Misfire Crime

Acts that cause a fire due to the negligence of the perpetrator, causing serious consequences and endangering public safety. According to the provisions of the mainland criminal law, it is one of the crimes of endangering public safety. According to the second paragraph of Article 115 of the Criminal Law of the People's Republic of China, whoever commits the crime of arson shall be sentenced to fixed-term imprisonment of not less than 3 years but not more than 7 years;

Interpretation

The crime of arson refers to the conduct of causing a fire due to the negligence of the perpetrator, causing serious consequences and endangering public safety. It is an offence to endanger public safety by negligently causing a fire.

If a fire is caused by negligence and any of the following circumstances is suspected, a case shall be filed for prosecution:

(1) Causing the death of one or more persons, or the serious injury of three or more persons;

(2) Causing direct economic losses of 500,000 yuan or more to public property or other people's property;

(3) Causing the houses of 10 or more families and other basic means of subsistence to be burned down;

(4) Causing forest fires, with an area of 2 hectares or more of forest land, or an area of 4 hectares or more of sparse forest land, shrub land, undeveloped forest land, or nursery land;

(5) Other situations causing serious consequences.
