1. Can electric vehicles drive without going home?
The answer is no, Article 8 of the Road Traffic Safety Law of the People's Republic of China: The state implements a registration system for motor vehicles. Article 18: Non-motor vehicles that shall be registered according to law can only be driven on the road after being registered by the traffic management department of the public security organs, and both motor vehicles and non-motor vehicles must be registered before they can be driven on the road.
2. What are the legal responsibilities of unlicensed and unlicensed electric vehicles on the road?
(1) Impound the vehicle
If a non-motor vehicle driver refuses to pay a fine after being punished for violating the Road Traffic Safety Law, according to Article 89 of the Road Traffic Safety Law of the People's Republic of China, if the non-motor vehicle driver refuses to accept the fine and punishment, his non-motor vehicle may be detained. Article 95 stipulates that if a motor vehicle driving on the road does not hang a motor vehicle number plate, or does not carry a driving license with the vehicle, the traffic management department of the public security organ shall detain the motor vehicle.
(2) Compulsory auction or scrapping
Article 107 of the Regulations for the Implementation of the Road Traffic Safety Law of the People's Republic of China stipulates that the driver or owner, If the manager fails to provide legal proof of the detained motor vehicle within 30 days, fails to go through the corresponding procedures, or does not come to accept the treatment, and still does not come to accept the handling after being notified by the traffic management department of the public security organ and announced for 3 months, the traffic management department of the public security organ shall send the motor vehicle to a qualified auction agency for auction, and the proceeds shall be handed over to the state treasury; the illegally assembled motor vehicle shall be dismantled; the motor vehicle that meets the scrapping standard shall be scrapped; and the motor vehicle shall be handed over to the relevant department for handling if it involves other illegal and criminal acts.
(3) Fines or detention
The "Road Traffic Safety Law of the People's Republic of China" and the "Regulations for the Implementation of the Road Traffic Safety Law of the People's Republic of China" stipulate that fines shall be imposed for driving on roads without hanging license plates and registration, and fines and detention shall be imposed for driving without a license.
(4) Increase the proportion of responsibility for traffic accidents
According to the rules for determining the liability for road traffic accidents, driving on the road without a license or license is an illegal and negligent act, and it may bear the corresponding accident liability after a traffic accident.
3. What are the procedures for dealing with electric vehicles after they are detained?
According to the "Provisions on Motor Vehicle Registration", the identity certificate of the owner of the motor vehicle, the proof of the origin of the motor vehicle such as the purchase invoice, the certificate of conformity of the whole vehicle or the import certificate of the imported motor vehicle, the certificate of compulsory insurance for the liability of motor vehicles, the certificate of tax payment of vehicle purchase tax, the certificate of payment of vehicle and vessel tax or the certificate of tax exemption, etc.
4. Is there a solution to the incomplete procedures of electric vehicles and the inability to go to the household?
(1) Complete the formalities and return the vehicle. Recently purchased vehicles can contact the dealer to re-apply for relevant procedures and vouchers, and the vouchers will be returned for registration. Dealers who deliberately do not provide or conceal the provision may report to the taxation, market supervision and other departments; If you can't go through the procedures due to a long time, you can negotiate with the dealer to trade in the old for the new. If you are not willing to trade in the old for the new, you can apply for scrapping after dismantling the relevant accessories. (3) Direct scrapping. You can contact the scrap recycling company for scrap treatment and receive the scrap residual value as compensation.
