author:Hebei Traffic Police

On the afternoon of April 4, the Hebei High-speed Traffic Police Xiabancheng Brigade received an alarm from Mr. Qu, a truck driver, saying that he had a traffic accident on the Chengqin Expressway, and the goods on the car were broken due to the sudden braking, resulting in property damage.

The truck's driving recorder captured the moment of the accident

After receiving the police, the police quickly rushed to the scene to understand the situation. When the two vehicles drove back and forth to a fork in the road, the SUV in front of them suddenly stopped, and the truck in the rear took emergency braking to cause the goods on the car to collide and shatter, and the SUV in front of them then drove away.

The police contacted the off-road vehicle driver Ms. Yang according to the license plate number recorded by the dashcam, Ms. Yang admitted that it was because she was not familiar with the road conditions, afraid of taking the wrong road at the fork in the road, and then stopped to observe the road sign, through the reversing mirror also found that the truck braked because of its sudden stop, but saw that the truck did not contact with its own vehicle, did not realize that it would cause losses, and then left.

According to Article 119 of the Road Traffic Safety Law, "traffic accident" refers to the event of personal injury or property damage caused by the fault or accident of the vehicle on the road.

From the definition of "traffic accident", "contact" is not a precondition for constituting a traffic accident and the assumption of liability. As long as the conduct of the parties has a causal relationship and played a role in the occurrence of the traffic accident, they should bear corresponding liability.

The above case is a typical non-contact traffic accident, in which the vehicles of the two sides did not have direct contact, but it does not mean that the vehicle in front is not responsible, and the rear vehicle did not maintain a sufficient safety distance during the driving process and did not bind the goods firmly.

In the end, through the education and coordination of the police, the two drivers realized their mistakes in the driving process, and they were also very afraid of the serious consequences that might occur, and said that they would strictly abide by the traffic laws and accidents in the future, and the two sides reached an understanding agreement.

Traffic police reminder

Drivers must plan the driving route before traveling to prevent traffic accidents caused by emergency braking or reversing at the fork of the highway because the route is not familiar;

When the truck travels, it is necessary to bundle and strengthen the goods on the car to avoid the safety threat to other passing vehicles due to the falling off of the goods due to sudden braking;

When driving at high speed, it is necessary to always maintain a sufficient safety distance from the car in front to prevent the sudden braking of the car in front and the change of lanes due to too close distances, resulting in traffic accidents and personal and property losses.
