Recently, the Rugao Municipal People's Court publicly pronounced a verdict on a dangerous driving crime case, in which a car owner was found to be an accomplice by the court for lending the car to the other party to drive after drinking with a friend, and the two were sentenced to detention and fined at the same time.

On December 1, 2020, Wu and Zheng, who were fishing together during the day, talked about wine at the dinner table, and a bottle of liquor was already in the stomach between the cups. Full of wine and food, the two still feel unfinished, and they meet to go to the bathing center to take a bath. Because Zheng mou wanted to send his wife home first, the owner Wu mou handed over his car and car keys to Zheng Mou, who drove him.

After that, Zheng mou drove an accident with the ordinary two-wheeled motorcycle driven by Lu Mou, causing Lu to be injured, and the two cars were damaged to varying degrees. After testing, the alcohol content in Zheng's body was 146.2mg\/100ml.

After the incident, defendants Zheng and Wu truthfully confessed their crimes, and voluntarily admitted guilt and accepted punishment, reached a mediation agreement with the victim Lu and performed on civil compensation, and obtained an understanding.

After trial, the Rugao court held that the owner of the car, Wu Mou, knew that Zheng Mou drank alcohol and still handed over the car to Zheng Mou to drive, although he did not drive himself, but his act of delivering the car and car keys had objectively provided help for Zheng Mou's drunken driving, and he was an accomplice to Zheng Mou's dangerous driving. Based on the circumstances of the two men's confession, admission of guilt and acceptance of punishment, and return of compensation, the court made a judgment according to law, and the owner of the car, Wu Mou, was sentenced to one month of detention, suspended for two months, and fined 1,000 yuan; the driver Zheng was sentenced to two months and fifteen days of detention and fined 2,500 yuan.

According to the judge undertaking the case, China's criminal law stipulates that whoever drives a motor vehicle drunk shall be sentenced to criminal detention and fined, and the subject of this crime is not only applicable to the driver of a motor vehicle. If the owner of the car or the relevant actor knows that the driver has drunk alcohol and still hands over the car to him to drive or instigates or instructs him to drive, as long as the driver meets the standard of drunk driving, the relevant person may also constitute an accomplice to the crime of dangerous driving.
