Recently, the Pu'an Court heard a case involving telecommunications fraud.
Basic facts of the case: In April 2023, defendants Yang purchased 3 mobile phone cards from and Li, and defendants Yang and Wu went to Zhao's home, inserted a phone card with one mobile phone, and after downloading an APP on the other phone, they connected the two mobile phones together to commit fraud, resulting in the victim Qiu being defrauded of 5,000 yuan and the two illegally making a profit of 1,260 yuan.
In May 2023, the defendant Yang purchased 3 phone cards from Zhang, and committed fraud in the above way, resulting in the victims Ma and Huang being defrauded of 10,000 yuan and 20,000 yuan respectively, and the two illegally made a profit of 1,080 yuan.
It was also ascertained that in October 2023, the defendant Wu Moumou provided a bank card to others to "run points" to obtain benefits, receiving a total of more than 78,000 yuan in transfers, receiving more than 54,000 yuan in defrauded funds from 13 victims including Tan, and Wu Moumou made illegal profits of 1,110 yuan.
Trial process: Defendants Yang and Wu clearly knew that others were committing telecommunications network fraud and provided mobile phone cards to help commit fraud, and their conduct constituted the crime of fraud. Defendant Wu XX clearly knew that it was criminal proceeds in order to obtain money, but still provided his bank card for receiving criminal funds and making profits, involving more than 54,000 yuan of defrauded funds, and his conduct constituted the crime of covering up and concealing criminal proceeds. The Pu'an People's Court sentenced the defendant Yang to one year imprisonment and a fine of 8,000 yuan in accordance with law. In summary, the Pu'an Court sentenced Wu to two years and seven months in prison and a fine of 24,000 yuan.
The judge reminded that the general public should raise their awareness of prevention and self-protection, and do not rent, lend, or sell their bank cards, mobile phone cards, and various third-party payments and social media accounts for temporary profits!
