Chapter I: General Provisions

Article 1 In order to strengthen the management of non-motor vehicles, prevent and reduce safety accidents, ensure the safety of life and property of urban and rural residents, improve the governance capacity of megacities and the quality of park city demonstration areas, in accordance with the provisions of the Road Traffic Safety Law of the People's Republic of China, the Product Quality Law of the People's Republic of China, the Fire Protection Law of the People's Republic of China, the Regulations on the Implementation of the Road Traffic Safety Law of the People's Republic of China and other laws and regulations, combined with the actual situation of Chengdu, these Regulations are formulated.

Article 2 These Regulations apply to the production, sale, registration, passage, maintenance, parking, charging and replacement of non-motor vehicles and their supervision and management activities within the administrative area of this city.

Article 3 The term "non-motor vehicles" as used in these Regulations refers to vehicles that are driven on the road by human or animal power, as well as electric bicycles, motorized wheelchairs for the disabled, and other means of transportation that are driven by power units but are designed to meet the relevant national standards such as maximum speed, empty mass, and dimensions.

The term "electric bicycle" as used in these Regulations refers to a two-wheeled bicycle that conforms to national standards, uses an on-board battery as an auxiliary energy source, has the ability to pedal and ride, and can realize the functions of electric assistance and electric drive.

"Motorized wheelchairs for persons with disabilities" as used in these Regulations refers to wheelchairs that meet the national standards for motorized wheelchairs, are designed for persons with disabilities with lower limbs, and are all operated by the driver's upper limbs.

Fourth city and district (city) and county people's Governments shall establish and improve the coordination mechanism for the management of non-motor vehicles, to ensure the necessary funds for the work, to urge the relevant departments to perform their duties of supervision and management in accordance with the law, and to improve the scientific, standardized and refined level of non-motor vehicle management.

Town people's Governments, sub-district offices shall supervise and urge the relevant units within their jurisdiction to implement the management responsibilities of non-motor vehicles.

Article 5 The public security organs are responsible for the registration and traffic management of non-motor vehicles.

The market supervision department is responsible for the supervision and management of the production, sales and maintenance of non-motor vehicles and related products.

The competent department of transportation is responsible for the supervision and management of the Internet rental bicycle industry.

The competent department of housing and urban-rural development is responsible for supervising and urging the property service provider to manage the parking and charging of non-motor vehicles in the property management area it undertakes.

The postal administration department is responsible for the supervision and management of the field of non-motor vehicle safety management of express delivery enterprises.

The fire and rescue agency is responsible for the comprehensive supervision and management of the fire safety work of non-motor vehicles.

The competent department of ecology and environment is responsible for the supervision and management of the recycling and disposal of hazardous wastes such as waste lead-acid batteries.

Development and reform, economy and information, finance, planning and natural resources, urban management, commerce, emergency response, disabled persons' federation and other units in accordance with their respective responsibilities, do a good job in the management of non-motor vehicles, establish and improve mutual cooperation in law enforcement work and information sharing mechanisms.

Article 6 State organs, enterprises, public institutions, social groups and other organizations shall carry out publicity and education on the lawful and safe use of non-motor vehicles for their personnel.

The administrative departments in charge of education and schools shall include road traffic safety and fire safety education for non-motor vehicles in legal education. Minors' parents or other guardians shall strengthen safety education for minors using non-motor vehicles.

Media such as radio, television, newspapers and periodicals, and the Internet shall strengthen public interest publicity on laws and regulations related to the safety management of non-motor vehicles.

Article 7: All units and individuals have the right to dissuade conduct that violates the provisions of these Regulations, and may also make complaints and reports through the 12345 government service hotline.

Chapter II Vehicle Management

Article 8 The batteries, chargers and other products of non-motor vehicles and electric bicycles produced and sold in this city shall comply with relevant national standards.

Manufacturers and importers of electric bicycles shall, in accordance with relevant national regulations, entrust a certification body with statutory qualifications to conduct compulsory product certification for the electric bicycles they produce or import.

Electric bicycles that have not obtained compulsory product certification shall not be sold and registered in the city.

Electric bicycle manufacturers are not allowed to sell non-complete electric bicycles that do not contain key components such as batteries and chargers.

Article 9 Non-motor vehicle operators shall implement the purchase inspection and acceptance system, and establish a purchase ledger and a sales ledger; Information such as product qualification certificates shall be publicized in a conspicuous position in the sales venue; E-bikes should be sold separately from other types of vehicles, and the type of vehicle should be prominently indicated.

E-commerce platform operators shall conduct verification and registration of information such as the identity certificates (business licenses), addresses, contact information, and compulsory vehicle product certification certificates of sellers applying to enter the platform for the sale of non-motor vehicles; Where it is discovered that non-motor vehicles sold on the platform violate the provisions of relevant laws and regulations, necessary measures shall be taken in accordance with law to deal with them and a report shall be made to the market regulation departments.

Sellers of electric bicycles shall not sell electric bicycles that are inconsistent with the information of the compulsory product certification certificate and the actual product, or the key components such as batteries and chargers equipped with the information of the product certification are inconsistent with the information of the product certificate.

Article 10 It is forbidden to install or modify power devices on non-motor vehicles, or remove or alter the speed limiting device of electric bicycles, and other behaviors that change technical parameters and affect driving safety; It is forbidden to set up a canopy, install a pylon, install or modify a seat on a non-motor vehicle, and other behaviors that change the shape and structure of the non-motor vehicle and affect driving safety.

It is forbidden to sell non-motor vehicles with illegal additions or modifications in the preceding paragraph.

Article 11 If a maintenance operator undertakes the maintenance business of an electric bicycle, it shall repair and replace the parts in accordance with the technical parameters and safety requirements specified in the product certificate and compulsory product certification certificate, and keep them consistent with the specifications, models and technical parameters of the original parts.

Article 12 Producers and sellers of non-motor vehicles and their batteries shall provide replacement and recycling services for used batteries and establish recycling accounts. Encourage non-motor vehicles and their battery producers, sellers, and maintainers to recycle waste batteries by trade-in, discounted repurchase, etc. Non-motor vehicle waste batteries that belong to hazardous waste shall be sent to units with corresponding disposal qualifications for centralized disposal.

The competent department of ecology and environment shall organize the establishment of collection outlets for hazardous wastes such as waste lead-acid batteries, and announce them to the public.

Chapter III: Traffic Management

Article 13 The following non-motor vehicles shall be registered with the public security organs and obtain non-motor vehicle license plates and driving licenses before they can be driven on the road:

(1) Electric bicycles;

(2) Motorized wheelchairs for the disabled;

(3) Human-powered tricycles;

(D) the provincial people's Government shall be registered on other non-motor vehicles.

Newly purchased non-motor vehicles that should be registered and licensed, the driver can temporarily pass through within 15 days after purchasing the vehicle with the purchase certificate.

Article 14 The non-motor vehicles provided for in Article 13 of these Regulations shall submit the following materials for registration and licensing, and submit the vehicle for on-site inspection:

(1) Personal identification certificates or unit uniform social credit code certificates, business licenses, and so forth;

(2) Proof of purchase or other proof of lawful origin;

(3) Non-motor vehicle qualification certificate or import certificate.

If you apply for the registration and licensing of electric bicycles, you should also submit the compulsory product certification mark of electric bicycles.

Those who apply for a motorized wheelchair license plate certificate for the disabled shall also submit a certificate of lower limb disability in accordance with law.

The public security organs shall release the non-motor vehicle registration procedures, materials to be provided, and model texts to the public, and adopt methods such as setting up additional registration points, simplifying handling procedures, and handling them online to facilitate the public's handling of non-motor vehicle registration.

Where the application materials are complete and conform to the statutory form, the public security organs shall issue non-motor vehicle number plates and driving licenses; Where the application materials are incomplete or do not conform to the legally-prescribed form, they shall be notified of all the content that needs to be supplemented and corrected at one time; If the requirements are not met, the registration shall not be made and the reasons shall be explained in writing to the applicant.

Article 15 The city implements total regulation and control of Internet rental bicycles.

The municipal department in charge of transportation shall establish an information service platform for the Internet rental bicycle industry. The municipal transportation department, the municipal public security organ, and the municipal urban management department shall carry out policy formulation, parking point planning and parking order management in accordance with their duties, and on the basis of extensive listening to public opinions, implement the evaluation of the quality of Internet rental bicycle service quality, and dynamically adjust the number of vehicles put on the Internet rental bicycle operating enterprises according to the evaluation results.

Internet rental bicycle operators shall follow the requirements of the total volume regulation and dynamic adjustment mechanism, orderly release and recovery of vehicles, and strengthen daily scheduling and parking management.

The specific regulatory measures for Internet rental bicycles shall be formulated separately by the municipal people's government.

Article 16 Within the administrative area of Jinjiang District, Qingyang District, Jinniu District, Wuhou District and Chenghua District, except for the specific needs of municipal, sanitation and other public utilities, the new non-motor vehicle license plate and driving license for manpower tricycles shall not be transferred.

The people's governments of districts (cities) and counties outside the administrative areas specified in the preceding paragraph shall strengthen the standardized management of human-powered tricycles within their jurisdictions.

Article 17 Where the ownership of a registered non-motor vehicle is changed or transferred, the owner of the non-motor vehicle shall apply to the public security organ for the registration of the change of transfer; If it is no longer on the road due to scrapping, damage, loss, loss or other reasons, the owner of the non-motor vehicle shall apply to the public security organ for cancellation of registration.

Article 18: Public security organs shall, in accordance with the relevant provisions of the State and Sichuan Province, collect information on registered non-motor vehicles and provide inquiry services to the public.

19th housing and urban-rural development departments in the new, reconstructed, expansion of urban roads shall, in accordance with the requirements of the code synchronous planning, supporting the construction of non-motorized lanes.

If the non-motorized lanes of the completed roads are occupied or the non-motorized lanes are not constructed, the municipal housing and urban-rural development department may, in conjunction with the municipal public security organs, adjust the lane settings according to the actual conditions of the road, and restore or reconstruct the non-motorized lanes.

Public security organs may set up isolation facilities between motorized and non-motorized lanes in accordance with relevant national standards and actual road conditions.

No unit or individual shall occupy a non-motorized lane to park a vehicle or other acts that obstruct the passage of non-motorized vehicles without approval.

Article 20 Non-motor vehicles that have been registered shall hang non-motor vehicle license plates at designated parts to keep the license plates clear and complete. If driving a non-motor vehicle that needs to be registered on the road, the driver shall carry the driving license with the vehicle, and if the electronic driving license is obtained, the paper driving license may not be carried.

It is forbidden to forge, alter, buy or sell or use forged or altered non-motor vehicle driving licenses and license plates, and prohibit the use of non-motor vehicle license plates of other vehicles.

Article 21 Driving a non-motorized vehicle on the road shall comply with the following provisions:

(1) Ensure that vehicle brakes and other safety devices are complete and effective;

(B) obey the traffic signals, obey the command of the traffic management personnel;

(3) Shall not drive a non-motorized vehicle that has been installed or modified on the road;

(4) Do not drive while intoxicated;

(5) Driving in non-motorized lanes; On roads where there are no non-motorized lanes, drive on the right side of the roadway;

(6) Slow down before turning, and turn on the turn signal in advance;

(7) Slow down when passing through a pedestrian crossing, and stop and give way when a pedestrian is passing through a pedestrian crossing; When passing on a road without a traffic signal, if a pedestrian crosses the road, he or she shall avoid it;

(8) Shall not enter highways, urban expressways, elevated roads, upper span bridges, underpass tunnels and other motor lanes and pedestrian streets, as well as areas where signs prohibiting non-motor vehicle traffic are set up;

(9) Do not drive in the opposite direction or enter the sidewalk;

(10) Passing the pedestrian bridge shall be carried out by getting off the car;

(11) Do not carry out hand-held acts that impede safe driving, such as making and receiving phone calls or browsing electronic devices;

(12) Animals shall not be leashed.

Article 22: In addition to complying with the provisions of Article 21, the following provisions shall also be observed when driving electric bicycles or motorized wheelchairs for the disabled on the road:

(1) The driver is at least 16 years old;

(2) The driver of the electric bicycle and the carrying personnel shall wear safety helmets, and the carrying personnel shall ride in the forward direction of the seat;

(3) Do not drive after drinking;

(4) Persons with non-lower limb disabilities are not allowed to drive motorized wheelchairs for persons with disabilities.

Article 23 Relevant enterprises that use non-motor vehicles to engage in express delivery, logistics, take-out and other distribution activities shall implement the main responsibility for production safety and comply with the following provisions:

(1) Establish and improve the internal traffic safety management system and clarify the person responsible for safety;

(2) Establish and improve the management ledger of non-motorized vehicle drivers and non-motorized vehicles, and clearly indicate the driver's traffic safety obligations and liability for breach of contract in the online delivery agreement signed with the driver; Organize drivers to carry out training and assessment of laws and regulations such as traffic safety and fire safety;

(3) Do a good job in daily safety inspections such as maintenance and maintenance of non-motor vehicles;

(4) Persons with potential safety hazards such as diseases that impede safe driving shall not be arranged to drive non-motor vehicles;

(5) Supervise and urge drivers to use electric bicycles, batteries, chargers and other products that meet national standards;

(6) Supervise and urge drivers to standardize driving, standardized parking, and safe charging and replacement;

(7) According to traffic conditions and other factors, reasonably determine standards and requirements such as delivery time and routes, to avoid causing road traffic violations or traffic accidents;

(8) Equip electric bicycle drivers with safety helmets, and purchase third-party liability insurance, personal accident insurance and other insurance as needed;

(9) Other traffic safety management obligations provided for by laws and regulations.

Article 24 Owners or managers of non-motor vehicles are encouraged to purchase third-party liability insurance, personal injury insurance and property damage insurance.

Article 25: Public security organs shall strengthen the application of digital and intelligent technologies in the field of non-motor vehicle traffic management, and increase the level of informatization and intelligence in the management of non-motor vehicles.

Based on the specific conditions of roads and traffic flows, public security organs may adopt traffic management measures that allow motor vehicles to borrow non-motorized lanes to pass.

Chapter 4 Parking and Charging Management

26th public security organs according to the actual road and non-motor vehicle parking needs to plan the road parking location, and by the district (city) and county people's Government to determine the competent department is responsible for management. No other unit or individual shall occupy the road without authorization to set up a non-motor vehicle parking lot.

If an application is made for the establishment of a non-motor vehicle parking lot that occupies the road, it shall be jointly approved by the public security organs and the competent departments to standardize the management.

No unit or individual shall dismantle or damage facilities and equipment such as non-motor vehicle parking location signs and markings without authorization; It is not allowed to occupy the parking area of non-motor vehicles without authorization.

Approved non-motor vehicle parking lots shall not change the nature of use without authorization.

27th stations, hospitals, shopping malls, schools, exhibition halls, theaters, stadiums, parks and other public buildings, public places construction units shall, in accordance with the provisions, supporting the planning, construction of non-motor vehicle public parking facilities, management units shall implement the management of special personnel.

Flammable and explosive places, production plants, logistics warehouses and other production and operation sites shall plan and support the construction of non-motor vehicle parking places and centralized charging facilities. If it is not possible to set up a centralized parking place due to objective conditions, a safe area shall be set aside as needed, and a relatively concentrated temporary parking point for non-motor vehicles shall be set up.

Article 28 New residential quarters shall be planned and supported by the construction of centralized parking places for non-motor vehicles and centralized charging facilities. Residential quarters that have been built shall, according to the actual situation, add or reconstruct centralized parking places for non-motor vehicles and centralized charging facilities.

Article 29 Non-motorized vehicles parked in public places shall be parked in the parking lot of non-motorized vehicles in an orderly manner. If there is no parking lot for non-motor vehicles, it shall be parked in the designated area. If there is no demarcated area, non-motor vehicle parking shall not occupy blind roads and green spaces, shall not obstruct the passage of other vehicles and pedestrians, and shall not affect the city environment.

Article 30 The parking and charging of electric bicycles shall comply with the safety requirements of electricity and ensure fire safety, and shall not engage in the following acts:

(1) Parking or charging in areas such as public foyers, shared walkways, stairwells, evacuation passages, and safety exits of buildings, or in indoor areas of crowded places;

(2) Using an elevator car to carry an electric bicycle and its battery;

(3) Enclosing or blocking fire hydrants or occupying fire spacing;

(4) Violating the requirements for safe electricity use and privately connecting wires and sockets for charging;

(5) Other violations of fire safety regulations.

Article 31 Property service providers shall strengthen the safety management of electric bicycles in the property management area, implement the fire safety responsibility system, formulate fire extinguishing and emergency evacuation plans, regularly inspect the area under management, and eliminate potential fire safety hazards in a timely manner.

Where property management service providers discover violations of article 30 of these Regulations, they shall promptly dissuade and stop them, and where they refuse to make corrections, the property management service providers shall report to the relevant departments and assist in handling them.

In the event of a safety accident or emergency, the property service provider shall take emergency measures in a timely manner, and report to the relevant competent departments and assist in handling them.

Article 32 The managers of electric bicycle charging sites shall establish a safety management system for electricity use, set up special sockets, install safety devices such as leakage protection, equip fire extinguishing equipment, and do a good job of routine maintenance, inspection and emergency response.

Encourage and support the installation of charging facilities with functions such as regular charging, automatic power cut-off, and fault alarm, as well as automatic fire alarm and automatic fire extinguishing facilities, in electric bicycle parking places.

Chapter V: Legal Responsibility

Article 33: Where paragraph 4 of article 8 of these Regulations is violated by electric bicycle manufacturers who sell non-complete electric bicycles that do not contain key components such as batteries and chargers, the market regulation departments are to order corrections and impose a fine of between three times the equivalent value of the products sold.

Where a seller violates the provisions of paragraph 3 of Article 9 of these Regulations by selling electric bicycles that are inconsistent with the information on the compulsory product certification certificate and the actual product, or that are equipped with key components such as batteries and chargers that are inconsistent with the information on the product certificate, the market regulation department shall order corrections and impose a fine of between three times the equivalent value of the products sold (including sold and unsold products).

Article 34: Whoever violates the provisions of Article 10 of these Regulations by engaging in the commercial installation or modification of non-motor vehicles, or the sale of the installation or modification of non-motor vehicles, shall be fined not less than three times the equivalent value of the products sold (including sold and unsold products).

Article 35: Whoever violates the provisions of items 5 to 12 of Article 21 and items 2, 3 and 4 of Article 22 of these Regulations by driving a non-motor vehicle on the road, shall be ordered by the public security organs to make corrections and given a warning or a fine of not less than 5 yuan but not more than 30 yuan.

Whoever violates the provisions of Item 4 of Article 21 of these Regulations by driving a non-motor vehicle while intoxicated shall be fined 50 yuan by the public security organ.

Article 36: Whoever violates paragraph 2 of Article 20 of these Regulations by forging, altering, or buying or selling non-motor vehicle license plates, shall be fined not less than 500 yuan but not more than 1,000 yuan by the public security organs, and confiscate the forged, altered, or bought or sold non-motor vehicle license plates.

Article 37: Where a unit or individual commits any of the following acts, the public security organs may first detain the non-motor vehicle and notify the driver to accept the punishment in a timely manner:

(1) Whoever violates the provisions of Article 13 of these Regulations by driving a non-motor vehicle that has not been registered in accordance with law on the road, shall be ordered to make corrections by the public security organ and fined 50 yuan;

(2) Whoever violates the provisions of paragraph 2 of Article 20 of these Regulations by using forged or altered non-motor vehicle license plates or using other non-motor vehicle license plates, shall be confiscated by the public security organs and fined between 50 and 200 RMB;

(3) Whoever violates the provisions of Item 3 of Article 21 of these Regulations by driving a non-motor vehicle that has been added or modified onto the road, shall be ordered by the public security organ to restore the original state and shall be fined not less than 30 yuan but not more than 100 yuan.

After the public security organs detain the vehicle, they shall promptly verify the relevant information, handle it on the spot and issue a voucher, and inform the parties to come to the public security organs to accept the handling within the prescribed time limit. If it is necessary to provide proof of legal sources such as purchase invoices, the driver shall cooperate.

If the disposition is not accepted within the time limit, and the disposition is still not accepted after three months of notification and announcement, the public security organ has the right to deal with the impounded vehicle in accordance with law.

Article 38: Where the provisions of Article 23 of these Regulations are violated by enterprises that use non-motor vehicles to engage in express delivery, logistics, take-out and other distribution activities and fail to perform their enterprise safety management provisions and traffic safety management obligations, the competent department of the industry shall order corrections and impose penalties in accordance with the relevant provisions of laws and regulations in the field of production safety.

Article 39: Whoever violates the provisions of Paragraphs 1, 2, or 3 of Article 30 of these Regulations by parking or charging in areas such as public foyers, shared walkways, stairwells, evacuation passages, and safety exits of buildings, or in indoor areas of densely populated places, using elevator cars to carry electric bicycles and their batteries, enclosing or blocking fire hydrants, or occupying fire spacing, shall be ordered to make corrections by the fire and rescue organization, and shall be fined between 5,000 and 50,000 RMB to units, and to be given warnings or fines of up to 500 RMB to individuals.

Article 40: Where laws or regulations already have provisions on legal responsibility for other conduct that violates the provisions of these Regulations, follow those provisions.

Chapter VI Supplementary Provisions

Article 41: These Regulations take effect on June 1, 2024.
