"The price of cold dishes is not indicated, and the label and the dish are not placed in the same place...... A few days ago, a Beijing consumer reported to the "China Consumer Daily" 3.15 Consumer Voice all-media interactive platform, saying that they encountered "price doubts" when ordering food at the western MCA beef noodle store.

The reporter of "China Consumer Daily" conducted an investigation by visiting three stores on the spot and experiencing the official ordering mini program. In addition to the above situation reported by consumers, the reporter also found that when ordering takeout with the "Western MCA +" applet, there are problems such as the price of dishes being more expensive than dine-in, not providing small noodles, and ordering takeout must be logged in first, and the real name will be displayed on the homepage after logging in, making personal privacy "difficult to hide".

The label and the dish are "not on the right board" and the price is not marked

On April 1, Li Mu (pseudonym), a consumer in Beijing, told a reporter from China Consumer Daily: "I found that the cold dishes sold at the newly opened Western MCA Beef Noodles (Xinjiekou Store) near my home are not clearly priced.

On April 2, the reporter came to the Western MCA Beef Noodle (Xinjiekou store) and saw all kinds of cold dishes in the glass window next to the cashier counter, and the price of each plate of cold dishes was not indicated. The reporter randomly selected a few cold dishes to ask for the price, and the staff told the reporter the price of the dish after checking it from the computer every time. The reporter asked: "The prices of different cold dishes are not marked next to them, can only be informed through computer queries?" The staff did not reply.

On April 4, the reporter visited the Western MCA Beef Noodles (ABP Store) and the Western MCA Beef Noodles (Kandanqiao Store) in Fengtai District, Beijing.

The reporter saw a plate of cold dishes in the glass window of the Western MCA Beef Noodle (ABP store), but there was no label indicating the name and price of the cold dishes. The reporter randomly asked about the price of a few plates of cold dishes and asked: "Why is the price not marked next to the dish?" The staff did not give any explanation after answering the price of the dish.

In the western MCA beef noodles (see Danqiao store), the reporter found that the label of the dish and the cold dish are "not on the right board", the corresponding position of the dish label "Sauce Fragrant Sheep Scorpion" is a plate of peanuts, and the corresponding position of the dish label "Spiced boiled peanuts" is a plate of shredded potatoes, and the price is not indicated on the label of all dishes.

"How much does this pepper chicken cost?" a consumer asked, pointing to the menu in the window. The staff replied that "the large portion is 58 yuan, and the small portion is 38 yuan". The consumer offered to buy a large plate of pepper sesame chicken and divide it into two servings, but the staff refused. In desperation, consumers gave up on the purchase.

The reporter asked the staff for a menu, and saw that there were all kinds of cold dishes in the "refreshing cold dishes" area on the menu, and the price was indicated accordingly. The reporter noticed that the staff of the above three stores would not take the initiative to provide menus unless consumers took the initiative to ask for them.

The price of the same bowl of noodles is different in the same store

The reporter found that the price of a "large piece of beef bone soup beef noodles" on the menu of Western MCA beef noodles (Kandanqiao store) was 28 yuan, while the price of a "large piece of beef bone soup beef noodles" was advertised on the electronic screen in the store as 26 yuan. Upon inquiry, the staff of the store said that the price of this bowl of noodles was 26 yuan.

Recently, the State Administration for Market Regulation issued the "Notice on Continuing to Do a Good Job in the Marketing Norms of Takeaway Merchants to Prevent Food and Beverage Waste", encouraging platforms to improve incentive mechanisms to promote merchants to develop, provide and promote small meals;

The reporter entered the Western MCA Beef Noodles (Xinjiekou Store) in the "Western MCA +" WeChat applet and found a "large piece of beef bone soup beef noodles" with the same picture, and the dining methods were selected as "dine-in" and "delivered to home", and the price of the meal was displayed at 26 yuan and 28 yuan respectively. When you choose "dine-in", you can choose from large slices of beef bone broth (26 yuan), large portions of beef noodles in bone broth (20 yuan) and small portions of beef noodles in bone broth (18 yuan), while when you select "delivery to home", consumers can only choose between large slices of beef bone broth beef noodles (28 yuan) and bone broth beef noodles (20 yuan).

The reporter switched the store to Western MCA Beef Noodles (ABP store) and Western MCA Beef Noodles (Danqiao store), and found that the same was the case.

In response to the reporter's question, the staff of the Western MCA Beef Noodle (ABP Store) said that the "dine-in" of the mini program is the same as the large piece of beef bone broth beef noodle in the takeaway, but the takeaway is a little more expensive. In response to the question of why there is no small portion of bone broth beef noodles for takeaway, the staff of Western MCA Beef Noodles (Kandanqiao store) said that they "don't know".

The real name will be displayed after logging in and authorizing

The reporter's investigation found that when ordering takeout through the "Western MCA +" WeChat applet and choosing to settle, the system will automatically pop up a login page, and you must first check and agree to the "Membership Agreement" and "Privacy Terms", etc., and only after passing the mobile phone number verification can you go to the "Confirm Order" page to submit payment. When the reporter returned to the homepage of the Mini Program, he found that his real name was displayed.

The reporter changed a WeChat account to log in to the "Western MCA +" applet, and successfully logged in after passing the mobile phone number verification, and this time, the name displayed on the homepage was "WeChat user".

Why is there a different display of the same login method? Will personal information be leaked? In response to these problems reported by the reporter, the online customer service of Western MCA said that the mobile phone number will be displayed as a "WeChat user" without authorization, and the personal privacy of users who display their real names will not be leaked or infringed.

Regarding the reply of the customer service, consumer Xie Ying (pseudonym) raised questions. Xie Ying told reporters that when she logged in to the "Western MCA +" applet, she agreed to the steps to obtain and verify her mobile phone number, but after successfully logging in, what was displayed was "WeChat user".

Article 1 of the User Agreement and Privacy Agreement, which was updated on November 20, 2023, in the "Western MCA+" WeChat Mini Program, states: "When you register for our e-account, you need to provide your name, gender, date of birth, contact number, email address and other personal information...... You may decide not to provide the above information, or request the deletion of any information previously provided. However, if you do so, you may not be able to obtain, use, or purchase our products or services, in whole or in part. Article 5 states: "We may share, store or process your personal information with other of our affiliates, partners or suppliers...... In such cases, we will require our affiliates, partners and suppliers to comply with this Policy. ”

According to the WeChat official account of "Western MCA", its affiliated company is Beijing Western MCA Catering Co., Ltd., which currently has more than 100 stores.

Excessive collection of personal information must be stopped

On April 11, Wang Jiucheng, the chief lawyer of Beijing Li Dao Law Firm, said in an interview with the reporter of "China Consumer Daily" that the "Provisions on Clearly Marked Prices and the Prohibition of Price Fraud", "Personal Information Protection Law" and other laws and regulations clearly stipulate that the clear price should be based on the characteristics of goods and services, industries, regions, etc., so as to be true and accurate, the goods are in place, the identification is eye-catching, and personal information is clearly stipulated. The price of the product is not indicated, the menu is not displayed in a public way, and the price of beef noodles is inconsistent with the price displayed on the electronic screen and the menu.

"Personal information processors shall not refuse to provide products or services on the grounds that individuals do not consent to the processing of their personal information or withdraw their consent, and the collection of personal information shall be limited to the realization of the purpose of processing, etc., which is clearly stipulated in the Personal Information Protection Law, and business operators shall not collect excessive personal information. Wang Jiucheng believes that consumers have the right to process their personal information independently, and the merchant mini program cannot order without logging in, and the individual has essentially lost the right to information self-determination or freedom of consent, and the merchant is suspected of forcing consumers to consent to the processing of personal information in disguise. Accordingly, the act of logging in first to order takeout through the merchant mini program is suspected of violating the law. In general, merchants only need to know the number of diners, the number of dishes, the delivery address, telephone number and other information to provide catering services, and the consumer's real name and other information are not directly related to the meal, and the merchant's collection of consumers' real-name information is excessive collection and is suspected of violating personal privacy.

Wang Jiucheng reminded consumers that when purchasing goods or receiving services, they should fully exercise their right to know so that they can make rational choices; personal information is protected by law, understand the value of personal information, understand the risks that may be brought about by the leakage of personal information, and enhance their awareness of self-protection; when encountering consumer problems, collect evidence in a timely manner, and safeguard their legitimate rights and interests in accordance with the law when their rights and interests are harmed.
