Zhang Yan, former secretary of the Hongcun Community Party Branch in Jinzhai County, was sentenced in the first instance in the case of embezzlement and bribery

On May 12, this reporter learned from the Jinzhai Court of Lu'an City that the court recently publicly pronounced a verdict in the first instance on the case of Zhang Yan, former secretary of the Party Branch of the Hongcun Community in Jinzhai County, for embezzlement and bribery. He was sentenced to 10 months' imprisonment and fined RMB100,000 for the crime of embezzlement; sentenced to one year and two months' imprisonment and fined RMB102,000 for the crime of accepting bribes; and decided to carry out the fixed-term imprisonment of one year and six months and fined RMB202,000. More than 199,000 yuan (which has been returned) of defendant Zhang Yan's illegal gains were recovered, confiscated, and handed over to the state treasury.

After trial, the court ascertained that from March 2013 to March 2018, when defendant Zhang Yan was the secretary of the party branch and director of the neighborhood committee of the Hongcun Community in Meishan Town, he took advantage of his position to fraudulently increase project funds to defraud more than 86,000 yuan of state funds; from 2009 to 2019, he took advantage of his position to seek benefits for others in handling matters such as the entry of newborns into the household, the application for urban minimum guarantee and low-cost rental housing, and illegally accepted more than 110,000 yuan in cash from others.

After trial, the court held that defendant Zhang Yan took advantage of his position as secretary of the party branch and director of the neighborhood committee of the Hongcun community to fraudulently obtain more than 86,000 yuan of state funds by inflating the project funds, constituting the crime of embezzlement; in handling matters such as entering the household of newborn babies for others, applying for urban minimum guarantees and low-rent housing, illegally accepting other people's property and property, seeking benefits for others, and soliciting other people's property and property when paying for the project, constituting the crime of accepting bribes and should be punished according to law. Defendant Zhang Yan committed several crimes, and shall be punished together with several crimes in accordance with law. In view of the fact that he truthfully confessed the facts of the crime after he arrived at the case, he voluntarily admitted guilt in court, returned all the illegal gains, and was a first-time offender, so the above judgment was made.
