In order to promote the high-quality development of urban parks and improve the urban ecology and living environment, in accordance with the Construction Law of the People's Republic of China, the Regulations on Urban Greening and other laws and administrative regulations, the Ministry of Housing and Urban-Rural Development has formulated the Measures for the Management of Urban Parks, which makes specific provisions on the planning, construction, protection and management of urban parks, provides legal guarantees for promoting the development of urban parks, is conducive to improving the service functions of urban parks, improving the level of management services, and better meeting the diverse needs of the people for sharing green space. Effectively enhance the people's sense of gain and happiness. These Measures shall come into force on December 1, 2024.

Measures for the management of urban parks

Article 1 These Measures are formulated in accordance with the Construction Law of the People's Republic of China, the Regulations on Urban Greening, and other laws and administrative regulations in order to promote the high-quality development of urban parks and improve the urban ecology and living environment.

Article 2 The term "urban park" in these measures refers to the city with garden landscape and service facilities, with the functions of improving ecology, beautifying the environment, leisure and recreation, fitness and entertainment, inheriting culture, protecting resources, popular science education and emergency refuge, and opening to the public, including parks built by using park green space and other parks included in the directory of urban parks.

Article 3 These measures apply to the planning, construction, protection and management of urban parks.

Article 4 The competent department of housing and urban-rural development under the State Council shall be responsible for guiding and supervising the work of urban parks nationwide.

The competent departments of housing and urban-rural construction of the people's governments of provinces and autonomous regions shall be responsible for guiding and supervising the work of urban parks within their respective administrative areas.

Municipalities directly under the Central Government, municipalities, municipal districts, county people's Governments to determine the competent departments of urban landscaping (hereinafter referred to as the competent departments of urban landscaping) in accordance with their duties is responsible for the supervision and management of urban parks within their respective administrative areas.

Article 5 Urban parks are public welfare urban infrastructure.

The funds required for the planning, construction, protection and management of urban parks shall be guaranteed by the competent departments of urban landscaping and applying to the financial authorities.

Sixth urban landscaping authorities shall establish a directory of urban parks, and report to the competent departments of landscaping at the next level. The directory of urban parks shall include the name, category, location, area, management unit, supervision unit and contact information of the park, and shall be disclosed to the public.

The competent departments of urban landscaping shall, according to the size, function, location, etc., classify and grade urban parks, and implement differentiated management in terms of maintenance funds, assessment and inspection.

Seventh urban landscaping departments shall strengthen the construction of informatization, improve the level of digitization and intelligence in the management of urban parks.

Encourage scientific and technological research on urban parks, promote the application of new materials, new processes, and new technologies, and improve the quality and function of urban parks.

Article 8: Units and individuals are encouraged to participate in the planning, construction, protection, and management of urban parks in accordance with law through methods such as adoption, donations, and volunteer services, and promote the joint construction, co-governance, and sharing of urban parks.

Nineth urban landscaping departments shall, in accordance with the urban green space system planning and other relevant planning, build a balanced layout, rich types, complete functions, good quality urban park system.

The competent department of urban landscaping shall, in the process of urban renewal, improve the urban park system according to the results of the urban physical examination, and promptly propose a plan or plan to optimize the layout of urban parks and improve service facilities, and implement it in accordance with the division of functions.

Tenth urban landscaping authorities in accordance with the relevant provisions of the review of the design plan of urban park construction projects, shall focus on the review of the following aspects:

(1) Whether it meets the requirements of science, ecology and frugality, and implements the concepts of people's cities, green and low-carbon, and safe development;

(2) Whether the selection and allocation of plants are scientific and reasonable, follow the laws of nature and biological characteristics, and reflect the diversity and characteristics of plants and the selection principles of native plants;

(C) whether the proportion of green land meets the requirements, whether the functional layout is reasonable, whether to set up to meet the functional needs of the park, activity venues and parking spaces, public toilets and other facilities, the main entrances and exits of the park are set up with urban traffic, tourist flow, etc.;

(4) Whether to protect ancient and famous trees, buildings (structures) with cultural value and historical relics, and natural relics with scientific value in urban parks;

(5) Whether resources and features such as natural mountains, water bodies, topography, landforms, wetlands, and biological species are protected;

(6) Whether it highlights the humanistic connotation and regional characteristics, and integrates history, culture, art, traditional crafts, etc.;

(7) Whether it complies with other requirements stipulated in laws, regulations and technical standards.

Article 11 The design of urban park construction projects shall be undertaken by the design unit with corresponding qualifications.

Article 12 Urban park construction projects shall be constructed in accordance with the approved design plan and relevant provisions, and the examination and approval procedures for engineering construction projects shall be handled in accordance with law.

The construction enterprise undertaking the landscaping project in the urban park construction project shall have the landscaping professional and technical personnel and skilled personnel who match the contracted project, and the project leader shall have the corresponding professional and technical ability and on-site management work experience. Special projects such as housing construction, municipal public utilities, water conservancy and hydropower in urban park construction projects shall be undertaken by construction enterprises with corresponding qualifications.

13th urban landscaping departments shall, in accordance with urban disaster prevention and mitigation and other relevant plans, coordinate with relevant departments to use urban parks to build emergency shelters.

Article 14 Urban parks shall, in accordance with the standards for the construction of barrier-free facilities, construct barrier-free facilities. If the existing urban park does not meet the construction standards of barrier-free facilities, it shall organize and implement the transformation; Where there are no conditions for the renovation of barrier-free facilities, necessary alternative measures shall be taken in accordance with law.

Article 15 After the completion of the urban park construction project, the construction unit shall organize the completion acceptance in accordance with the law, and the experience can be delivered only after passing the experience.

The construction unit shall, in accordance with the provisions of the State on archives management, timely collect and sort out the documents and materials of all aspects of the construction project, establish and improve the construction project files, and transfer them to the urban construction archives management agency in a timely manner after the completion and acceptance of the urban park construction project.

16th construction unit or urban park management unit shall, after the city park is approved, approved or filed in accordance with law, before being put into use, to the competent department of urban landscaping to submit an application for the naming of the city park, and submit the following materials:

(1) The plan and reasons for naming the city park;

(B) the location, scale, function, nature of the city park and other basic information;

(3) Other materials that shall be submitted in accordance with law.

Where it is necessary to change the name of an urban park, it shall be implemented with reference to the preceding paragraph.

17th application materials complete and meet the following conditions of the city park naming, renaming application, urban landscaping departments shall be approved in accordance with law, and within 15 days from the date of approval of the city park name submitted to the competent administrative departments of geographical names of the people's Governments at the same level for the record:

(1) The meaning is clear, healthy, and does not violate public order and good customs;

(2) Use the standard spoken and written language of the country and avoid the use of rare characters;

(3) Respect local history and citizens' feelings, and pay attention to cultural connotation;

(4) Adapt to the functions of the park such as improving the ecology, beautifying the environment, leisure and recreation, fitness and entertainment, inheriting culture, protecting resources, popular science education and emergency refuge;

(5) Generally, the name of the person is not used as the name of the city park, and the name of the national leader is not used as the name of the city park;

(6) Do not use foreign names and place names as the names of urban parks;

(7) Do not use the name of the enterprise or the name of the trademark as the name of the city park;

(8) Comply with laws, administrative regulations, and relevant state provisions.

18th urban landscaping departments shall, in accordance with the law delineate the urban green line, organize the urban park management unit to set up a green line boundary post and green line public notice board in harmony with the environment, publish the location of the urban park, area, four to the boundary, management units, supervision telephone and other content.

19th urban landscaping authorities shall guide and supervise the urban park management units in accordance with the requirements of the relevant technical standards, do a good job in the conservation and management of urban park plants.

No unit or individual may damage the plants in the city park or cut down trees without authorization. If it is really necessary to cut down trees in urban parks, it must be approved by the competent department of urban landscaping, and replant trees or take other remedial measures in accordance with the relevant provisions of the State.

20th urban landscaping authorities shall organize the investigation, identification, grading, registration, numbering of ancient and famous trees in urban parks, set up signs, delineate the scope of protection, and implement conservation and management responsibilities; In accordance with the requirements of one tree and one file, establish graphic archives and electronic information databases, regularly carry out health assessments of ancient and famous trees, and organize and implement protection measures such as rescue and rejuvenation.

Archives of ancient and famous trees shall include basic information of trees, value significance, geographical location, growth environment, conservation records, protection status, photos and other content. The logo of ancient and famous trees shall include the name of the tree, scientific name, family, age, protection level, number, etc. Qualified urban parks shall set up electronic information codes for signs of ancient and famous trees.

City park archives of ancient and famous trees should be reported to the competent department of landscaping at the next level.

21st urban park management units shall develop daily maintenance and protection plans for ancient and famous trees, improve the growth environment of ancient and famous trees, and implement conservation responsibilities; If it is found that the ancient and famous trees have suffered damage or have significantly weakened growth, they shall be reported to the competent department of urban landscaping in a timely manner.

22nd embodies a certain historical period and within the geographical scope of representative gardening art and construction skills, and has important historical, cultural, artistic, ecological and scientific value of the city park, shall be identified as a historical park in accordance with the relevant provisions.

The competent departments of urban landscaping shall organize the preparation of a plan for the protection of historic gardens and organize the implementation. The Historic Park Conservation Plan includes the following:

(A) the assessment of the status quo of the protection, management and utilization of historic gardens, analysis of their value, characteristics and problems in the protection and management of the use;

(2) Determine the principles of protection, the scope of protection, and the key protection objects within the scope of protection, such as the architectural pattern and style, the plant landscape style, and the original pattern of the mountain water system;

(3) Formulate special protection and utilization measures for the overall protection of historic gardens and key protection objects;

(D) put forward measures to inherit and promote Chinese garden culture;

(5) Put forward requirements for the implementation of safeguards.

If the protection of cultural relics and historical buildings is involved in the historical park, it shall be implemented in accordance with the relevant laws and regulations.

Article 23 The urban park management unit shall be responsible for the daily management of the park and shall do the following work:

(A) establish and improve the park management system, according to the law to develop the park rules;

(2) Keep the garden clean and tidy, and ensure that the equipment and facilities are in good condition;

(3) Do a good job in the greening and maintenance of parks, and keep trees and flowers luxuriant;

(4) Protecting biodiversity and preventing and controlling the encroachment of alien species;

(5) Guide tourists to visit the park in a civilized manner and discourage tourists from uncivilized behavior;

(6) Establish and improve the responsibility system for production safety, do a good job in the investigation and management of hidden dangers, and improve the level of safety management;

(7) Formulate emergency response plans, carry out regular drills, and do a good job in emergency response;

(8) Other work provided for by laws and regulations.

24th urban landscaping departments shall organize the development of urban parks and green space open and shared work, guide the urban park management units to open urban parks in the conditional lawn and understory space.

The management unit of the urban park shall publish the opening hours and scope of the lawn and understory space, improve the surrounding environmental sanitation, safety monitoring and other supporting facilities, and implement rotational maintenance and management of the open lawn according to factors such as the size of visitors, plant characteristics and climatic conditions.

Article 25: Urban park management units shall, in light of the actual conditions of the park, improve supporting service facilities such as for recreation, culture, popular science, reading, and fitness, and use electronic display screens and other facilities to carry out publicity and education, and enhance the service functions of urban parks.

26th urban landscaping departments shall regulate the business activities of urban park supporting service projects, and strengthen supervision and management.

Urban park management units shall, in accordance with relevant provisions, organize and carry out supporting service project business activities and provide convenient services. Where new commercial supporting service facilities are set up in urban parks, they shall comply with the requirements of the approved urban park construction project design plan and relevant technical standards.

It is strictly forbidden to set up private clubs in urban parks in the form of self-construction, leasing, contracting, transferring, lending, mortgage, buyout, joint venture, cooperation, etc.

Article 27: Urban parks shall be open every day. If it is necessary to temporarily close due to special circumstances, the competent departments of urban landscaping and urban park management units shall use the Internet, radio and television, urban park billboards and other channels to release information on the closure of the park in advance.

For urban parks that implement closed management, the urban park management unit shall disclose the opening and closing times to the public.

Article 28 Visitors shall visit the park in a civilized manner, abide by the park management regulations, take care of the flora and fauna and facilities in the park, and protect the park environment.

29th in violation of the provisions of these measures, the construction unit or the city park management unit without authorization for the naming of urban parks, renaming, in accordance with the relevant provisions of the Regulations on the Administration of Geographical Names shall be punished.

30th in violation of the provisions of these measures, damage to the plants in the city park or cut down trees without authorization, in accordance with the urban greening regulations and other relevant provisions shall be punished.

Article 31 Where construction, design, construction and other units violate the provisions of these Measures in the construction activities of urban park construction projects, they shall be punished in accordance with the "Construction Law of the People's Republic of China", the "Regulations on the Quality Management of Construction Projects" and other relevant laws and regulations.

32nd urban landscaping department staff in the supervision and management of urban parks abuse of power, dereliction of duty, favoritism or other illegal acts, shall be punished according to law; where a crime is constituted, criminal responsibility is pursued in accordance with law.

Article 33: These Measures take effect on December 1, 2024.
