On October 13, 2020, when the plaintiff Peng's mother took her pet dog Chihuahua to walk around the community, she encountered defendant Zhang Mou, who also walked with her own corgi dog, because the two dogs did not have a leash, they began to bark wildly when they met, and then they tore each other apart, resulting in the Chihuahua being bitten.
Peng Mou talked to the chief judge: "After I arrived at the scene, I asked my mother whose dog bit me, and my mother told me that it was the defendant Zhang Mou, and then I went to ask him, the first sentence he gave me at that time was that your dog did not lead the dog leash, and my dog did not lead the dog leash, and I was not responsible." ”
Subsequently, the two sides had an argument, which in turn triggered a physical conflict, resulting in Peng being injured in the conflict. After receiving the police, the police of the police station under the jurisdiction went to the scene and made a record of the interrogation of both sides. On the same day, Peng took the chihuahua to the pet hospital for examination and treatment, diagnosed with a bite on the right side of the neck, and did debridement and suture. Peng himself also went to the hospital for examination and treatment.
But a wave of uneven waves rose again, to four days later, October 17th, the two pets met again in the community, although at this time the corgi dog has put on the anti-bite mouth cover, but in the bite, the chihuahua was bitten by the corgi again, after the pet hospital examination, the chihuahua was bitten on the left side of the abdomen this time. Afterwards, Peng sued Zhang in court, demanding that Zhang compensate him for the various economic losses caused by his injuries of 4651.61 yuan, and the cost of examination and treatment of the Chihuahua's bite was 1600 yuan.

After trial, the court held that if the animal breeding caused harm to others, the animal breeder or manager shall bear tort liability. After the two parties tore at their respective pets, a dispute arose, resulting in Peng's injury, and Zhang should bear all the liability for compensation. In the end, in the case of the dispute over the liability for damage caused by animal breeding, the court ordered Zhang to compensate Peng for the medical expenses of his pet dog being bitten, and the rest was borne by Peng himself; in the case of the right to health dispute, Zhang was ordered to compensate Peng for economic losses of 1566.45 yuan within three days of the judgment taking effect. After the verdict, neither of the original defendants appealed.
