On April 22, 2024, the Ministry of Commerce of the People's Republic of China (hereinafter referred to as the Ministry of Commerce) received an application for anti-dumping investigation formally submitted by Yunnan Yuntianhua Co., Ltd., National Energy Group Ningxia Coal Industry Co., Ltd., Kaifeng Longyu Chemical Co., Ltd., Yankuang Lunan Chemical Co., Ltd., Tangshan Zhonghao Chemical Co., Ltd., and PetroChina Inner Mongolia New Materials Co., Ltd. (hereinafter referred to as the "Applicants") on behalf of the Chinese mainland copolymer polyformaldehyde industry. Anti-dumping investigations were conducted on imports of polyoxymethylene copolymers from Taiwan and Japan. In accordance with the relevant provisions of the Anti-dumping Regulations of the People's Republic of China, the Ministry of Commerce reviewed the applicant's qualifications, the relevant situation of the product applying for investigation, the relevant situation of similar products in Chinese mainland, the impact of the product under investigation on the industry in Chinese mainland, and the relevant situation of the country (region) applying for investigation.

According to the evidence provided by the applicant and the preliminary review by the Ministry of Commerce, the applicant's production of polyacetal copolymer accounted for more than 50% of the total output of similar products in Chinese mainland in 2021, 2022 and 2023, which is in line with the provisions of Articles 11 and 13 of the Anti-dumping Regulations of the People's Republic of China on applications for anti-dumping investigation by industries in Chinese mainland. At the same time, the application contains the contents and relevant evidence required for the anti-dumping investigation and filing stipulated in Articles 14 and 15 of the Anti-dumping Regulations of the People's Republic of China.

Based on the results of the above review, and in accordance with Article 16 of the Anti-dumping Regulations of the People's Republic of China, the Ministry of Commerce has decided to conduct an anti-dumping investigation on imported polyacetal copolymers originating in the European Union, the United States, Taiwan and Japan from May 19, 2024. The relevant matters are hereby announced as follows:

1. Case filing and investigation and investigation period

Since the date of this announcement, the Ministry of Commerce has conducted an anti-dumping investigation on imported polyoxymethylene copolymers originating in the European Union, the United States, Taiwan and Japan, and the dumping investigation period determined in this investigation is from January 1, 2023 to December 31, 2023, and the industrial injury investigation period is from January 1, 2021 to December 31, 2023.

2. The product under investigation and the scope of the investigation

Scope of investigation: Imported acetal copolymer originating from the European Union, the United States, Taiwan and Japan

Name of the product under investigation: polyoxymethylene copolymer, also known as polyoxymethylene copolymer, or polyoxymetene copolymer

Main uses: Acetal copolymer has good mechanical comprehensive properties such as high mechanical strength, high fatigue resistance, high creep resistance, etc., and can partially replace copper, zinc, tin, lead and other metal materials, and can be directly used or modified for auto parts, electronic appliances, industrial machinery, daily necessities, sports equipment, medical appliances, pipe fittings, building materials and other fields.

This product is classified in the "Import and Export Tariff of the People's Republic of China (2023)": 39071010, 39071090. Other products such as acetal homopolymer and modified acetal under these tariff codes are not within the scope of this investigation.

3. Register for the survey

Interested parties shall, within 20 days from the date of this announcement, register with the Trade Remedy Investigation Bureau of the Ministry of Commerce to participate in this anti-dumping investigation. Interested parties participating in the investigation shall provide basic identity information, the quantity and amount of the products under investigation exported or imported into Chinese mainland, the quantity and amount of similar products produced and sold, and the related information in accordance with the Reference Format for Registration to Participate in the Investigation. The Reference Format for Registration to Participate in Investigations can be downloaded from the Trade Remedy Investigation Bureau sub-website of the Ministry of Commerce website.

Interested parties shall register to participate in this anti-dumping investigation and submit an electronic version through the "Trade Remedy Investigation Information Platform" (https://etrb.mofcom.gov.cn), and submit a written version at the same time as required by the Ministry of Commerce. The electronic and written versions should be the same in content and in the same format.

The interested parties mentioned in this announcement refer to the individuals and organizations specified in Article 19 of the Anti-dumping Regulations of the People's Republic of China.

4. Access to public information

Interested parties can download, read, transcribe and copy the non-confidential copy of the application submitted by the applicant in this case by downloading it from the sub-website of the Trade Remedy Investigation Bureau on the website of the Ministry of Commerce or going to the Trade Remedy Public Information Reference Room of the Ministry of Commerce (Tel: 0086-10-65197878). During the course of the investigation, interested parties may inquire about the public information of the case through the relevant website, or go to the Trade Remedy Public Information Reference Room of the Ministry of Commerce to find, read, transcribe and copy the public information of the case.

V. Comments on the filing of the case

Interested parties may submit written comments to the Trade Remedy Investigation Bureau of the Ministry of Commerce within 20 days from the date of this announcement if they need to comment on the scope of the survey, the qualifications of the applicants, the countries (regions) under investigation, and other relevant issues.

6. Investigation methods

According to Article 20 of the Anti-dumping Regulations of the People's Republic of China, the Ministry of Commerce may use questionnaires, sampling, hearings, on-site inspections and other means to obtain information from relevant interested parties and conduct investigations.

In order to obtain the information required for the investigation of this case, the Ministry of Commerce usually issues a questionnaire to interested parties within 10 working days from the date of the deadline for registration to participate in the investigation as stipulated in this announcement. Interested parties can download the questionnaire from the Trade Remedy Investigation Bureau sub-website of the MOFCOM website.

The "Questionnaire on Foreign (Regional) Exporters or Producers of the Anti-dumping Case of Polyacetal Copolymer" asks for information including the company's structure and operation, the products under investigation, export sales to Chinese mainland, domestic (regional) sales, operation and finance, production costs and related expenses, estimated dumping margins and checklists. The "Questionnaire on Chinese Mainland Producers of the Anti-dumping Case of Polyacetal Copolymer" asks for information including the company's basic information, similar products, operation and related information, financial and related information, and other issues that need to be explained. The "Questionnaire on Chinese Mainland Importers in the Anti-dumping Case of Copolymer Polyoxymethylene" asks for information, including the basic information of the company, the trade of the products under investigation and related information.

Interested parties shall submit complete and accurate answers within the specified time. The questionnaire should include all the information requested in the questionnaire.

7. Submission and processing of information

Interested parties submitting comments and answers during the investigation process shall submit electronic versions through the "Trade Remedy Investigation Information Platform" (https://etrb.mofcom.gov.cn), and submit written versions at the same time as required by the Ministry of Commerce. The electronic and written versions should be the same in content and in the same format.

If the information submitted by the interested party to the Ministry of Commerce needs to be kept confidential, it may submit a request to the Ministry of Commerce for confidential treatment of the relevant information and explain the reasons. If the Ministry of Commerce agrees to its request, the interested party applying for confidentiality shall also provide a non-confidential summary of the confidential information. The non-confidential summary should contain sufficient meaningful information to enable other stakeholders to have a reasonable understanding of the confidential information. If a non-confidential summary cannot be provided, the reasons should be stated. If the information submitted by the interested party does not indicate that it needs to be kept confidential, the Ministry of Commerce will treat the information as public information.

8. Consequences of non-cooperation

According to Article 21 of the Anti-dumping Regulations of the People's Republic of China, when the Ministry of Commerce conducts an investigation, the interested party shall truthfully reflect the situation and provide relevant information. If the interested party does not truthfully reflect the situation or provide relevant information, or fails to provide the necessary information within a reasonable time, or otherwise seriously obstructs the investigation, the Ministry of Commerce may make a ruling based on the facts already obtained and the best information available.

9. Investigation period

The survey will start on May 19, 2024 and should normally be concluded by May 19, 2025, with an extension of 6 months in exceptional circumstances.
