Under the situation that the "four winds" continue to maintain a high-pressure situation and the more stringent the requirements are later, why does Tao Haohai still not converge and does not give up? Why violate the law again after being punished? What are the warnings and reflections of this case? How did the local discipline inspection and supervision organs deal with the case seriously and carry out the use of cases to promote reform?
Both investigations stemmed from reports from the masses
In January and February 2018, the Chizhou Municipal Commission for Discipline Inspection received online reports reflecting clues about problems by Tao Haohai, director of the Chizhou Economic and Technological Development Zone Safety Supervision Bureau (Environmental Protection Bureau). On June 5, 2020, during the special rectification action to implement the spirit of the eight central regulations in Chizhou City, an online whistleblower letter attracted the attention of the staff.
"The whistleblower letter mentioned that Tao Haohai accepted the arrangement of tourism activities from a construction company in Zhejiang Province to Xiangshan, Zhejiang Province, and repeatedly accepted clues about the banquets of the management service recipients, and even the time and place were relatively clear." As one of the case-handling personnel, Lu Zhengyou, director of the Third Supervision and Inspection Office of the Chizhou Municipal Commission for Discipline Inspection, recalled that after receiving the clues of the problems that were transferred, the Municipal Commission for Discipline Inspection and Supervision "quickly investigated and handled" and immediately organized personnel to carry out preliminary verification.
During the peripheral inspection, the inspectors found 5 relevant personnel of a company in Shanghai and a company in Chizhou City mentioned in the clues of the problem to conduct a conversation, and retrieved the photos of mobile phone payment records of banquet expenses, relevant hotel bills, tourism and accommodation records and other relevant documentary materials.
After grasping the basic situation, on June 9, 2020, the inspectors found Tao Haohai for verification talks.
"In 2018, you were severely warned and punished by the party for violating the spirit of the eight central regulations, why haven't you learned a lesson and taken it as a warning?" The inspectors asked during the conversation.
"This company is not registered in our district and is not a management service object." Tao Haohai defended.
"The company undertakes the project of the district company you manage, and you have a connection with these companies at work, and these enterprises are the objects of management services." The inspectors' words left Tao Haohai speechless. In the end, he told his question truthfully.
After investigation, on July 30, 2019, December 20, 2019, and January 13, 2020, Tao Haohai accepted the invitation of Rao, the director of the office of a Shanghai company, to represent the company on behalf of the management service object, and ate at a restaurant, and the above banquet expenses were paid by Rao and returned to the company to be reimbursed in the name of hospitality expenses.
In November 2019, a construction company in Chizhou City won the bid to undertake the construction of a company in Shanghai. In December 2019 and March 2020, Tao Haohai accepted three banquets from Wang Mou, the general manager of the company, and Zhang Mou, the construction project manager, at a restaurant and the canteen of the project engineering department. In addition, during the "May Day" period in 2020, Tao Haohai and his wife accepted Zhang X's invitation to play in Xiangshan, Zhejiang, and the cost of food and accommodation during the tour was paid by Zhang X, and the fare was paid by Wang X, who also came to travel.
After violating the spirit of the eight provisions of the central government, he still did not repent, and repeatedly accepted the banquet and tourism activity arrangements provided by the management service recipients, and what awaited Tao Haohai was a more severe punishment - on July 18, 2020, Tao Haohai was dismissed from the party and dismissed from government affairs, demoted to a first-level chief clerk, and refunded the travel expenses that should be borne by individuals.
Behind repeated falls is a weak sense of discipline
"My weak sense of discipline and my failure to really learn lessons from my own case and take it as a warning have led to the recurrence of such problems, which seems to be accidental, but it is inevitable." Tao Haohai talked about the mistakes he had made and regretted not being the first.
Tao Haohai was punished in 2018, mainly for accepting property in violation of the spirit of the eight central regulations, using a private car in violation of honesty and discipline, and seeking benefits. In 2020, there was another behavior of accepting and managing service recipients to eat and invite. Tao Haohai used three "noes" in a row to reflect on his "fall again" - "did not really learn lessons from his own cases in 2018, did not strictly demand himself against the "Regulations on Disciplinary Punishment of the Communist Party of China" and other intra-party regulations, and did not achieve the alarm bell for a long time and take himself as a warning."
Not only Tao Haohai, judging from the typical cases investigated and handled in recent years, the lack of respect for discipline and rules is one of the internal reasons why a small number of party members and cadres violate the spirit of the eight central regulations. Under the high-pressure situation of continuously rectifying the "four winds", a small number of party-member leading cadres regard discipline requirements as the wind in their ears, and the "eating wind" is not reduced, the "wine style" is difficult to go, and the illegal tourism is still going their own way.
Ideology determines action, and Tao Haohai's "two falls" fully exposed his lack of political consciousness and party membership. The analysis of the case also found that in the establishment of a new type of "pro-" and "Clean" government-business relationship, the imperfect and imperfect systems of relevant departments also caused a small number of party-member leading cadres to have a luck mentality and defy the wind and violate discipline.

On September 26, 2020, Zhejiang Province reported 11 cases of violating the spirit of the eight central regulations, among which Ding Guofeng, a member of the party committee and deputy director of the office of Jiaoshi Street in Haining City, received a serious warning from the party and a major punishment for private car maintenance. Previously, in September 2019, Ding Guofeng was admonished to talk about other disciplinary violations such as driving a bus.
