This is the first drug trafficking case concluded by the hospital since October 1, 2023, when etomidate was officially included in the control of Class II psychotropic substances by the state.
Case review
In 2023, Pei Mou A, Pei Mou B, and Chen invited two minors (handled in a separate case) to participate in the sale of e-cigarette cartridges containing etomidate.
Pei Moujia and other five people successively sold "top e-cigarettes" to 3 people a total of 6 times, a total of 8, and made a profit of 1,900 yuan. After that, Pei Moujia and five others were arrested red-handed by the public security organs. In the course of the litigation, Pei X A, Pei X B, and Chen X respectively paid a fine of RMB 15,000 and returned RMB 1,900 of illegal gains.
At trial, the court held that Pei X A, Pei X B, and Chen X knew that they were drugs, but still used minors to sell them many times, and the circumstances were serious, and their actions constituted the crime of drug trafficking.
The three defendants played a major role in the joint crime and are the principal offenders, and shall be punished in accordance with all the crimes in which they participated, organized, or directed. Defendant Pei X A, within 5 years of the completion of the criminal punishment, commits another crime that should be sentenced to fixed-term imprisonment or higher, is a recidivist and shall be given a heavier punishment. Defendants Pei X A and Pei X B truthfully confessed their crimes after they arrived at the case, and they confessed and may be given a lighter punishment. 3. Where the defendant voluntarily admits guilt and accepts punishment, he may be given a lenient disposition in accordance with law; Where unlawful gains are returned, a lighter punishment may be given as appropriate.
Therefore, Pei Moujia was sentenced to four years and eight months imprisonment and fined 15,000 yuan in accordance with the law; Pei Mouyi was sentenced to three years and eleven months imprisonment and fined 15,000 yuan; Chen was sentenced to four years and four months in prison and fined 15,000 yuan; The illegal gains of RMB 1,900 returned by the three defendants shall be confiscated and turned over to the state treasury; The seized items involved in the case are to be handled by the Nanzhang County Public Security Bureau in accordance with law.
Etomidate, commonly known as "tobacco powder", is a white powdery substance insoluble in water, which has a sedative-hypnotic effect and is an anesthetic prescription drug. After illegal use of etomidate, dizziness, unsteadiness on standing, mental excitement and even mental disorders that affect people's emotions, thinking, volitional behaviors, and even lead to death.
Etomidate will be included in the list of Class II psychotropic drugs from October 1, 2023, and will be included in the list of drugs, which is a drug in the sense of the criminal law, and illegal smoking, possession, and trafficking of etomidate will be treated as drug-related violations and crimes.
