Interim Measures for the Gradient Cultivation and Management of Green Factories

Chapter I: General Provisions

Article 1 In order to accelerate the construction of a green manufacturing and service system, give full play to the basic and guiding role of green factories in the green and low-carbon transformation of the manufacturing industry, accelerate the formation of a standardized and long-term cultivation mechanism, and build a leading force in green manufacturing, these measures are formulated in accordance with the "Outline of the 14th Five-Year Plan for National Economic and Social Development of the People's Republic of China and the Long-Range Objectives for 2035", "The 14th Five-Year Plan for Industrial Green Development" and the "Implementation Plan for Carbon Peaking in the Industrial Sector".

Article 2 The term "green factory" in these measures refers to the realization of intensive land use, harmless raw materials, clean production, waste recycling, low-carbon energy enterprises, is the core implementation unit of green manufacturing.

The gradient cultivation of green factories refers to the establishment of a cultivation mechanism from the following two dimensions: the vertical formation of a national, provincial and municipal linkage of the green factory cultivation mechanism, and the horizontal formation of a green industrial park, green supply chain management enterprises to drive the park, the upstream and downstream enterprises of the supply chain to create a green factory cultivation mechanism.

Green industrial park refers to an industrial park that integrates the concept of green and low-carbon development into the process of park planning, spatial layout, industrial chain design, energy utilization, resource utilization, infrastructure, ecological environment, operation and management, etc., and realizes green, low-carbon and circular sustainable development in an all-round way, and is a platform for the agglomeration of green factories and green infrastructure.

Green supply chain management enterprises refer to the leading enterprises that run the concept of green and low-carbon development through the whole process of product design, raw material procurement, production, transportation, storage, sales, use and scrap disposal, and realize the coordinated improvement of the green level of the whole supply chain, which is the key to driving the upstream and downstream factories of the supply chain to implement green manufacturing.

Article 3 The gradient cultivation and management of green factories follow the principles of enterprise main body, government guidance, standard guidance and comprehensive coverage, based on the cultivation of green factories and supported by the cultivation of green industrial parks and green supply chain management enterprises, optimize the policy environment, guide third-party institutions to provide professional services, stimulate the endogenous power of green manufacturing of enterprises, give full play to the leading role of green manufacturing benchmarking, and promote the green and low-carbon transformation and upgrading of industries and regions.

Article 4 The Ministry of Industry and Information Technology is responsible for the macro guidance, overall coordination, supervision and management of the gradient cultivation of green factories nationwide, organizes the formulation of evaluation standards, selects and publishes the list of green factories, green industrial parks and green supply chain management enterprises at the national level (hereinafter referred to as the green manufacturing list), and promotes the introduction of relevant supporting policies.

The competent departments of industry and information technology of all provinces, autonomous regions, municipalities directly under the Central Government and cities specifically designated in the state plan, and the Xinjiang Production and Construction Corps (hereinafter referred to as the provincial-level competent departments of industry and information technology) shall formulate the implementation rules for the gradient cultivation management of green factories in their respective regions in accordance with these measures, and report to the Ministry of Industry and Information Technology for the record, and shall be responsible for the cultivation, management and recommendation of their respective regions in accordance with these measures and implementation rules.

Article 5 The Ministry of Industry and Information Technology is responsible for the construction, operation and maintenance of the industrial energy conservation and green development management platform (https://green.miit.gov.cn/, hereinafter referred to as the management platform), and uses it as a unified platform for the gradient cultivation and management of green factories.

Chapter 2 Cultivation Requirements

Article 6 The provincial-level competent department of industry and information technology shall list the enterprises and industrial parks that have the cultivation conditions and potential for improvement in the region as the cultivation objects, formulate the cultivation plan, guide and support the cultivation objects to implement green transformation and upgrading according to the relevant standards and requirements of green factories, green industrial parks and green supply chain management enterprises, and continue to improve the work of green development.

Article 7 The cultivation objects of green factories shall meet the following conditions:

1. A manufacturing enterprise established in accordance with the law and with independent legal personality or regarded as an independent accounting unit, and engaged in actual production;

2. Meet the requirements of the relevant standards in the first paragraph of Article 14 of these Measures.

Article 8 The cultivation objects of green industrial parks shall meet the following conditions:

1. Industrial parks with legal boundaries and scopes, unified management institutions, and product manufacturing and energy supply as the main functions, with industrial added value accounting for more than 50%;

2. Release the green factory cultivation plan in the park, and organize the enterprises in the park to carry out the creation of green factories;

3. Meet the requirements of the relevant standards in the second paragraph of Article 14 of these Measures.

Article 9 The cultivation objects of green supply chain management enterprises shall meet the following conditions:

1. An independent accounting unit established in accordance with the law and with independent legal personality or regarded as a legal person, which is an enterprise with great industry influence, strong operating strength, complete industrial chain, good green supply chain management foundation, and plays a leading role in the industrial chain, and actively creates a green factory;

2. Formulate a supplier green factory cultivation plan and promote suppliers to create green factories;

3. Meet the requirements of the relevant standards in the third paragraph of Article 14 of these Measures.

Chapter 3 Creation Procedure

Article 10 Enterprises and parks may adopt the method of self-evaluation or entrust a third-party institution with evaluation capabilities to carry out evaluation, and prepare an evaluation report and submit it through the management platform.

If the third-party evaluation method is adopted, the third-party institution shall carry out its work in accordance with the requirements for the third-party evaluation of green manufacturing (Annex 1) and be responsible for the authenticity and accuracy of the evaluation report issued. If the self-evaluation method is adopted, the workflow and report template can refer to the "Requirements for Third-party Evaluation of Green Manufacturing".

Article 11 The provincial-level competent department of industry and information technology shall, in accordance with the application materials received by the management platform, organize the creation of green factories at the provincial and municipal levels in the region in accordance with these measures and the implementation rules for the gradient cultivation management of green factories in the region, and publish the list of green factories at the provincial level. In principle, provincial-level green factories should first be included in the list of city-level green factories.

Article 12 The provincial-level competent department of industry and information technology shall, after fully soliciting the opinions of the local competent departments such as ecological environment, emergency management, and market supervision, recommend the representative and leading provincial-level green factories in the region to the Ministry of Industry and Information Technology through the management platform before July 31 of each year. The recommended number of green factories in each province will be determined comprehensively according to factors such as the number of industrial enterprises above designated size and the construction of gradient cultivation system. The Ministry of Industry and Information Technology organizes experts to review the factories recommended by each province, and selects the best to determine the annual publicity list, which is publicized for 15 days, and is included in the list of green factories at the national level without objection and announced.

Article 13 The process and time requirements for the establishment of green industrial parks and supply chain management enterprises at the national level are the same as those for green factories at the national level. The provincial-level competent departments of industry and information technology may organize the creation of provincial-level green industrial parks and supply chain management enterprises on their own according to the actual work needs, and determine whether the recommended units need to be included in the list of provincial-level green industrial parks and supply chain management enterprises.

Article 14 The Ministry of Industry and Information Technology regularly publishes a list of standards for the creation of green factories at the national level (see the website of the Department of Energy Conservation and Comprehensive Utilization for details). The industries that have been included in the list shall be evaluated in accordance with the corresponding standards, and the industries that are not included in the list shall be evaluated in accordance with the General Principles for the Evaluation of Green Factories (GB/T36132). Priority will be given to factories in key industrial areas that have reached the benchmark level issued by relevant state departments, and factories that have reached the advanced value or level 1 level of the corresponding national energy consumption quota standards will be recommended in other industries.

The establishment of green industrial parks at the national level is based on the "Evaluation Requirements for Green Industrial Parks" (Annex 2, which will be revised at any time according to the actual situation). The recommended parks should be industrial parks at or above the provincial level with a large number of green factories and a high proportion.

The Ministry of Industry and Information Technology (MIIT) regularly publishes an industry index system for the creation of green supply chain management enterprises at the national level (see the website of the Department of Energy Conservation and Comprehensive Utilization for details). The published industry index system shall be evaluated according to the index system, and the unpublished industry shall be evaluated in accordance with the "Evaluation Requirements for Green Supply Chain Management Enterprises" (Annex 3, which will be revised at any time according to the actual situation). In principle, the recommended enterprises should be green factories at the national level, and priority should be given to leading enterprises with a large number of green factories in automobile, machinery, electronics, textile, communication manufacturing and other industries, as well as suppliers, and pilot enterprises for extended producer responsibility of automotive products.

Provincial-level competent departments of industry and information technology may refer to the above-mentioned standards and appropriately adjust the requirements in combination with the actual situation of the region to determine the standards to be used at the provincial and municipal levels.

Article 15 In the past three years, enterprises or parks (including enterprises in the park) with the following circumstances shall not apply, recommend and be included in the green manufacturing list:

(1) Failure to operate and produce normally (cancellation of industry and commerce, suspension of production for more than 12 consecutive months, inclusion in the list of abnormal business operations by the market regulation departments and not being removed, etc.);

(2) Accidents such as security (including network security and data security), quality, and environmental pollution, as well as tax evasion, and other violations of laws and regulations occur (refer to "Credit China" and the "National Enterprise Credit Information Publicity System");

(3) Being dynamically adjusted out of the green manufacturing list;

(4) Where serious problems are found in the relevant supervision and inspection work of the State Council and relevant ministries and commissions;

(E) is included in the list of industrial energy conservation supervision and rectification and failure to complete the rectification as required;

(6) The enterprise is listed as a judgment defaulter.

Chapter 4 Dynamic Management

Article 16 The list of green manufacturing shall be dynamically tracked. The list of green manufacturing at the national, provincial and municipal levels shall be filled in the dynamic management form (Annex 4) through the management platform before April 15 of each year, and the key indicators of green manufacturing of the year shall be reported.

Article 17 The provincial-level competent departments of industry and information technology shall strengthen guidance, supervision and inspection of enterprises or parks included in the green manufacturing list, conduct on-site spot checks and reviews from time to time, continue to track and analyze the effectiveness of creation, and report to the Ministry of Industry and Information Technology in real time if there are major or above production safety and quality accidents, level II (major) and above environmental pollution emergencies.

Article 18 If the enterprises or parks in the green manufacturing list have any of the following circumstances, they shall be removed and announced when the annual list is released:

(1) the circumstances referred to in Article 15;

(2) Refusal to fill in the dynamic management form on time;

(3) There are problems such as falsification of submitted materials or data.

In the event of a major or higher production safety and quality accident, or a Class II (major) or higher environmental pollution emergency, it shall be removed from the list at all levels in a timely manner and an announcement shall be made.

Article 19 If the name of the enterprise or park in the green manufacturing list is changed or the actual production and operation scope, production address, organizational boundary and the time of inclusion are significantly changed due to investment, mergers and acquisitions, etc., it shall be explained when filling in the dynamic management form. The local competent department of industry and information technology shall review and confirm the change instructions submitted by the enterprise or park, and remove them from the list at this level if they no longer meet the relevant standards after the change. For those involving the green manufacturing list at the previous level, the local competent department of industry and information technology will report the adjustment opinions uniformly when recommending the list every year, and announce and change it when the annual list is released.

Article 20: Local departments in charge of industry and information technology shall supervise and manage third-party institutions conducting business in their own regions, and promptly report any problems they discover. Third-party institutions that have been found to have committed fraud or deliberately concealed the subject of the assessment are to report on the management platform and not accept the evaluation results issued by them for three years.

The Ministry of Industry and Information Technology is to publish the relevant circumstances of the evaluation work carried out by third-party institutions in a timely manner, and guide third-party institutions to improve their service levels and work quality.

The total number of national-level green manufacturing evaluation projects (including green factories, green industrial parks, and green supply chain management enterprises) carried out by a third-party organization with the same legal representative shall not exceed 15 each year.

Article 21 Any organization or individual may report to the relevant competent department of industry and information technology in real name for problems in the authenticity and accuracy of relevant information of green manufacturing list units and third-party institutions, and provide supporting materials and contact information.

The content of the report accepted, the relevant competent departments of industry and information technology shall promptly verify, and if it is confirmed that there is a reported matter, it shall be required to rectify or be removed from the green manufacturing list in accordance with the requirements of Article 18 of these Measures, and if the third-party institution has reported matters, it shall be handled in accordance with the provisions of the first paragraph of Article 20 of these Measures.

Chapter 5 Supporting Mechanisms

Article 22 The Ministry of Industry and Information Technology is responsible for formulating policies related to green manufacturing, coordinating and promoting the formulation of evaluation standards for green factories in different industries, developing and promoting the "enterprise green code" that reflects the green development level of green factories, and jointly with relevant departments in accordance with laws and regulations in planning and layout, technological transformation, special fund application, government procurement, pilot demonstration, financial services, Provide support for the green manufacturing list units in terms of brand promotion, give full play to the role of the national industry and finance cooperation platform, guide financial resources to provide precise support for the green development of industry, implement green manufacturing publicity and promotion actions, and carry out green manufacturing training.

Article 23 The local competent departments of industry and information technology are responsible for formulating and promulgating support and guidance policies for green manufacturing in the region, taking the gradient cultivation of green factories as the main starting point for promoting the green and high-quality development of the regional manufacturing industry, formulating targeted policies for the problems encountered in the process of gradient cultivation of green factories in the region, and actively using financial, industrial, land, planning, financial, tax, and energy policies in accordance with laws and regulations to continuously improve the level of green manufacturing.

Article 24 The third-party institutions participating in the gradient cultivation of green factories shall strengthen their own capacity building and professional training, take the initiative to publicize and implement the relevant concepts and requirements of green manufacturing to the cultivation objects, promote advanced and mature experience, deeply explore the highlights and potential improvement space of green development work, put forward reasonable improvement suggestions, track the needs of the green development process of the cultivation objects, and provide green manufacturing system solutions and continuous technical services.

Article 25 Green factories, green industrial parks, and green supply chain management enterprises shall actively display and publicize advanced technologies and typical practices of green manufacturing through public channels, disclose environmental information in accordance with the relevant provisions of the competent departments of ecology and environment, and play a leading role in advanced demonstration. Encourage green factories to prepare green and low-carbon development reports, green industrial parks to formulate green factory support policies, and green supply chain management enterprises to increase product procurement of green factories.

Chapter VI Supplementary Provisions

Article 26 The Ministry of Industry and Information Technology is responsible for the interpretation of these Measures.

Article 27: These Measures shall be implemented as of the date of promulgation.
