The Hong Kong SAR Government has gazetted a legislative amendment to crack down on lawbreakers smuggling real gun components

Hong Kong, June 4 (China News Service) -- On June 4, the Hong Kong SAR Government published in the Gazette the Firearms and Ammunition (Firearms Announcement) (Amendment) Regulation 2021 (the Amendment Regulation). The Amendment Regulation clearly lists designated important firearm (i.e. real firearm) elements as "firearms" within the meaning of the Firearms and Ammunition Ordinance (Cap. 238) in the form of subsidiary legislation to combat the improper use of firearms by lawbreakers, to ship the genuine gun elements individually to Hong Kong, and then to install them locally as fully functional real firearms, threatening the safety of public lives and property.

A spokesman for the Security Bureau of the HKSAR Government said: "The Amendment Regulation provides a clearer and more specific definition of real gun components. The Amendment Regulation only targets genuine gun elements and other types of components (e.g. those applicable only to airsoft guns) are not affected. ”

The spokesman said that the Amendment Regulation also provides that if it is not properly or in disrepair or has been modified and modified, an object that could have been used as an element in a firearm would also be considered a firearm. The practice is consistent with the current practice of the Firearms and Ammunition Ordinance.

The spokesman said the government conducted a four-week public consultation in February and received a total of 257 submissions. Most of the respondents supported the proposed revisions. In terms of the specific issues raised in the consultation paper, nearly 90 per cent support legislation for a clearer definition of firearm elements, and more than 80 per cent agree to regulate proposed important firearm elements. In addition, 80 per cent of respondents supported a 90-day grace period before the legislative proposal came into force.

It is reported that the HKSAR Government will submit the Ordinance to the Legislative Council on 9 June for a first-come,201 review process. The Amendment Regulation will come into effect on 1 November to allow affected persons to dispose of the components or apply for licences from the Police. (End)
