On January 27, according to a public statement, the General Court of the European Union in Luxembourg revoked the 1.06 billion euro fine imposed by the European Executive Commission on the US chipmaker Intel on the 26th local time, finding that the EU failed to fully prove the key anti-competitive behavior in this case.

Twelve years after the 4th highest fine in EU history, the General Court in Luxembourg invalidated the ruling, though the European Commission is likely to appeal to the Supreme Court.

The European Commission, the EUROPEAN Union's antitrust enforcement agency, faces a similar appeal in a blockbuster anti-competitive case against search engine giant Google, a legal battle that could take a decade or more.

The European Union is seeking to pass drafts for big tech companies such as the Digital Markets Act, which some lawyers say promise to reduce the number of cases requiring separate antitrust investigations.

The European Commission accused Intel of offering kickbacks to customers to prioritize the use of its own computer chips over products from rival Ultramicro Corporation (AMD), and in 2009 imposed a hefty fine on the semiconductor giant.

However, the Ordinary Court noted that the EU's "analysis was incomplete and could not demonstrate, on the basis of the necessary legal criteria, that the kickbacks in dispute could produce or were likely to have an anti-competitive effect".

In addition, the legality of discounts to manufacturers is also at the heart of the Google Android case, in which Google was heavily fined 4.3 billion euros by the European Union, the highest amount in the EU's record.
