I have been following this case for more than half a year, and this is the third article written about it.
In June last year, Liu Aiye, the principal of Boai Special School in Suixian County, Hubei Province, who has been reported by the media many times for "touching deeds" and is also well-known locally, was exposed to molesting underage disabled female students in offices and student dormitories many times, causing an uproar.
In fact, "indecency" was only a lesser offense to which Mr. Liu pleaded in, and the students accused him of rape. The physical examinations of both victims showed old lacerations to the vagina, but no valid DNA was extracted from the victims' bodies because there was no rape on the day the student reported the incident.
However, the Suixian People's Court finally convicted Liu Aiye of indecent assault, sentenced him to three years and six months in prison, and banned him from engaging in work in close contact with minors.
Part of the first-instance criminal verdict:
Between September 2018 and May 2022, defendant Liu Aiye repeatedly touched and kneaded the breasts and breasts of underage student Chen Sisi (born on October X, 2004, blind) in the principal's office and the student's dormitory. In the second half of 2021, Liu Aiye stroked the breasts of underage students Zhou Xiaoruo (female, born on October X, 2005, intellectually disabled) and Zhang Yangyang (female, born on October X, 2006) in the principal's office.
The demon principal is subdued, the school is disbanded on the spot, the disabled students have nowhere to go, and the parents have many complaints. Chen Sisi, the victim who called the police before, even received a strange text message, in which the other party accused her of dragging everyone down, "A disabled baby drags down a family, more than 100 babies, more than 100 families." ”
At first glance at this case, a very intuitive feeling is that this is not only a confrontation between good and evil, but also a duel between the strong and the weak.
On the one hand, there is a principal with rich experience in physical and mental health and is known as a "good name", and on the other hand, there are disabled female students who have not yet reached adulthood and have to rely on the life of a special school, and the difference in strength between the two is too great.
It is conceivable how helpless and frightened the victims should be when they face the assault and even the subsequent police questioning, and the resistance they face is not only Liu Aiye's connections, prestige and foundation, but also the hateful gaze of the parents of other special school students.
They mustered up the courage to gamble on the possibility of justice by dissecting the wound and destroying the present. But until this time, the law did not completely grant them their wishes, and the sinners were punished, but they were only convicted of very minor crimes.
Three years later, Liu Aiye returned to society, and his life will not change much, but these students who have no school to go to school are lost in the present and the future.
With this in mind, in June last year, I wrote my first article about this case, "Talking about the Sexual Assault Case of Hubei Special School" (click on the blue word to read).
Not long after writing this article, there was a new development in the case again, and several victims' parents did not agree with the first-instance verdict and submitted a protest application to the procuratorate, and the case was retried on September 4, 2023, with the cause of action being "rape".
Adhering to prudence and fairness in the law, it was a good thing that the case was retried, but soon, the county court was exposed to evil deeds: the two lawyers entrusted by the murdered girl were subjected to all kinds of prevarication and difficulties when they read the case file in the court litigation center in accordance with the law.
That's not all, the president of the county court even mobilized the bailiffs, snatched their mobile phones, handcuffed them and put them in the detention cell. The court is supposed to be a place for the pursuit of justice, and there is a law to follow when lawyers read the case file, so why should the court do everything possible to obstruct it?
One afternoon, the parents of a victim received dozens of phone calls from the village, town, and county, asking why she wanted a lawyer, "The case has not yet been decided, so what are you going to do with a lawyer?"
The two lawyers were so upset that they made the matter public on the Internet, and promised that they were willing to bear all the legal consequences for making a public real-name report, and "implored the attention of the national judicial level and various news media."
At this point, the suspicions are already obvious, there is an unknown force that is trying to interfere with the trial of the case without any gaps, which can't help but make people wonder if the first-instance verdict of the case is obviously light.
What is the biggest difference between judges and lawyers, but the former can detain and even trample on the latter for no reason? If power is greater than the law, and power is extinguished by the law, our so-called society under the rule of law will always be just a piece of paper.

Now, the latest follow-up is out.
On January 8, 2024, Liu Aiye, who was already serving a prison sentence, was convicted of rape again, and was sentenced to three years and six months in prison in accordance with the law, and it was decided to enforce the sentence of 15 years imprisonment and deprivation of political rights for three years.
From 3 years and 6 months to 15 years, this gap is not small, it is said that good and evil are in the same thought, and whether social values advocate good or evil, is not between the court's judgment?
The case has come to this point, and it is basically complete. However, beyond this case, there are still some issues and recommendations that need to be clarified and implemented urgently.
First, during the retrial, why did the court illegally interfere with the lawyer's reading of the case file? Is this related to the fact that the first-instance judgment was too lenient? and have the relevant persons involved been punished?
Second, the demon principal has been punished, but the children have become wandering "prodigal sons", is it necessary for the local government to take settlement measures as soon as possible, not to mention cultivating talents, at least to solve their current school problems?
It is a dereliction of duty on the part of the Buddha to cross sentient beings, and a society full of love and positive energy urgently needs the devil to take on the duties of angels. What are the angels up to?
Third, should we comprehensively review and rectify the operation of local schools, focusing on the current situation of training and placement of children with disabilities, so as to avoid the recurrence of similar cases?
After the scandal of Boai Special School in Suixian County, Hubei Province was exposed, the Suixian Education Bureau said that the school's school-running qualifications were incomplete, and the school-running qualifications had been revoked.
In case handling, there is a concept called "double investigation in one case", which means that in the process of investigating a certain case, it is not only necessary to find out the violation of discipline or illegal behavior of the parties, but also to find out the scope of responsibility and responsibility of the relevant supervisor or leader in charge.
This concept is generally used in cases of violations by discipline inspection cadres or officials, but in fact, such cases of violations by non-public officials with typical social significance can also be promoted. Not only can one case be double-checked, but also one case can be investigated for multiple times.
The repeated harm to the children is not only the responsibility of the devil alone, but also the local ZF, the regulatory authorities and even the courts.
Demons deserve to die for evil, but who lifted the demons to the throne of the gods, and who pushed the children to the altar?
