending, maintenance, and recovery of labor remuneration have made villagers and procurators "fight fiercely" and effectively solve the urgent needs of villagers.
In June this year, the newly revised Law on the Protection of Minors came into effect. Online, the Xinchang County Procuratorate produced a rule of law cloud classroom of "Uninsured Law and Me" based on family guardianship, campus bullying, network protection, etc., and sent it to schools; offline, the "Vice Principal for Rule of Law" was busy sending laws, activities, and publicizing laws to various schools. Let the "new seedling" cloud classroom resonate with the offline rule of law class at the same frequency, and build a solid ideological defense line for minors.
The formation of legal beliefs is inseparable from the edification of the spirit of the rule of law, and truly useful laws must be written in people's hearts. "The trial of cases must go through the mass line, not the secret line" "Go to the point of accident or the place where the masses gather to try the case, so that the broad masses of the people can participate in the trial.", Liang Baitai's words fully show that the idea he pioneered to let the masses participate in judicial activities is an original legal idea with great vitality, and this sentence has also become the purpose of the Xinchang County Procuratorate in handling affairs and handling cases.
In recent years, the Xinchang County Procuratorate has held regular procuratorial open days to invite representatives from all walks of life and all fields to the procuratorate to experience and understand procuratorial work, and further deepen the construction of judicial standardization.
Since 2020, the court has invited more than 50 people's congress deputies, CPPCC members, and representatives from all walks of life to participate in judicial activities, truly making judicial justice visible and procedural justice tangible. At the end of last year, the Xinchang County Procuratorate actively carried out in-depth procuratorial hearing activities, carried out more than 10 hearings of various types, and explored the temporary procuratorial hearings in the township street spear adjustment center, so that the grass-roots people could feel fairness and justice that could be touched and credible.
The theory of people's mediation is one of the important theories advocated by Liang Baitai, and is a necessary supplement and right-hand man to the people's judicial work; he once said that "the township soviets have the right to resolve all kinds of disputes that are not involved in criminal acts," which laid a good foundation for the modern people's mediation system.
On the basis of actively carrying forward the "Fengqiao experience", the Xinchang County Procuratorate has realized the innovation and development of people's mediation work, integrated the people's mediation theory with modern procuratorates, promoted criminal reconciliation, helped resolve contradictions, and improved the quality and efficiency of cases. In August 2020, on the basis of the mechanism of procurators " linking towns into villages" for procurators, the Xinchang County Procuratorate also implemented the 12309 procuratorial service center to enter the township (street) spear adjustment center to achieve global coverage of procuratorial services, implement a procurator docking a town (street), and give full play to the professional advantages and governance capabilities of procurators through the "package cadre system".
Since 2021, the Xinchang County Procuratorate has regularly "sat on duty" through procurators to promote the timely resolution of contradictions and disputes at the source by carrying out legal publicity, participating in contradiction mediation, and holding on-site (temporary) hearings, and in half a year, the procuratorate has participated in the mediation of more than 50 cases of various types.
