In order to give full play to the evaluation and guidance functions of typical cases and the role of warning and education, and to further urge all entities that charge electricity charges to strengthen price self-discipline and standardize the charging of electricity charges, a batch of typical cases of illegal price increases in electricity charges are hereby announced as follows:

Wenchongtan Industrial Zone, Tianhe District

Case of charging electricity bills at a higher price for an apartment

According to the clues reported by the masses, the law enforcement officers of the Tianhe District Market Supervision Bureau inspected and found that Pan Moumou, the manager of an apartment in Wenchongtan Industrial Zone, charged the electricity fee of apartment residents at a charging standard of 1.6 yuan/kWh from May to July 2023, violating the provisions of Article 33, Paragraph 1 of the "Guangzhou Municipal Regulations on Electricity Supply and Consumption".

On August 29, 2023, the Tianhe District Market Supervision Bureau issued a warning and a fine of 13,640.8 yuan to the party in accordance with Article 66 of the Electricity Law of the People's Republic of China.

Case of charging electricity bills at a higher price for a rental house

According to the clues reported by the masses, the law enforcement officers of the Baiyun District Market Supervision Bureau inspected and found that Liang Moumou, the manager of a rental house on Xinshi West Street, Baiyun District, charged tenants electricity fees at a charging standard of 1.5 yuan/kWh from May to June 2023, which violated the provisions of Article 33, Paragraph 1 of the "Guangzhou Municipal Regulations on Electricity Supply and Consumption", and the law enforcement officers ordered the parties to make corrections within a time limit.

The review found that in July 2023, the party concerned was charged at the unit price of 0.6 yuan/kWh for electricity and 0.9 yuan/kWh for the loss and maintenance of power equipment, and the actual electricity charge standard was still 1.5 yuan/kWh.

On October 12, 2023, the Baiyun District Market Supervision Bureau issued an administrative penalty of a warning and a fine of 3,238 yuan to the party in accordance with Article 66 of the Electricity Law of the People's Republic of China.

East Street, Xindun Village, Xintang Town, Zengcheng District

Case of charging electricity bills at a higher price for a rental house

According to the clues reported by the masses, the law enforcement officers of the Zengcheng District Market Supervision Bureau inspected and found that Luo Moumou, the manager of a rental house on East Street in Xindun Village, Xintang Town, Zengcheng District, charged tenants electricity fees ranging from 1.3 yuan/kWh to 1.5 yuan/kWh from May to August 2023, violating the provisions of Article 33, Paragraph 1 of the "Guangzhou Municipal Regulations on Electricity Supply and Consumption", and the law enforcement officers ordered the parties to make corrections within a time limit.

The re-examination found that the parties charged tenants electricity at a price of 0.89 yuan/kWh, and charged a comprehensive management fee ranging from 0.41 yuan/kWh to 0.61 yuan/kWh according to electricity consumption, and the actual electricity charge standard was still 1.3 yuan/kWh to 1.5 yuan/kWh.

On March 7, 2024, the Zengcheng District Market Supervision Bureau issued a warning, fined 20,458 yuan, and confiscated 12,786.26 yuan of illegal gains to the parties in accordance with Article 66 of the Electricity Law of the People's Republic of China.

According to the clues reported by the masses, the law enforcement officers of the Tianhe District Market Supervision Bureau inspected and found that Cao Moumou, the landlord of a rental house on Fengyuan Street in Shipai Village, Tianhe District, charged tenants electricity fees at a rate of 1.5 yuan/kWh from May 2023 to July 2023, violating the provisions of Article 33, Paragraph 1 of the "Guangzhou Municipal Regulations on Electricity Supply and Consumption".

On October 13, 2023, the Tianhe District Market Supervision Bureau issued an administrative penalty of a warning and a fine of 7,286.55 yuan to the party in accordance with Article 66 of the Electricity Law of the People's Republic of China.

Huai'anli Second Lane, Xiaogang Village, Baiyun District

Case of charging electricity bills at a higher price for a rental house

According to the clues reported by the masses, the law enforcement officers of the Baiyun District Market Supervision Bureau inspected and found that Jiang Moumou, the manager of a rental house in Huai'anli Second Lane, Xiaogang Village, Baiyun District, charged tenants electricity fees according to the standard of electricity fee of 0.65 yuan/kWh and electricity loss of 0.85 yuan/kWh from May to September 2023, that is, the actual electricity price of 1.5 yuan/kWh, in violation of the provisions of Article 33, Paragraph 1 of the "Guangzhou Municipal Regulations on Electricity Supply and Consumption".

On January 19, 2024, the Baiyun District Market Supervision Bureau issued an administrative penalty of warning and a fine of 1,130 yuan to the party in accordance with Article 66 of the Electricity Law of the People's Republic of China.

Xinxing Straight Street, Xintang Town, Zengcheng District

Case of charging electricity bills at a higher price for an apartment

According to the clues reported by the masses, the law enforcement officers of the Zengcheng District Market Supervision Bureau inspected and found that Li Moumou, the landlord of an apartment in Xinxingzhi Street, Xintang Town, Zengcheng District, charged the apartment tenant's electricity fee at the standard of 1.3 yuan/kWh from May to September 2023, which violated the provisions of Article 33, Paragraph 1 of the "Guangzhou Municipal Regulations on Electricity Supply and Consumption", and the law enforcement officers ordered the party concerned to make corrections within a time limit.

The re-investigation found that the parties charged some tenants a power transfer fee of 0.88 yuan/kWh, and at the same time charged a maintenance fee according to the electricity consumption on the basis of the above-mentioned electricity price, and the actual electricity charge standard was still 1.3 yuan/kWh.

On March 11, 2024, the Zengcheng District Market Supervision Bureau issued a warning to the parties, fined them 10,360.86 yuan, and confiscated 3,860.54 yuan of illegal gains in accordance with Article 66 of the Electricity Law of the People's Republic of China.

Lane 1, Dongheng Road, Zhucun, Tianhe District

Case of charging electricity bills at a higher price for an apartment

According to the clues reported by the masses, the law enforcement officers of the Tianhe District Market Supervision Bureau inspected and found that Zou Moumou, the manager of an apartment in Lane 1, Dongheng 5th Road, Zhucun, Tianhe District, charged tenants electricity fees at a charging standard of 1.5 yuan/kWh during July 2023, violating the provisions of Article 33, Paragraph 1 of the "Guangzhou Municipal Regulations on Electricity Supply and Consumption".

On November 3, 2023, the Tianhe District Market Supervision Bureau issued a warning and a fine of 12,613.84 yuan to the party in accordance with Article 66 of the Electricity Law of the People's Republic of China.

Guangshan 2nd Road, Tianhe District

A case of a farmer's market manager increasing the price of electricity

According to the clues reported by the masses, the law enforcement officers of the Tianhe District Market Supervision Bureau inspected and found that from May 2023 to September 2023, Guangzhou Hemou Property Management Co., Ltd. collected electricity fees from the second and third floors of a farmers' market on Guangshan 2nd Road.

The above-mentioned acts of the enterprise concerned violated the provisions of Article 33, Paragraph 1 of the Regulations on the Supply and Use of Electricity in Guangzhou. On March 4, 2024, the Tianhe District Market Supervision Bureau issued an administrative penalty of a warning and a fine of 48,273.65 yuan to the party in accordance with Article 66 of the Electricity Law of the People's Republic of China.

Article 33 of the Regulations on the Supply and Consumption of Electricity in Guangzhou stipulates that "no unit or individual shall increase the price of electricity in violation of the national electricity price policy or collect electricity charges in disguise".

Article 43 stipulates that "anyone who violates the provisions of the first paragraph of Article 33 of these Regulations by increasing the price or indirectly increasing the price of electricity shall be dealt with in accordance with the Electricity Law of the People's Republic of China".

Article 66 of the Electricity Law of the People's Republic of China stipulates that "anyone who violates the provisions of Articles 33, 43 and 44 of this Law by failing to collect electricity charges from users in accordance with the records of electricity prices and electricity metering devices approved by the State, setting electricity prices beyond his authority, or adding other fees to electricity charges shall be given a warning by the price administrative department and ordered to return the illegally collected fees, and may be fined not more than five times the amount illegally collected 。
