The cause of the accident originated from the formation of an employment relationship
Before the accident, in order to facilitate the transportation of employees and save money, Fan XX, a family farm operator in Qinglong Manchu Autonomous County, hired a three-wheeled car without a number plate, while the driver of the three-wheeled car, Zhang XX, never obtained a driver's license.
At 6:05 p.m. on August 17, Mr. Zhang drove a three-wheeled car carrying 17 farm employees along the village road of Beiganshu Village in Longwangmiao Township from east to west to the intersection of S265 Provincial Road. When the three-wheeled car turned south, the heavy dump semi-trailer driven by Ma Moumou also drove from south to north along S265 Provincial Road to the same intersection. When Ma Moumou found the three-wheeled car, he wanted to avoid it, but it was too late. After the collision between the right front of the heavy dump truck and the front part of the three-wheeled car, the heavy dump semi-trailer drove out of the road, the three-wheeled car overturned, the driver of the three-wheeled car, Zhang xx, the passenger Shen xx, Zhang xx, Tian xx, Li xx, died, and the other 13 passengers were injured to varying degrees. Cause of the accident
After in-depth investigation, the police handling the case analyzed the causes of the accident: Zhang Moumou did not obtain a motor vehicle driver's license to drive, did not register a three-wheeled car according to law, illegally carried people on the road, and did not let the straight-moving vehicle go first when turning.
The parts of the motor vehicle driven by Mr. Ma do not meet the technical standards, change the structure of the motor vehicle without authorization, observe the intersection without careful observation, fail to drive safely and civilized in accordance with the operation specifications, exceed the maximum speed indicated by the speed limit sign, and do not slow down and slow down at the intersection without light control and no sign marking line control are other factors that cause accidents.
The police determined that Zhang X and Ma X bore equal responsibility in this accident, and the 17 passengers on the three-wheeled car were not responsible.
