Fujian Hexing Rubber Co., Ltd. is a subsidiary of Jianxin Tire (Fujian) Co., Ltd., which mainly produces high-quality tire products such as motorcycles, electric vehicles, and bicycles. As a local industrial enterprise above designated size in Yongan, the company's sales in 2023 will reach 350 million yuan, and its "Gumande", "Mountain Road Tour" and "GUMANDE" trademarks that have spent many years of painstaking efforts to create have been recognized by consumers in terms of product quality and brand effect, and it has become a well-known tire brand in China. On October 17, 2023, the person in charge of the company went to the Yongan Public Security Bureau to report to the police that there were multiple online stores on an e-commerce platform selling tires with counterfeit registered trademark brands of the company.
After receiving the report, the Yongan Municipal Public Security Bureau attached great importance to it and set up a special team to carry out an investigation. After investigation, it was found that more than 10 online stores sold counterfeit "Gumande", "Mountain Road Tour" and "GUMANDE" tires at a unit price nearly 30 yuan lower than the market price without the permission of "Fujian Hexing Rubber Co., Ltd."
After further investigation, it was determined that the registration and delivery place of the more than 10 stores were in Zhengzhou, Henan Province. In order to find out the facts of the crime and destroy the counterfeiting den, the police drove nearly 1,500 kilometers to Zhengzhou, Henan Province to carry out investigations. Through the investigation, the police found that four suspects, including Wang Mouqi, Wang Mouxiang, Yang Moulei, and Dong, were responsible for sales in Zhengzhou, but the production place of counterfeit tires was not in Zhengzhou.
In order to achieve the whole chain of crackdown, the police made persistent efforts to overcome the local cold weather, and after nearly a month of squatting investigation, it was finally found out that the production place of counterfeit tires was a rubber factory in Julu, Hebei Province. The person in charge of the rubber factory is Wang Moudong, who is responsible for the production of counterfeit tires, and transports the counterfeit tires to Zhengzhou, Henan Province, where they are sold by Wang Mouxiang and other four suspects on the e-commerce platform. On January 16, 2024, the police of the special case group went to Julu, Hebei Province and Zhengzhou, Henan Province in 2 groups to arrest them, and with the cooperation of the local police, they arrested 5 criminal suspects including Wang Mouxiang and Wang Moudong in one fell swoop, and seized more than 3,300 counterfeit tires, 9 pairs of tire molds, and a large number of "GUMANDE" label paper, tape and winding stickers.
According to the suspect's confession, in May 2023, Wang Mouxiang found a large sales volume of "Gumande", "Mountain Road Tour" and "GUMANDE" brand tires on the Internet, and came up with the idea of making counterfeit tires of the brand and selling them to make money. So Wang Mouxiang contacted a rubber manufacturer in Julu, Hebei Province to discuss cooperation and jointly fund the production of counterfeit "Gumande" tires. The rubber factory transported the counterfeit tires to a warehouse in Zhengzhou, Henan Province, where Wang Mouxiang and others sold them through an online store. In order to increase sales, Wang Mouxiang not only improved the reputation of the online store, but also developed offline sales together, with a total of nearly 15,000 counterfeit tires, resulting in direct and indirect economic losses of more than 1,000 yuan for trademark holders.
After Wang Moudong, Wang Mouxiang and others arrived at the case, they confessed to the crime of making and selling counterfeit brand tires. According to the provisions of Articles 213 and 214 of the Criminal Law of the People's Republic of China, Wang Moudong is suspected of counterfeiting registered trademarks, Wang Mouxiang and other 4 people are suspected of selling goods with counterfeit registered trademarks, and 5 people have been criminally detained in accordance with the law.
