If the employee is injured in an accident or is diagnosed or appraised as an occupational disease according to the Law on the Prevention and Control of Occupational Diseases, the unit to which he belongs shall submit an application for recognition of the work injury to the social insurance administrative department within 30 days from the date of diagnosis or appraisal of the occupational disease. If the employer fails to submit an application for recognition of work injury within the prescribed time, the treatment of the work injury and other related expenses incurred during this period shall be borne by the employer;

8. If the worker is injured or suffers from an occupational disease due to a labor accident and needs to suspend labor and receive medical treatment for the work injury, during the period of suspension of employment, the original wage and welfare benefits will remain unchanged and shall be paid by the unit on a monthly basis;

9. If an injured worker who is unable to rely on himself due to work reasons needs care during the period of suspension of business to retain salary, the work unit shall be responsible;

10. Where the employee's disability due to work is grade 1 to 4, the employer and individual shall pay the basic medical insurance premium in accordance with the disability allowance standard;

11. If the employee is disabled due to work, it is regarded as a fifth- or sixth-level disability, and the labor-management relationship with the employer is retained and normal work is arranged. For employees with difficulties, the disability allowance is paid on a monthly basis, the standard is: 70% of the wage at level 5 and 60% of the salary at level 6, and the employer pays various social insurance premiums for them within the specified time. If the actual amount of disability benefit is lower than the local minimum wage, the difference is paid by the employer;

12. The employee may terminate or terminate the labor relationship with the employer according to his own requirements, and the employer shall pay him a disability employment allowance.
