Case Review

The Doumen Procuratorate filed a public prosecution with the Doumen Court on the grounds that defendant Xiao Mouhua had committed dangerous driving and assaulting the police.
Court judgment
After trial, the Doumen court held that defendant Xiao Mouhua violently attacked the people's police who were performing official duties, and his behavior constituted the crime of attacking the police; his drunken driving of a motor vehicle on the road had constituted the crime of dangerous driving, and it belonged to driving a motor vehicle without driving qualifications, and the blood alcohol content exceeded 200 mg per 100 ml, and should be given a heavier punishment.
After comprehensively considering the circumstances such as defendant Xiao Mouhua truthfully confessing the facts of the crime and voluntarily admitting guilt and accepting punishment after arriving at the case, in the end, the Doumen Court sentenced defendant Xiao Mouhua to two months' detention and a fine of RMB 4,000 for the crime of dangerous driving; sentenced him to six months' imprisonment for attacking the police, decided to carry out a fixed-term imprisonment of six months, and fined him 4,000 yuan.
After the verdict was pronounced, defendant Xiao Mouhua did not file an appeal, and the judgment has taken effect.
