On August 31, 2021, during the food safety inspection before the start of the autumn semester, the law enforcement officers of the Market Supervision Bureau of Jintang County, Sichuan Province, found that the warehouse of a kindergarten contained 3 bags of chili noodles, 1 bag of pepper powder, 2 bags of safflower pepper, 3 bags of dried peppers, and 2 bags of pepper powder distributed by a company on August 30, 2021, and the packaging dates marked on the packaging bags were all September 1, 2021. Law enforcement officers took administrative compulsory measures of seizure of the above products at the scene.

Through further investigation, it was found that the company held a food business license and did not hold a food production license. On August 19, 2021, the company purchased 2 bags of pepper noodles totaling 100 catties, 100 catties of pepper powder, 150 catties of safflower peppercorns, 300 catties of dried chili peppers and 50 catties of peppercorns from a number of dry wholesalers. On August 30, 2021, the company distributed 3 bags of chili noodles, 2 bags of safflower peppercorns, 3 bags of dried peppers, 2 bags of pepper powder, and 1 bag of pepper powder after being crushed and sorted into kindergartens. The company divides and labels the above products with plastic bags, and each bag is posted with a label stamped with the company's official seal and containing the product name, the origin of raw materials, the production license number of plastic packaging for food, storage conditions, packaging date, shelf life, distributor and net content, and the labeled packaging date is September 1, 2021. The total value of the goods was 330.50 yuan, and the illegal income was 47.1 yuan.

The Jintang County Market Supervision Bureau believes that the company's behavior of labeling the product packaging date in its business activities is inconsistent with the actual situation, as well as the act of sub-packing the pepper noodles and pepper powder without obtaining a food production license, and crushing the peppercorns and selling them to the outside world, all violated the Food Safety Law of the People's Republic of China. Due to the small number of products involved in the company's illegal acts, the small amount of value of the goods, and the fact that no serious harmful consequences were caused, and the parties actively cooperated with the market supervision department to investigate, truthfully stated the facts of the violation and took the initiative to provide evidentiary materials, the Jintang County Market Supervision Bureau decided to mitigate the punishment according to law.

On January 7, 2022, the Jintang County Market Supervision Bureau made a penalty decision, ordering the company to make corrections to the company's behavior of falsely marking the packaging date and producing food without a license, confiscating the prepackaged food with false production date, and the total fine and forfeiture was 110,471 yuan. The person in charge of the company said that because of the lack of serious study of the law, it has always been believed that after the processing and packaging of pepper noodles, pepper powder, peppercorns, etc., the external sales do not require food production licenses, and the food identification labels made by the entrusted advertising company are marked in accordance with the practice of the opening time and the packaging date is marked in advance, the staff negligence does not correct, resulting in false labeling of the packaging date of the food, bringing food safety risks to consumers, especially the kindergarten minors who are distributed, and now they are deeply punished.
