Recently, a neighborhood dispute was caused by a water leak in an old community, where an elderly couple lived upstairs and a young girl who had just bought a house downstairs. Due to the long-term unresolved water leakage problem, the little girl downstairs reported to the police, and after community mediation failed, she sued to the Xishan District People's Court of Kunming City, hoping to resolve the conflict through legal means.
During the preliminary mediation process, both parties were very emotional. The old couple upstairs thought that they had redone the waterproofing, and that it was the little girl who damaged the wall structure when she was decorating the house herself, causing the water to leak, and it had nothing to do with them. The little girl downstairs believes that she has not damaged the wall structure, and the long-term water leakage upstairs has caused the new house she bought to be unable to move in.
On May 8, in the face of the two sides of their own opinions, the staff of the Jinbi Court decided to visit the scene, communicate with the little girl to understand the situation of the house, and observe the leakage point. Then go upstairs to the old couple's house and listen to their attitude and handling of the water leak. The old couple said excitedly: "There is no problem with the house we have lived in for decades, and we have solved the water leakage upstairs by ourselves, so why should she ask for compensation, obviously she broke the wall by herself in the ...... of the renovation herself."
After patient persuasion by the court staff, the old couple was willing to go downstairs to check the leakage. Then carried out the water leakage test, upstairs to turn on the faucet to make the ground water, more than ten minutes later, downstairs did appear water leakage, after the old couple went downstairs for the second time to check, the two sides gradually put down the mustard in their hearts, sat down to negotiate a solution. After several rounds of communication, a settlement was finally reached.
The court staff struck while the iron was hot, reminding both parties to tolerate and understand each other in daily life, pay attention to the ways and means of communication in case of trouble, and jointly maintain neighborhood harmony. In the end, the two sides shook hands and made peace.
The upstairs leaks, the downstairs suffers, and if it is not handled properly, it will only exacerbate the conflict. The successful mediation of this dispute not only safeguarded the legitimate rights and interests of both parties and promoted neighborhood harmony, but also fully reflected the efforts made by Jinbi Court in practicing the "Fengqiao Experience" in the new era and substantively resolving conflicts and disputes.
