Recently, the Emergency Management Bureau of Qingyun County, Dezhou City, Shandong Province, received three procuratorial recommendations from the people's procuratorate of the county. Previously, the Qingyun County Emergency Management Bureau and the County People's Procuratorate carried out joint supervision and inspection of safe production in the field of dangerous chemicals, and found that there were more than 30 safety hazards in the three dangerous chemical production enterprises, which may infringe on the public interest. In accordance with the relevant provisions of the Safety Production Law, the county procuratorate requires the Qingyun County Emergency Management Bureau to perform its regulatory duties, deal with hidden dangers of accidents in a timely manner, and urge enterprises to strengthen safety training to prevent safety accidents.

In March this year, the Dezhou Municipal Procuratorate and the Municipal Emergency Management Bureau signed the "Guiding Opinions on establishing a Working Mechanism for "Administrative Law Enforcement + Expert Consultation + Procuratorial Public Interest Litigation on the Safety of Hazardous Chemicals" to carry out special activities for joint supervision and inspection of safe production in the field of dangerous chemicals. Under this working mechanism, the emergency management department establishes a database of experts on dangerous chemicals and randomly selects experts to participate in supervision and law enforcement, and the public interest litigation department of the procuratorial organ supervises the administrative law enforcement behavior of the emergency management department and puts forward opinions and suggestions in a timely manner. At the same time, procuratorial organs and emergency management departments have improved the daily liaison mechanism, clarified that special personnel are responsible for daily liaison, and jointly organized a special meeting every six months to jointly hold relevant business training.
"In the process of participating in the inspection and rectification and review of hidden dangers, we need to enter the production enterprises such as dangerous chemicals, from the wearing method of protective clothing to the laws, regulations and standards in the field of safe production, we must learn meticulously, and all kinds of training are very necessary." Not long ago, the procuratorial organs at the two levels of Dezhou City and County went to the Emergency Management Bureau at the same level to participate in the special training on the safety production law and understand the various work arrangements of the emergency management department to ensure safe production. At the same time, in view of the strong professionalism of safety supervision in the field of dangerous chemicals, the procuratorial organs conduct special training for the supervisors of their administrative organs, etc., and deeply study relevant laws, regulations and standards.
"Originally, we 'closed the door' to handle cases and collect limited channels for clues in public interest litigation cases on production safety, but now with the cooperation of the emergency management department, the channels for obtaining clues are abundant." Yan Qianqian, director of the Fourth Procuratorial Department of the Dezhou Municipal People's Procuratorate, said: "With the help of experts, we can understand safe production from a professional point of view, breaking the original situation of 'each managing a stall' with the emergency management department. ”
Through combing and analyzing the feedback and inspection records of experts in the special activities of joint supervision, the procuratorial organs of Dezhou City have extensively used channels such as the smart civil banking system, the 12345 hotline, and Tieba to analyze and judge the law enforcement situation of relevant departments involved in the field of dangerous chemicals, clarify the responsibilities of all parties, and help solve problems such as multi-head management, cross-law enforcement, and the existence of law enforcement vacuums.
According to statistics, since the implementation of the mechanism, the procuratorial organs of Dezhou City have filed and handled 121 public interest litigation cases in the field of production safety, and issued 115 pre-litigation procuratorial suggestions in the field of safe production.
