The "Notice of Time limit for removal" made by your unit on February 7, 2022, our company has received it, and hereby replies to the relevant matters mentioned in the notice as follows:

Our concrete mixing station project located in the south of Changjiang West Road, west of Jingsi Road, north of Xueyi Road and east of Fangxing Avenue in Hefei is a project introduced by Hefei High-tech Zone in 2007, and the construction and commissioning of the project has been approved by the relevant administrative departments of Hefei High-tech Zone. Since the beginning of production and operation in 2007, it has made great contributions to the development of the regional economy, with 86 employees and also solved the employment problem of a group of personnel. In the "Notice of Time Limit for Removal", your unit said that our company did not handle the relevant construction procedures during the lease period, suspected of encroaching on collective land and environmental protection complaints, which seriously deviated from the basic facts.

First, the project plant, office buildings and related buildings and structures are legal construction, and our company enjoys legal ownership.

All the factories, office buildings and related buildings and structures on the project land are in accordance with the requirements of investment promotion in 2007, and all the construction acts are approved by the relevant administrative departments of Hefei High-tech Zone, and there is no illegal construction. Moreover, over the years, our company has been paying real estate tax in accordance with the relevant provisions of the Interim Regulations of the People's Republic of China on Real Estate Tax, so our company enjoys legal ownership of all buildings on the project land.

Second, our company does not have the situation of encroaching on collective land

Our company obtained the right to use the land for this project based on the lease relationship, and since 2007, when the lease contract was first signed with your unit, after multiple renewals, the contract period of the written lease contract expired on May 31, 2018. On August 20, 2018, the Construction and Development Bureau of Hefei High-tech Zone organized a special meeting on the suspension and demolition of concrete enterprises in Hefei High-tech Zone, and in accordance with the requirements of the meeting, the project was suspended and demolished, and the construction and development bureau took the lead and the land sub-bureau cooperated, and another site was selected to build a new production line. Our company actively cooperated with the suspension of this project in accordance with the requirements of the above meeting, so after the lease contract expired, your unit did not renew the lease contract with our company. Since then, the site selection of the new production line has not been effectively implemented, and our company has not been able to resume production at the new site, resulting in delays to this day. In April 2020, many departments asked our company to resume production, during which our company also paid rent to your unit, but your unit refused to accept it. Therefore, your company's claim that our company has encroached on collective land is nonsense.

Third, our production and operation activities meet the requirements of environmental protection

Since its commissioning in 2007, our production and operation activities have met the requirements of relevant laws and regulations, there is no situation of illegal operation, the project construction has been assessed according to law, and environmental remediation has been carried out in accordance with the requirements of the administrative department, and there is no environmental violation.

Fourth, the legitimate rights and interests of our company should be guaranteed

Your unit requires our company to "return to the land within ten days" and "move away from the original site and restore the original state" in the "Notice of Time Limit for Removal", based on the above-mentioned requirements of the above-mentioned special meeting on the suspension and demolition of concrete enterprises in Hefei High-tech Zone on August 20, 2018, plus our company learned that the area where the project land is located is about to be demolished, so our company agrees in principle to cooperate with your unit to return the land and move out. However, before our company moves away, the following matters concerning the legitimate rights and interests of our company should be resolved:

1. As mentioned above, our company enjoys unquestionable ownership of all buildings on the project land, because the building is immovable, can not be moved, and has formed a whole with the land, therefore, when returning the land, your unit should pay a reasonable consideration to our company for the buildings on the project land to compensate for our losses, or make it clear that in the future, the compensation rights and interests of this part of the expropriation and demolition will all belong to our company.

2. In accordance with the requirements of the special meeting on the suspension and demolition of concrete enterprises in Hefei High-tech Zone on August 20, 2018, the site selection of the new concrete mixing station production line of our company should be implemented, and in the case of the new site being determined, that is, requiring our company to shut down and move away, it will cause huge operating losses to our company, and all the employees of our company will face unemployment problems, which may have a negative impact on social stability.
