【Yu talks more than that】
As we all know, China has established a people's assessor system, which embodies the democratization of the judiciary and the people's mastery, and can also ensure judicial fairness to a certain extent, which has a great role in promoting judicial fairness and promoting the fair law enforcement of the courts. But at the same time, we must also soberly realize that this system is still perfect enough, and in some places or within a certain range, it is still a new thing that "form is greater than content"; there are still such and such problems in the selection and performance of responsibilities of people's assessors; and ordinary people think of people's assessors to some extent when they encounter law-related problems.
All of this, the film "Twelve Citizens" and The film review of Yi Huan have been well interpreted or interpreted.
I read "Twelve Citizens" because of the article sent to me by the Ascendas brothers. 1 small scene, 12 small actors, the posture of the stage play, rich in content and profound in thought.
This kind of film is very small, but it is the kind that is easy to attract. If I had to give a list of 2015 films, "Twelve Citizens" is at least one of the best in terms of ideological depth, media orientation, plot setting, actor acting skills, shooting techniques, detail control, and artistic perspective. Although this subject has been photographed many times by various countries, there is no doubt that it was filmed on the shoulders of "others", the shock brought to people's hearts by this narrow scene is still not to be underestimated, especially when 12 citizens come out of the factory, the feeling of complete release is moving.
The filming of this film is of epochal significance, and a series of unjust, false and wrongly decided cases triggered by the "Hug case" have surfaced, making the public realize that only the spirit of the rule of law, the principle of rule of law and the systems, systems and mechanisms that can be realized can protect our lives and rights from being wrongly deprived of "according to law".
However, when we are excited and want to complain about unjust cases and call for judicial justice, there are actually more deep-seated things that we need to think about.
From the perspective of mass psychology, the IQ of the group is low, and it is easy for them to take the simplest form to make the simplest judgment, and the jury group is certainly no exception. So, shortly after the film began, when Juror No. 8 was the only one to put forward the presumption of the suspect's innocence, I became very interested in his profession.
Anyone who has studied group psychology a little should know that for a group of people gathered together, if there is no common direction and goal guidance, although they are a group in form, it is actually difficult to form group psychological characteristics.
Well, the only possible common goal of the 12-member jury at first was time, Juror No. 3 wanted to hurry up and run his taxi, Juror No. 7 remembered that there was a pile of ice cream in the refrigerator and quickly melted away, Juror No. 10 was anxious to go back to collect the rent... So the first round of voting began, everyone was in a hurry, thinking of ending this "meaningless discussion" as soon as possible, and only Juror No. 8 objected.
Therefore, the good thing about this drama is that the writers and directors have such common sense. And at the end, a scene was set up specifically for Juror No. 8 to return to the room to retrieve the "prosecutor's" work card.
From the perspective of the average moviegoer, such a character and plot setting may not be as touching as the words of the architect in the American "Twelve Angry Men". But I think that "Twelve Citizens" made by our Chinese director is more in line with science and logic. Moreover, juror No. 8 in the plot guides other jurors step by step to have "reasonable doubts", which can be called a typical successful case of using hinting techniques to actively influence group psychology. In fact, British and American lawyers and judges have long been skilled in influencing jury decisions, starting with the selection of jury lists. In the simplest example, if there is a case in which a white man harms a black man, the first thing the white defense attorney does is to do everything in his power to get rid of all the black people on the jury candidate.
Therefore, I think that a good jury system should avoid the common direction and goals of jury members. If you pull a few people at random, just to reflect the form of a jury, then the only common goal of these people will only be to rush, choose to rush or be at the mercy of others. If the pure "reasonable doubt" is the basis and the purpose is to respect life, then the efficiency of the judgment will be greatly reduced, and if the rich second generation in "Twelve Citizens" is really the murderer, this "reasonable doubt" is also very likely to lead to a wrong verdict.
Therefore, after so many years of development, all countries have basically adopted the principle of "eliminating reasonable doubt", which is not a thing created to protect the victims, but to facilitate the conviction of judicial organs. Of course, since this exists, the advantages certainly outweigh the disadvantages. Like many social systems, the balance between this is difficult to grasp, and the contradictions are never reconciled.
At present, the only effort we can do is to improve the source of ordinary participation in the jury as much as possible, such as giving material rewards or obligations to regulate, so that each jury member can actively participate in it, rather than in vain. Of course, if there is a better way to keep the jury members from thinking independently, preventing them from forming group psychological characteristics, and at the same time taking into account the efficiency of the judgment, then it should be near-perfect.

I accidentally joined the army for more than 20 years, and I spent a lot of effort to live my life as the most disliked look.
