In 207 BC, Wangyi Palace was turned into "scorched earth" by "a torch for the Chu people", witnessing the decline of the Qin Dynasty. On September 24, 2003, the site of Wangyi Palace was identified as a provincial-level cultural relics protection unit by the People's Government of Shaanxi Province. However, due to historical reasons, a large amount of garbage left around the Site of Wangyi Palace has had an impact on the cultural relics site. The procuratorial organs initiated public interest litigation procedures to effectively protect cultural relics and sites.
The ruins of Wangyi Palace were invaded by garbage
Wangyi Palace was built by Qin Shi Huang to watch over the invasion of ethnic minorities in the north, named because it was "bordered by Jingshui in the north and looked at Beiyi", and was a strategic place for the Qin people to prevent the Xiongnu from attacking. The site covers an area of more than 600 meters from east to west and more than 500 meters from north to south, with a total area of more than 300,000 square meters.
The ruins of Wangyi Palace are located in Eryangzhuang Village, Zhengyang Street, Qinhan New Town, and are the fourth batch of provincial-level cultural relics protection units. In October 2020, the Weicheng District Procuratorate of Xianyang City found that there was a large amount of garbage in the Wangyi Palace ruins area, which polluted the surrounding environment and had a certain impact on the cultural relics site.
It is understood that since the 1980s, there has been a brick factory in the wangyi palace site area that has taken soil for a long time, forming more pits and ditches, serious garbage dumping, and poor environmental style.
After Qinhan New Town took over the social affairs of the district in 2017, it successively closed all brick and tile factories and soil extraction yards in the ruins area of the jurisdiction, and the brick factories in the ruins of Wangyi Palace were also banned. At the same time, the functional departments of Qinhan New City have increased the inspection and supervision of the area, and the phenomenon of excavation and soil extraction and dumping of garbage in the ruins area has been curbed to a certain extent, but due to the remote location of the site and weak supervision forces, the phenomenon of dumping garbage has not been eliminated.
On October 27, 2020, after discovering that such phenomena still existed in the course of performing its duties, the Weicheng District Procuratorate issued procuratorial suggestions to the Qinhan New Town Management Committee and relevant departments, suggesting that they perform their duties in accordance with the law, supervise and rectify the illegal dumping of garbage within the protection area of the Wangyi Palace site, and safeguard the national interests and the social public interest.
Problem-oriented Filing a lawsuit
After receiving the procuratorial recommendation issued by the Weicheng District Procuratorate, the Qinhan New Town Management Committee instructed the Urban Management and Transportation Bureau to deal with it immediately. The Bureau of Urban Management and Transportation immediately held a special meeting to discuss, quickly verify the relevant situation, carry out rectification work, severely crack down on littering, and strictly investigate and deal with illegal dumping. In the process of rectification, a total of 4 administrative cases were investigated and handled, administrative fines of 30,000 yuan were imposed, and height limit railings and warning signs were set up within the protection area of the Wangyi Palace site to prevent illegal pulling vehicles from entering. At the same time, the Qinhan New Town Urban Management and Transportation Bureau also joined hands with relevant departments such as cultural relics and public security to strengthen supervision and inspection, and carried out day and night uninterrupted and irregular supervision and law enforcement inspections in response to the phenomenon of illegal garbage theft.
On November 9, 2020, the Qinhan New Town Urban Management and Transportation Bureau made a written reply to the procuratorial suggestions based on the rectification situation. On November 19, 2020, when the Weicheng District Procuratorate inspected the rectification situation on the spot, it was found that although the Qinhan New City Urban Management and Transportation Bureau performed some of its duties, the existing garbage in the Wangyi Palace site area was not completely removed and rectified, and the cultural relics protection unit and the ecological environment were not restored to their original state.
In accordance with relevant laws and regulations, after the case is reported, the case handling team of the Xianyang Municipal Procuratorate investigates and verifies it, and the provincial procuratorate approves it. On December 30, 2020, the Weicheng District Procuratorate transferred the case to the Xi'an Railway Transport Procuratorate for handling. After receiving the case, the Xi'an Railway Transport Procuratorate set up a special case-handling team composed of three procurators, Lei Guangji, Wang Ying, and Zhou Yingna, to carefully examine the case, and the procurator handling the case went to the scene many times to investigate and verify. On January 5, 2021, the Xi'an Railway Transport Procuratorate filed a lawsuit with the Xi'an Railway Transport Court in accordance with the law.
Formulate a plan for scientific rectification
In view of the procuratorial proposal on the work suggestions of the procuratorial proposal on the removal of garbage in the ruins area and the thorough rectification of the environmental features in the ruins area, the party committee and management committee of Qinhan New Town attached great importance to it, immediately held a special meeting, analyzed and judged item by item, combined with the actual situation, conscientiously checked and filled in the gaps, comprehensively sorted out existing problems, and formulated strong work measures.
The Management Committee of Qinhan New Town has effectively assumed the main responsibility for rectification, and on the basis of on-site investigation, it has held a special meeting again on January 13, 2021 to study the deployment of rectification matters, and set up a rectification work leading group headed by a deputy director of the management committee and the heads of relevant departments as members to ensure that all rectification work is deployed, responsible for and implemented.
On January 27, the Management Committee of Qinhan New Town invited relevant experts to formulate a rectification work plan to implement rectification from the aspects of cultural relics protection, environmental protection and land nature, mainly in accordance with the procedures of "transportation, filling, covering and greening".
On February 1, the Management Committee of Qinhan New Town invited the two courts of Xi'an Railway Inspection and Law Inspection and Law, relevant experts, etc. to jointly go to the site of Wangyi Palace to investigate, and held a symposium to improve the rectification plan. On February 5, the Ministry of Political and Legal Work of Qinhan New Town, the Bureau of Urban Management and Transportation, the Bureau of Cultural Relics, the Bureau of Ecology and Environment and other departments jointly held a symposium on the revision of the rectification plan, and finally formed a rectification work plan.
Rectification and reform are in place and the lawsuit is withdrawn in accordance with law
After the remediation work began, the Qinhan New Town Urban Management and Transportation Bureau excavated, sorted and sorted out the garbage on the site, cleaning up and sorting a total of 3800 cubic meters of construction waste, and pulling it to the site in accordance with the regulations for dumping. At the same time, the site completed by the clearance was backfilled with high-quality loess soil, covered with planting soil, transported a total of 50,000 cubic meters of earth, and the backfill height was 3-15 meters, restoring the original appearance of the site and meeting the requirements of green covering.
During the construction process, the Qinhan New Town Cultural Relics Bureau invited experts to guide and monitor the whole process. The Qinhan New Town Ecological and Environmental Bureau has put dust control in place, covered with pure soil, and no new pollutants have been brought in. The Natural Resources and Planning Bureau determined that the land had been restored to its original state, and the Street Office was responsible for meeting the farming conditions as soon as possible. Zhengyang Subdistrict Office participated in the greening, selecting the perennial herbaceous plant clover for greening, covering an area of 15 acres. The Public Security Sub-Bureau participated in the rectification work and took compulsory measures against violators who illegally dumped garbage and destroyed the ruins of Wangyi Palace on suspicion of constituting the crime of intentionally damaging cultural relics.
On May 8, under the auspices of the court, a case demonstration and rectification effect evaluation meeting was held, with the participation of procuratorial organs, administrative organs and experts in cultural relics protection and environmental protection, to sort out and present the evidence in the case, and to evaluate and certify the effect of the protection of the Wangyi Palace site.
On May 11, the Xi'an Railway Transport Branch of the Shaanxi Provincial People's Procuratorate and the Xi'an Railway Transport Procuratorate jointly inspected the site of the Wangyi Palace site, and unanimously agreed that the Wangyi Palace ruins had a good effect, and the Qinhan New City Management Committee had performed its duties according to law, realized all the litigation claims, and suggested that the prosecution be withdrawn according to law. On June 8, the Xi'an Railway Transport Court agreed to withdraw the case.
Establish long-term mechanisms to promote the performance of duties in accordance with law
Recently, the reporter and the procurator of the Xi'an Railway Transport Procuratorate came to the site of Wangyi Palace. The reporter saw at the scene that a huge white granite rock erected by the Shaanxi Provincial People's Government on March 28, 2018 was engraved with the words "Shaanxi Provincial Cultural Relics Protection Unit - Wangyi Palace Ruins", and next to it was erected a "Public Notice Board directly responsible for the safety protection of cultural relics", which had information such as management agencies, directly responsible persons, management personnel, and supervision telephones. The ditch adjacent to the ruins of Wangyi Palace has been filled in, and a three-step field has been built, planted with clover, and lush greenery.
Zhu Quanfeng, deputy director of the Political and Legal Work Department of the Qinhan New Town Party Committee, told reporters: "Through this case, we have put social and public affairs on the important agenda, included in the work of governing the district according to law, the construction of a government under the rule of law, and the modernization of urban social governance, and carried out warning education among all leading cadres, and regarded the protection of cultural relics and ecological environmental protection as an important indicator for the promotion and use of cadres." At the same time, the Management Committee of Qinhan New City also requires all functional departments to draw inferences from each other, comprehensively map, sort out and classify the social and public affairs areas managed, adhere to the problem orientation, establish a long-term mechanism, and create a good legal environment for the economic and social development of Qinhan New City.
Cheng Tao, deputy director of the Cultural Relics Bureau of Qinhan New Town, introduced: "In recent years, we have further strengthened the protection of cultural relics through a series of measures such as establishing a 4-level grid management system for field cultural relics safety, jointly establishing a field cultural relics protection brigade with public security organs, carrying out the creation of 'cultural relics protection demonstration villages', and normalizing joint inspections of cultural relics and public security, especially through this case, promoting the common concern and participation of various departments and the whole society in the protection of cultural relics, enhancing the awareness of cultural relics protection of the whole people, and building a solid bottom line for cultural relics safety." ”
It is reported that Qinhan New City has designated 2021 as the "year of improving the performance of duties according to law", and issued relevant documents to strive to improve the ability of departments and units to administer and perform their duties according to law.
