Civil Aviation Administration of China interprets the "Civil Aviation Metrology Management Regulations"

On April 22, according to the website of the Civil Aviation Administration of China, a few days ago, the Ministry of Transport announced the "Regulations on the Administration of Civil Aviation Metrology" (Order No. 6 of the Ministry of Transport in 2024), which will be officially implemented on June 1, 2024. In order to facilitate relevant units and individuals to better understand the content of the Regulations, and to truly do a good job of implementing them, they are hereby interpreted as follows:

This regulation is a comprehensive revision of the Regulations on the Administration of Civil Aviation Metrology of China (Decree No. 55 of the Civil Aviation Administration of China) promulgated by the former Civil Aviation Administration of China on October 11, 1996. This revision complies with the national metrology regulations, clarifies the metrology supervision responsibilities of the Civil Aviation Administration of China, and strives to be accurate, meticulous and easy to understand the content of the text. The overall framework removes the division of chapters, adjusts the "definition" to the "supplementary provisions", adds the provisions of the measurement technical specifications of the civil aviation department, simplifies the legal responsibility, and deletes the provisions on rewards and punishments and funds. The key points that need to be interpreted in these regulations are as follows:

Article 1 Purpose of formulation

Article 1 of the original provisions is deleted "in order to facilitate the realization of safety first, normal flight, and high-quality service", focusing on the main responsibilities of measurement work, and adding "Detailed Rules for the Implementation of the Metrology Law of the People's Republic of China" and other laws and administrative regulations" as the basis for formulating rules.

Article 2 Scope of Application

Article 2 of the original text is deleted from "measurement management" and "measurement and testing", and is changed to "civil aviation measuring instrument management, the establishment and use of special measurement standards for civil aviation, and the formulation and revision of measurement technical specifications of civil aviation departments", which further clarifies the scope of supervision of civil aviation measurement work according to the superior law.

Article 3 Units of measurement

Clarify the requirements for the use of civil aviation units of measurement. It stipulates: "Civil aviation measurement implements the national legal unit of measurement system, including the International System of Units unit of measurement and other units of measurement selected by the state. If a non-national legal unit of measurement is used, it shall be implemented in accordance with the relevant provisions".

Article 4 Metrology management responsibilities of the Civil Aviation Administration of China

Summarize the responsibilities of the Civil Aviation Administration of China in metrology management, stipulating: "The Civil Aviation Administration of China shall supervise and manage the measurement work of civil aviation in accordance with its duties. The Civil Aviation Administration of China may entrust a civil aviation metrology technical support unit to be specifically responsible for the implementation of relevant metrology in the field of civil aviation".

According to the adjustment of the responsibilities of the Civil Aviation Administration of China, Article 5 of the original regulations "the measurement management responsibilities of the regional civil aviation administration" is deleted; according to the actual civil aviation measurement work, the original provisions of Article 5 "requirements for the measurement management institutions of enterprises and institutions", Articles 7 to 10 "the work responsibilities of the civil aviation three-level measurement technology institutions", and Article 11 "the representative system of the measurement technology entrusting units" are deleted, so as to give full play to the role of the market in resource allocation and fully stimulate the vitality of market entities.

Article 5 Traceability of civil aviation measuring instruments and their values

According to the upper-level law, refine the requirements for the use and value management of civil aviation measuring instruments. It is stipulated that "general measuring instruments shall be traced to the national measurement standards or social public measurement standards in accordance with relevant national regulations, and special measuring instruments for civil aviation shall be traced to special measurement standards for civil aviation". Article 15 of the original provisions is deleted, "if the imported special measuring instruments cannot be verified in China, they shall be sent abroad for verification", and stipulates: "If the imported special measuring instruments for civil aviation cannot be traced in China, they can be traced by means of international comparison". After adjustment, the traceability of the value of civil aviation measuring instruments is more in line with the current management requirements of the country, and is also better in line with international standards.

Article 6 The process for establishing special measurement standards for civil aviation

According to the superior law, Article 13 of the original provisions is deleted, "special measurement standard instruments shall be organized by the measurement management department of the Civil Aviation Administration", stipulating: "The Civil Aviation Administration may, according to the needs of work, entrust civil aviation enterprises and institutions to establish special measurement standards for civil aviation. If the highest special measurement standard for civil aviation is established, the entrusted unit shall apply to the metrology administrative department of the State Council through the Civil Aviation Administration, and use it after passing the assessment under the auspices of the metrology administrative department of the State Council". The establishment and assessment of special measurement standards for civil aviation is an administrative licensing item of the metrology administrative department of the State Council, and the Civil Aviation Administration of China has no relevant assessment and approval responsibilities, which is more in line with the requirements of the current national measurement regulations after the amendment.

Article 7 Conditions for the establishment and use of special measurement standards for civil aviation

According to the upper-level law, clarifying the conditions that should be met for the establishment and use of special measurement standards for civil aviation is conducive to better guiding industry units to carry out the establishment and use of standards.

Article 8 Requirements for the verification of special measurement standards for civil aviation

According to the superior law, the verification requirements of the special measurement standards for civil aviation are clarified, and it is stipulated that "the highest special measurement standards for civil aviation shall be subject to compulsory verification, and other special measurement standards for civil aviation shall be verified by the user unit on a regular basis or sent to other measurement and verification institutions". The upper-level law only requires mandatory verification of the highest special measurement standards for civil aviation, and other special measurement standards for civil aviation do not stipulate the verification method, and the requirements of these regulations are consistent with the higher-level law.

Article 9 The data quality of the civil aviation metrology verification institution

In order to ensure the accuracy and reliability of the measurement value and clarify the data quality of the civil aviation metrology verification agency, it is stipulated that "the accuracy and traceability of the measurement data issued by the civil aviation metrology verification agency shall comply with the requirements of relevant laws and regulations and measurement technical specifications".

Article 10 Data management requirements of civil aviation metrology verification institutions

In order to ensure the accuracy and reliability of the measurement value and clarify the data management requirements of the civil aviation metrology verification agency, it is stipulated that "the civil aviation metrology verification agency shall establish a traceability mechanism for measurement data, results and other necessary information, and shall establish archives for the relevant records and report copies of the measurement process and conditions".

Article 11 Requirements for civil aviation metrology verification institutions to carry out compulsory verification work

Clarify the work requirements of mandatory verification. The superior law only stipulates the requirements for compulsory verification, and requires the compulsory verification work according to the superior law and the actual work of civil aviation. It is stipulated that "the civil aviation metrology verification institution that carries out compulsory verification work shall be authorized by the metrology administrative department of the people's government at or above the county level to become a legal metrology verification institution, and obtain the authorization to carry out metrological verification work". Article 22 of the original provisions is deleted: "For foreign technical institutions undertaking the verification of special measuring instruments for civil aviation in China, the measurement management department of the Civil Aviation Administration shall organize the accreditation work in accordance with the relevant requirements". The authorization of metrological verification is an administrative licensing item of the national metrology administrative department, and the Civil Aviation Administration of China has no relevant examination and approval responsibilities. After the revision, the civil aviation metrological verification work is more in line with the requirements of the upper law.

Clarify the management requirements of metrology personnel. According to the superior law, the management requirements for metrology personnel after the cancellation of the administrative licensing items for metrology inspectors are implemented, and the fifth chapter of the original provisions "metrology personnel" is deleted, stipulating that "metrology verification personnel who perform mandatory verification tasks shall obtain the professional qualification certificate of registered metrologists and register". Article 18 of the original provisions is cancelled, "the measurement standard instruments, metrology verification personnel, environmental conditions and rules and regulations of metrology technical institutions at all levels shall be assessed and approved by the metrology management agency of the Civil Aviation Administration or its designated institutions, and the certificate shall be issued before it can undertake the internal metrology verification, repair, testing and arbitration work of the civil aviation industry".

Clarify the working basis of metrological verification. According to the superior law, it is stipulated that "the measurement verification of special measuring instruments for civil aviation shall be carried out in accordance with the national metrological verification regulations or the metrological verification regulations of the civil aviation department".

Article 12, Article 13 and Article 14 Technical specifications for measurement of civil aviation departments

Clarify the principles, compilation process and release disclosure requirements of the measurement technical specifications of the civil aviation sector, and better guide enterprises and institutions to formulate and implement the measurement technical specifications of the civil aviation sector.

Article 15 Measurement technology innovation awards

In order to encourage technological innovation in measurement, it is stipulated that "the measurement technical specifications of the civil aviation sector with technological innovation or independent intellectual property rights, high technical level and significant benefits shall be rewarded in accordance with the relevant provisions of the state".

Article 16 Supervision and management

According to the superior law, the objects of civil aviation measurement supervision are clarified. Article 19 of the original regulations is deleted: "Aircraft maintenance licenses and product production licenses, and the equipment of measuring instruments for new and expanded airports must meet the requirements of the relevant regulations of the Civil Aviation Administration"; Article 20 of the original regulations is deleted; "The newly developed special measuring instruments for the civil aviation industry shall conform to the relevant provisions of the "Measures for the Administration of New Products of Measuring Instruments" promulgated by the administrative department of metrology under the State Council; Article 21 of the original regulations is deleted When introducing new aircraft or equipment, it is necessary to introduce supporting measuring instruments (including standards) and measurement and testing technical data that cannot be solved in China at the same time. The metrology department shall participate in the introduction of aircraft or equipment, and be responsible for the acceptance of the corresponding supporting measuring instruments and measurement technical data", stipulating: "The Civil Aviation Administration shall supervise and inspect the management of civil aviation measuring instruments and the establishment and use of special measurement standards for civil aviation". After the revision, the civil aviation measurement supervision work is more in line with the actual work and better serves the development of the industry.

Article 17 Penalties

According to the superior law, combined with the measurement supervision responsibilities of the Civil Aviation Administration of China, the violation of these provisions shall be punished.

Article 18 Penalties

Other violations of these provisions that do not exceed the scope of the provisions of the superior law shall be punished in accordance with the provisions of the superior law.

Article 19 Supplementary Provisions

The definitions of "special measuring instruments for civil aviation", "civil aviation metrology verification institutions", "civil aviation metrology technical support units, and civil aviation administrative organs" have been added.
