WeChat, which people usually use as a tool for communication, chatting, transferring money, and watching videos, has you ever thought that it can also be used as a case-handling tool for judges. Recently, the executive board of the Xunyang Municipal Court cleverly used WeChat to successfully find the person subject to enforcement, so that the case could be executed normally.
The executor, Li Mou, is from Hanbin District, Ankang City, and purchased a total of RMB27,000 from June to October 2019 while operating a hot pot restaurant in Xunyang City. Later, the hot pot shop was not well managed and closed down, and after Li left Xunyang, "the world evaporated", and Wang sued Li to the Xunyang court to pay him the arrears and interest. The court ruled in absentia in accordance with the law that Li should pay 27,000 yuan owed for the purchase of Wang's liquor and interest on overdue payment. After the judgment took effect, Li did not consciously perform his obligations, and Wang applied for compulsory enforcement.
After receiving the case, the enforcement judge promptly familiarized himself with the facts of the case, and during the visit and investigation, he learned that the person subject to enforcement, Li Mou, operated a restaurant in Hanbin District of Ankang City, and immediately went to the execution. After arriving at the destination, he learned that the store had been transferred to others and the name had long been changed, so the enforcement judge went to the place where Li was registered to investigate and visit. After the village cadres learned that Li was out of town for many years and lost contact with the village, he wanted to go to the WeChat that Li had used, so he kept adding his friends with the attitude of trying it out. After adding a successful and clear identity, the enforcement judge promptly served Li with the enforcement notice and other legal documents through WeChat in accordance with the law, informing him of the serious consequences of not performing the effective documents, and Li was forced by the majesty of the law to make a repayment plan and commitment to the court, and paid 1500 yuan in advance through WeChat.
The relevant person in charge of the Xunyang Court said that the executive board of the court constantly innovated the concept of enforcement, implemented in an efficient, civilized and good faith manner, formulated different enforcement plans for each case, did not give up a clue that the execution might be successful, and strived to ensure that the legitimate rights and interests of the parties were fulfilled in a timely manner.
