On the afternoon of October 29, the Nanjing Pukou District Procuratorate invited three hearing officers, civil affairs departments, and community workers to conduct a simple public hearing on the judicial aid of the victim's family in a traffic accident case, and handed over 50,000 yuan of judicial aid to the community for safekeeping and distribution on the spot, which was used to improve the lives of the elderly. The old man's son promised that all the judicial aid money would be used for the elderly and would no longer let the elderly live in shacks.
In September this year, when combing through the relevant cases, the Pukou District Procuratorate found that in a case in which a traffic accident caused the death of one person in 2016, although the perpetrator had been sentenced, the victim's family member Wu Youping (pseudonym) had not yet received a penny in compensation. The Prosecutor decided to conduct a field visit to learn about his current living situation.
When the prosecutor, led by the village committee staff, went down a steep slope of nearly seventy degrees, walked through a dirt road flooded by the river, and found Wu Youping's residence in a bush, he was shocked by the scene in front of him. Wu Youping lives alone in a shack converted from a cowshed, the shack is dimly lit, there is no running water, no kitchen, no bathroom, next to the pigsty, the only way to go out is to climb the steep slope. In the conversation with Wu Youping, the prosecutor learned that the old man, 75 years old, suffered from cerebral infarction, legs and feet, many falls and injuries, no fixed source of income, usually a pot of white porridge on pickles can eat for two or three days, son, daughter-in-law will send some meals every few days. When the prosecutor asked the old man how to contact others, the old man took out a mobile phone that could not be turned on, embarrassed to say that he would not use it; when the prosecutor asked why he did not go to live with his son, the corner of the old man's eyes was wet, "I don't want to leave the place where I lived with my wife..."
It is urgent to improve the living environment and living conditions of the elderly. The Pukou District Procuratorate decided to take the initiative to provide judicial assistance to Wu Youping and help the elderly handle the application procedures. The procurator handling the case went to the shack many times to patiently enlighten the old man to untie the knot and persuade him to move away from the river beach, and finally the old man agreed to move to live with his son.
Because the sons of the elderly often work outside, and the elderly are not cared for at home, the procurator handling the case summoned the civil affairs and community personnel in the street to hold a special coordination meeting, and jointly discussed the care and rescue plan around how to ensure the normal life of the elderly, care for the physical and mental health of the elderly, rational use and distribution of relief funds, and finally agreed that the procuratorate would be responsible for applying for judicial aid funds, supervising the use of rescue funds, and regularly visiting the elderly; the community should do a good job in supervising the issuance of judicial aid funds. Ensure that the judicial aid funds issued are truly used for the elderly, and at the same time arrange community personnel to visit and care frequently to help the elderly better integrate into society; the civil affairs department will give appropriate subsidies and assistance, and coordinate relevant social organizations to help the elderly at home.
Judicial aid is by no means just a matter of distributing relief funds, but also to truly solve the difficulties faced by the masses. The Pukou District Procuratorate will strengthen the care and assistance for the difficult groups among the victims of criminal cases, implement the procuratorial concept of the new era, change passive assistance to active assistance, and provide diversified assistance such as economic assistance, physical and mental rehabilitation, and legal support as needed, to help the people in need and their families get out of difficulties and rekindle the hope of life.
