
On the morning of October 25, Judge Deng Wei of the Criminal Division of the Hanyang District People's Court held a public hearing to hear Xu's case of illegally operating and selling counterfeit drugs. This case is the first criminal incidental civil public interest litigation case in the region.
From April 2017 to April 2018, defendant Xu used WeChat to contact Shangjia without obtaining a drug business license, and repeatedly purchased drugs worth a total of RMB 697611 and sold them. On April 18, 2018, the Wuhan Food and Drug Administration seized various drugs with a value of RMB24,910 worth of metformin hydrochloride tablets (Gehuazhi) that he had not yet sold in Xu's rented housing. After identification, it was found that the above drugs worth 7511 yuan of atorvastatin calcium tablets (Lipitor) were counterfeit drugs. The Hanyang District Procuratorate filed a criminal lawsuit against defendant Xu for the crime of illegal business operation and the crime of selling counterfeit drugs, and filed an attached civil public interest lawsuit, requesting that defendant Xu be ordered to issue an apology and warning statement in the national media. Sentencing in the case will be scheduled.
