At present, the phenomenon of illegal transfer and disposal of solid waste from large cities to surrounding small counties and remote villages and towns is more prominent. Only by adhering to the whole chain, the whole link, and the whole process to find out the illegal and criminal network, and tracing back to the source and cutting off the chain of interests, can we completely eradicate the breeding soil for ecological and environmental violations. This case is of typical significance in the investigation and handling of illegal transfer and disposal of solid waste across cities.
02 Brief introduction of the case
On March 17, 2021, the Qianxian Branch of the Xianyang Municipal Bureau of Ecology and Environment found during the on-site inspection of Jiangcun Town, Qianxian County, that a large amount of solid waste (mainly municipal domestic sludge and livestock and poultry manure) was piled up in a field in Tianshuang Village, Jiangcun Town, and no preventive measures were taken at the scene. After investigation, the stacking site is leased land for a farmers' professional cooperative in Qianxian County, which is building a breeding greenhouse for the earthworm breeding project, and there is no relevant document for the environmental impact assessment of the construction project. The law enforcement personnel of the Qianxian sub-bureau ordered the cooperative to stop construction and filed a case to investigate the company's illegal act of building first without approval. At the time of the March 23 investigation, the cooperative did not stop the construction of the project as required.
Further investigation found that the municipal sludge piled up came from the sewage treatment plant of a water company in Xi'an, which was transferred and dumped to the site by a Shaanxi environmental protection technology company. In view of the fact that the environmental protection technology company was registered in Xi'an City, and the contact with the company's legal representative was unsuccessful, Qianxian immediately set up a special team composed of public security departments, ecological and environmental departments and village and town governments to investigate the illegal transfer and dumping of sludge by the environmental protection technology company. The special case team went to Xi'an City many times to investigate and collect evidence, and through the public security household registration system to find and contact the company's legal person to cooperate with the investigation.
After investigation, the environmental protection technology company illegally transferred and dumped the sludge entrusted by the sewage treatment plant of a water company in Xi'an City to the project site of a farmers' professional cooperative in Qianxian County by way of resale. The sludge was piled up without any protective measures.
The law enforcement personnel of the Qianxian Sub-bureau retrieved the sludge monitoring report provided by a water affairs company in Xi'an, showing that the monitoring results of the total mercury, total arsenic, copper and zinc in the sludge produced by the company's sewage treatment plant met the "Pollutant Discharge Standards for Urban Sewage Treatment Plants" (gb18918-2002).
03 Investigation and handling
In accordance with the provisions of Article 25 and Article 31, Paragraph 1 of the Environmental Impact Assessment Law of the People's Republic of China, and with reference to the "Shaanxi Provincial Benchmarks for the Discretion of Environmental Administrative Punishment", the Municipal Bureau of Ecology and Environment imposed an administrative penalty of 30,000 yuan on a farmer's professional cooperative in Qianxian County; in accordance with Articles 19 and 63, Paragraph 1 of the Environmental Protection Law of the People's Republic of China, and Article 3 of the Interim Measures for the Transfer and Application of Cases of Environmental Detention by Administrative Departments, Chen Mou, the company's legal representative, was transferred to the public security organs for ten days of detention.
The Municipal Bureau of Ecology and Environment imposed an administrative penalty of 160,000 yuan on an environmental protection technology company in Shaanxi in accordance with the provisions of article 40, paragraph 10, item 10 of the Law of the People's Republic of China on the Prevention and Control of Solid Waste Pollution.
Rectification situation: On May 11, 2021, when law enforcement officers inspected the rectification situation, the pile of sludge had been thoroughly cleaned up.
04 Case Implications
To crack down on environmental violations of solid waste, it is necessary to find a breakthrough, find out the upstream and downstream, and form a high-pressure situation of the whole chain of attack, in order to build a solid regional ecological environment safety barrier.
Solid waste pollution prevention and control involves solid waste generation, collection, storage, transportation, utilization, disposal and other links, daily supervision and law enforcement, after grasping the clues, it is necessary to follow the vine to find the melon, trace the root cause, when necessary, and the administrative departments with supervision and management responsibilities joint action, joint law enforcement, completely cut off the chain of illegal interests, squeeze and eradicate the space for its breeding and spreading to the greatest extent, in order to force the supervision and service objects to actively perform the main responsibility of environmental protection, to achieve law-abiding operation and green development.
