On April 5, Henan Tesla roof rights defender ms. on the personal social platform, revealed the relevant progress of the civil litigation case with Tesla.
Ms. Che said that she sued Tesla (Shanghai) Co., Ltd., Tesla (Beijing) Co., Ltd. and Tesla Global Vice President Tao Lin for infringement of the right to reputation, and April 8 (this Friday) is the deadline for the trial to be concluded, and she expects the court to make a fair and just judgment.
Ms. Zhang disclosed the details of the case, saying that Ms. Tao Lin, Tesla's global vice president, said that her "refusal to accept testing", "only willing to pay high compensation" and "the recent negatives are all her contributions" are not true and are slanderous.
About "Refusal to test". Ms. Zhang said that Tesla had only one designated appraisal agency at that time and had business dealings with Tesla. In addition, unlike traditional fuel vehicles, smart new energy vehicles such as Tesla need complete data to detect, but Tesla has not provided complete data to car owners so far.
Regarding "only willing to pay high compensation". Ms. Zhang said that not to mention the high compensation, the amount has never been mentioned in the whole mediation process, and if Ms. Tao Lin cannot produce evidence, it is slander and fabrication of facts.
On "the recent negatives are all her contributions". Ms. Zhang said that before and after her rights protection incident, Tesla accidents occurred frequently across the country, causing media reports and online hot discussions. Therefore, this kind of partial generalization has caused a large number of netizens to misunderstand.
It is reported that Ms. Zhang formally filed a lawsuit with the Beiguan District People's Court of Anyang City in May last year against Tesla for violating its right to reputation, and put forward tesla and Tao Lin's public apology and compensation for moral damages of 50,000 yuan. Subsequently, in August, Ms. Zhang raised the amount of compensation requested to 500,000 yuan. In December, the first instance trial of the case began.
According to previous reports, there are as many as 5 civil litigation cases between Ms. Zhang and Tesla, in addition to the above-mentioned Ms. Zhang suing Tesla for infringement of the right to reputation, including Ms. Zhang as the plaintiff to accuse Tesla of infringing the right to know, privacy and car quality disputes, etc., as well as Tesla as the plaintiff to accuse Ms. Zhang of infringing the company's right to reputation at the Shanghai Auto Show, Tesla also claimed compensation of 5 million yuan for Ms. Zhang.
