The Central Commission for Discipline Inspection reported late at night: Ma Lin, fall off the horse

Late yesterday night, the Central Commission for Discipline Inspection and the State Supervision Commission issued a circular: Ma Lin, former secretary of the party committee and director of the Yunnan Provincial Prison Administration, was subject to examination and investigation.

According to the Yunnan Provincial Commission for Discipline Inspection and Supervision, Ma Lin, former secretary of the party committee and director of the Yunnan Provincial Prison Administration, is suspected of serious violations of discipline and the law and is currently undergoing disciplinary review and supervision and investigation.

Ma Lin, male, Han ethnicity, born in July 1956, Qinshui, Shanxi, member of the Communist Party of China, university degree, joined the work in October 1974. From October 1974 to December 1977, Ma Lin was a zhiqing of Mengpeng Commune, Zhenkang County, Lincang District, Yunnan Province. From 1974 to 2004, Malin worked in Lincang until july 2004, when he was deputy secretary of the Lincang Prefectural Committee until he was promoted to political commissar of the Provincial Prison Administration. In December 2007, Ma Lin was appointed as a member of the Party Committee of the Provincial Department of Justice, a political commissar and party secretary of the Provincial Prison Administration (deputy department level). Since December 2009, Ma Lin has served as a member of the Party Committee of the Provincial Department of Justice, the director of the Provincial Prison Administration Bureau (at the level of the main department), the secretary of the Party Committee, and the chairman of the board of directors of Yunnan Jinma Group Co., Ltd. In August 2016, he retired.

Shangguan News combed and found that since the beginning of this year, a number of officials who had served as the number one of the prison administration bureaus of provincial governments have been investigated and punished.

On September 14, Liang Qinghai, former party secretary and director of the Tianjin Municipal Prison Administration and former member of the party committee of the Tianjin Municipal Bureau of Justice, was investigated on suspicion of serious violations of discipline and law. Liang Qinghai, male, Han ethnicity, born in September 1957, 64 years old, from Panshi, Jilin Province. He has worked in the prison system for a long time and has never left Tianjin.

Also on September 14, the Intermediate People's Court of Xiamen City, Fujian Province, publicly pronounced a verdict in the bribery case of Zhang Jian, former president of the Anhui Provincial High People's Court, and sentenced defendant Zhang Jian to 15 years' imprisonment for accepting bribes. He illegally accepted property from others totaling more than RMB71.79 million, of which more than RMB24.03 million had not yet been actually obtained. The Shuangkai circular pointed out that Zhang Jian had violated the law to help criminals involved in criminal syndicates and vices to reduce their sentences and release them, and to retry and change their sentences.

Zhang Jian has served as the director of the Hubei Provincial Prison Administration and the secretary of the party committee.

On 31 August, Li Jian, former member of the party committee of the Guangxi Department of Justice and former secretary of the party committee and director of the Autonomous Region Prison Administration, was double-dismissed, and a circular pointed out that his officials and businessmen colluded to engage in power-for-money transactions; engaged in power-for-sex transactions; seriously violated social morality; took advantage of his position to seek benefits for others in the contracting of projects and other aspects, and illegally accepted property and property alone or in collusion with others, and the amount of money was particularly huge.

On July 17, Wo Lingsheng, former deputy secretary of the Political and Legal Committee of the Heilongjiang Provincial Party Committee, was investigated after nearly three years of retirement, and from February 2015 to December 2017, he served as the party secretary of the Heilongjiang Provincial Prison Administration.

On May 25, Fan Jun, former deputy secretary of the party group and vice president of the Xinjiang Uygur Autonomous Region Academy of Culture and Museum, who served as secretary of the party committee and director of the Xinjiang Uygur Autonomous Region Prison Administration, was double-dismissed, and the circular pointed out that he had illegally disposed of the money and clues involved in the case.

On May 14, Yao Xishuang, deputy secretary of the party group and deputy director of the Liaoning Provincial Department of Justice, was investigated, who was the party secretary and director of the Liaoning Provincial Prison Administration.

On February 6, Xu Huhe, former vice chairman of the Legislative Affairs Committee of the 12th People's Congress of the Inner Mongolia Autonomous Region, was expelled from the party for serious violations of discipline and the law, and he was also the party secretary of the Inner Mongolia Autonomous Region Prison Administration. The circular pointed out that Xu Huhe neglected to manage cadres in the judicial and prison systems, resulting in many major problems that seriously undermined judicial fairness, such as favoritism and fraudulent commutation of sentences and temporary execution outside of prison, and he also arbitrarily used his power and interfered in the transfer and commutation of sentences of criminals in violation of the law.

In addition, on September 15 this year, Liang Yijian, former political commissar of the Gansu Provincial Prison Administration, was examined and investigated, and his retirement has been nearly six years. Liang Yijian has been working in the Gansu Provincial Prison Administration since 1987. Until November 2015, he had been with the Gansu Provincial Prison Administration for 28 years.

When taking stock of the "risk points" of corruption in various political and legal systems, the website of the Central Commission for Discipline Inspection and the State Supervision Commission pointed out that in the prison system, the problem of "temporary reduction of leave (commutation of sentence, parole, and temporary execution outside of prison)" in violation of the law and the law is frequent, of which the problem of using patents to reduce sentences in violation of regulations is more prominent.

Judging from the publicly exposed cases of "temporary reduction of leave" in violation of the law, some inmates have forged key evidence such as inventions and creations and case data. For example, Sun Xiaoguo's parents helped Sun Xiaoguo illegally seek medical parole by falsifying medical records, resulting in Sun Xiaoguo not being taken into custody for execution after being sentenced. After committing the crime again, he also asked Luo Zhengyun, former inspector of the Yunnan Provincial Department of Justice, Zhu Xu, former deputy director of the Yunnan Provincial Prison Administration, and others to score Sun Xiaoguo's illegal assessment, select "labor reform activists," and use utility model patents that were not his inventions to make major meritorious contributions, and illegally help him reduce his sentence.

There are also judicial personnel who violate legal procedures. Guo Wensi was sentenced to life for intentional homicide, but was released after nine commutations. Guo Wensi's father, through others, gave cash several times and asked Sui Jianjun, then secretary of the party committee and director of Beijing Chaobai Prison, to help Guo Wensi in reducing his sentence. Knowing that Guo Wensi did not meet the conditions for commutation, Sui Jianjun presided over the prison director's office meeting 6 times and signed and approved the commutation document.
