01What is a high temperature allowance?

In June 2012, the State Administration of Work Safety, the Ministry of Health, the Ministry of Human Resources and Social Security, and the All-China Federation of Trade Unions issued a notice on printing and distributing measures for the administration of heatstroke prevention and cooling measures, which stipulates that workers who engage in high-temperature work are entitled to post allowances in accordance with the law.

02Under what circumstances can I enjoy the high temperature allowance?

In June ~ October of each year, if the employer arranges the worker to work in the open air and cannot take effective measures to reduce the temperature of the workplace to below 33°C (excluding 33°C), the employer shall pay the employee a high temperature allowance on a monthly basis, and specify the specific items and amounts in the wage list.

03 Units will be penalized if they do not pay high temperature allowance

The court reminded that the high temperature allowance is a component of labor remuneration (wages), and the payment of high temperature allowance is the legal obligation of the employer, not a "welfare" that can be paid or not. Soft drinks are not eligible for the high temperature allowance. It is an offence to fail to issue it; If the payment is not made in full, it shall be deemed to be in arrears or deducted wages

If an employer violates the provisions of the Measures for Labor Protection in Hot Weather in Guangdong Province and fails to pay high temperature allowance to employees, the competent department of human resources and social security at or above the county level shall order it to make corrections within a time limit and give it a repayment; If the correction is not made within the time limit, a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed.

04 If the maximum temperature exceeds 39 °C, outdoor operations should be stopped

During the following hot weather periods, employers shall reasonably arrange working hours, reduce labor intensity, and take effective measures to ensure the health and safety of employees:

  • If the daily maximum temperature reaches 39°C or above, outdoor work should be stopped on that day.
  • When the daily maximum temperature reaches above 37 °C and below 39 °C (excluding 39 °C), the outdoor working time shall not exceed 6 hours throughout the day, and the outdoor and open-air work shall be suspended at 12~16 o'clock.
  • If the maximum daily temperature reaches 35°C or more to less than 37°C (excluding 37°C), the employer shall shorten the continuous working time by changing shifts and taking breaks, and shall not arrange overtime work for workers working outdoors and in the open air.

05 Pregnant female employees shall not be arranged to engage in high-temperature work

Employers shall not arrange for pregnant female employees and juvenile workers to work in the open air in hot weather above 35°C or in workplaces with a temperature above 33°C.

06 If the operation is stopped due to high temperature, the salary shall not be deducted

Employers are not allowed to deduct or reduce employees' wages due to stopping work or shortening working hours due to hot weather.

07 High temperature allowance is not included in the minimum wage and normal working time wage

Article 12 of the Minimum Wage Regulations stipulates that the wages payable by an employer to an employee shall not be lower than the local minimum wage standard if the employee provides normal work:

  • Extended working hours pay.
  • Allowance for medium shift, night shift, high temperature, low temperature, underground, toxic and harmful and other special working environments and conditions.
  • Laws, regulations and national provisions of labor welfare, etc.

The Administrative Measures for the Payment of High Temperature Allowance clearly state that the normal working time wage and minimum wage standards do not include high temperature allowance.
