There has been a new development in the case of a 5-year-old boy Xiao Xuan (pseudonym) who was abused by his mother, Gu Moumou, resulting in amputation of both legs and first-degree disability of both eyes.
On April 8, The Paper learned from Xiaoxuan's father, Mr. Men, that he received a notice from the court that on the afternoon of April 11, the Tongzhou District Court of Nantong City, Jiangsu Province will hold a second trial of Gu Moumou's case of abuse. Mr. Men said that in October last year, the case was tried for the first time.
According to the indictment, because Gu Moumou had a weak relationship with Xiao Xuan, and thought that Xiao Xuan was disobedient and disgusted, he often used methods such as beating and scolding, throwing, dragging, punishing the station, tearing his mouth, pushing down the stairs, pulling his hair, pouring cold water, getting out in the rain, forcing him to eat feces, and starving for a long time.
Mr. Men told The Paper that he did not know that Gu Moumou was abusing the child before. In January 2023, he called the police after suspecting that his child had been abused. So far, he can't figure out why Gu Moumou treats children like this, and he hopes that the law will severely punish this kind of child abuse.

Mr. Men is from Anhui Province and his family is poor. In September 2016, Mr. Men and Gu Moumou, who went out to work, got married after being introduced to each other. In May 2017, Xiaoxuan was born. Mr. Men said that Gu Moumou was a native of Nantong, Jiangsu, who lost his father at an early age and depended on his mother for his life. Before Gu Moumou married him, he had a marriage history and gave birth to a daughter.
According to Mr. Men, in October 2017, he and Gu Moumou divorced, and Xiaoxuan was taken back to his hometown by him to be taken care of by the child's grandmother. In October 2021, he and Gu Moumou remarried. In January 2022, after discussion, the two decided to bring Xiaoxuan from his hometown in Anhui to Nantong to raise him together. And he has been working abroad for a long time to support his family's livelihood.
Mr. Men told The Paper that in January 2023, Gu Moumou said on the phone that Xiaoxuan was sick and couldn't walk. When he returned home, he found that Xiao Xuan's legs were red and swollen and sent Xiao Xuan to the hospital for treatment. After that, Xiao Xuan told him, "Mom asked him to stand in cold water, scalded him with boiling water, and didn't give him anything to eat." After suspecting that Xiao Xuan was abused by Gu Moumou, he called the police.
Xiao Xuan's eyes and legs were seriously injured. According to the relevant medical certificates, Xiao Xuan has optic neuropathy in both eyes with a disability level of Grade 1, both lower legs are missing and the disability level is Grade 3, and he suffers from mental epilepsy with a disability level of Grade 2.
Mr. Men said that at present, Xiaoxuan's legs have been amputated and he is wearing prostheses, and he has no vision in his left eye and about 0.01 to 0.02 in his right eye. Xiao Xuan is still hospitalized in Beijing due to the need to treat his eyes, and he does not know when he will be discharged.
Indictment: Ill-treatment due to emotional apathy and disgust
According to the indictment previously made by the Tongzhou District Procuratorate of Nantong City, Gu Moumou was born in 1989, was Chinese, unemployed, and lived in Tongzhou District, Nantong City. In January 2023, Gu Moumou was detained by the local police.
The Tongzhou District Procuratorate of Nantong City said that after review and investigation in accordance with the law, it was found that from February 2022 to early January 2023, Gu Moumou had a weak relationship with the mother and son of the victim Men Moumou (note: referring to Xiaoxuan), and felt disgusted that Men Moumou was disobedient and often urinated on his body, bed, and on the ground, so he often used methods such as beating and scolding, throwing, dragging, punishing the station, tearing his mouth, pushing down the stairs, pulling his hair, pouring cold water, getting out in the rain, forcing him to eat feces, and starving for a long time. In the meantime, in May 2022, the kindergarten teacher found that Men Moumou was obviously emaciated and had multiple traumatic injuries on his body, and reported it to the relevant departments in a timely manner. Gu Moumou still did not repent after being educated and admonished by the relevant departments, and continued to abuse Men Moumou in the above manner, causing him to suffer severe malnutrition, mental malaise, and frequent bruises and skin trauma on his body.
In particular, from November 2022 to the occurrence of the case, Gu Moumou repeatedly injured him by letting Men Moumou stand in a basin of cold water with his feet in a basin of cold water and scrubbing his body by himself, not putting shoes and socks on him, not giving him bedding, letting him lie down without effective warmth measures and clothes, and sleeping alone on the open-air balcony on the second floor for the night, and repeatedly injured him, and knew that Men Moumou's feet were frostbitten and his walking was unstable, but he still did not take him to seek medical treatment, resulting in frostbite on his bilateral ankles in a short period of time. Traumatic subdural hemorrhage caused by a fall, causing intracranial hypertension and decreased vision in both eyes (the injury cannot be identified at this time), and bilateral ankle frostbite necrosis and amputation, the degree of injury to the human body was determined by forensic medicine to be serious injury level 1.
The Tongzhou District Procuratorate of Nantong City believes that Gu Moumou has abused his young son for a long time and frequently, the circumstances are heinous, causing the victim to be seriously injured in the first degree and seriously disabled, the facts of the crime are clear, the evidence is credible and sufficient, and his criminal responsibility should be pursued for the crime of abuse. Gu Moumou's truthful confession of his crime is a confession and can be punished lightly. Gu XX voluntarily admits guilt and accepts punishment, and may be given a lenient disposition.
It is hoped that the abuse will be punished severely
Mr. Men said that he had been working abroad for many years and rarely went home, and he did not know that Gu Moumou abused Xiaoxuan, and he still can't understand why Gu Moumou did this.
According to Mr. Men, after the incident, Gu Moumou did a psychiatric evaluation, and the results of the evaluation showed that he had no mental problems.
Gu Moumou is a native of Yuntai Mountain Village, Pingchao Town, Tongzhou District, Nantong City. A village cadre in Yuntai Mountain Village said in a previous interview with the media that during Mr. Men's migrant work, Xiaoxuan lived in the village with his mother, grandmother, and half-sister. In May last year, they knew that Gu Moumou often beat Xiao Xuan, Xiao Xuan was naughty, everyone thought that the child made his mother angry, and they also came to admonish, "No one thought that such a thing would happen."
The Paper noted that the indictment disclosed that in May 2022, the kindergarten teacher found that Men Moumou was obviously emaciated and had multiple external injuries on his body, and reported it to the relevant departments in a timely manner. Gu Moumou still did not repent after being educated and admonished by relevant departments. According to a previous report by Southern Metropolis Daily, a staff member of the Shangping Chao Town Women's Federation said that regarding Xiaoxuan's abuse by his biological mother, the association had negotiated with the child's mother in June 2023 with relevant departments, and the child's mother had promised not to bully the child again.
Mr. Men revealed that in October 2023, the case of Gu Moumou committing the crime of abuse will be tried in court. He had demanded severe punishment for such abuses. In court, Gu Moumou "pleaded" with him, tearfully expressed his remorse, and asked the court to give a light sentence.
According to article 260 of the Criminal Law, whoever abuses a family member, and the circumstances are heinous, is to be sentenced to up to two years imprisonment, short-term detention, or controlled release. Where the crime in the preceding paragraph is committed, causing serious injury or death to the victim, a sentence of between two and seven years imprisonment is to be given.
