In which cases can there be financial compensation?
On January 1, 2017, the Regulations on the Normal Management of Flights came into effect.
According to Article 29 of the Provisions on the Normal Administration of Flights issued by the Civil Aviation Administration of China, after a flight departure is delayed or cancelled, the carrier or ground handling agent shall provide food and accommodation services to passengers in accordance with the following circumstances:
(1) If a flight is delayed or cancelled at the place of origin due to the carrier's own reasons such as aircraft maintenance, flight deployment, crew and so on, the carrier shall provide passengers with services such as meals or accommodation.
(2) If a flight is delayed or cancelled at the place of origin due to weather, emergencies, air traffic control, security checks, passengers and other non-carrier reasons, the carrier shall assist the passenger in arranging meals and accommodation at the passenger's own expense.
According to the relevant regulations, it is up to the airline to decide whether the domestic carrier compensates for flight delays, the conditions, standards and methods of compensation, including the provision of meals or accommodation services to passengers.
Currently, airlines offer compensation measures for flight delays caused by airline reasons.
For example, if a Xiamen Airlines flight is delayed for 4 hours (inclusive) to 8 hours, each passenger will be compensated up to 2,000 points or 200 yuan in cash. If the delay is more than 8 hours (inclusive), each passenger will be compensated up to 4,000 points or 400 yuan in cash. If the flight is cancelled due to a breakdown or weather conditions, Xiamen Airlines also provides passengers with a free flight change opportunity.
If the delay time of China Southern Airlines flight is 4 hours (inclusive) to 8 hours, each passenger will be compensated up to 200 yuan in cash, 1,600 miles or 300 yuan voucher; If the delay is more than 8 hours (inclusive), the maximum compensation for each passenger shall not exceed 400 yuan in cash or 3200 miles or 600 yuan voucher.
