On the evening of November 25, the Guizhou Provincial Commission for Discipline Inspection published a notice on its website: Qin Tao, a department-level cadre of Guizhou Financial Holding Group Co., Ltd. (Guizhou Guimin Investment Group Co., Ltd.), was suspected of serious violations of the law and was under the jurisdiction of the Guizhou Provincial Supervision Commission and is currently under supervision and investigation by the Guizhou Southeast Prefecture Supervision Commission.
From Qin Tao's work experience to the procedures and wording of his investigation, several information points revealed in the briefing are worth paying attention to.

Career started as a hotel porter
According to the resume of the circular, Qin Tao was born in March 1972, a native of Mengyin, Shandong Province, with a bachelor's degree from a working university, began working in September 1994, and joined the Communist Party of China in December 2003.
Qin Tao worked as a bellman in the front office of Guizhou Hotel, and from September 1994 to May 2014, he worked in Guizhou Hotel System until he was the general manager of Xinlian Hotel of Guizhou Hotel International Conference Center Co., Ltd.
According to the enterprise investigation data, Guizhou Hotel Hotel Management Group Co., Ltd. and Guizhou Xinlian Hotel Co., Ltd. are both wholly-owned subsidiaries of Guizhou Hotel Group Co., Ltd. Guizhou Hotel Group Co., Ltd. is a company wholly owned by the State-owned Assets Supervision and Administration Commission of Guizhou Province.
From May 2014 to June 2017, Qin Tao served as deputy general manager of Guizhou Tourism Commercial Holdings Co., Ltd., which is also a subsidiary of guizhou state-owned assets supervision and administration commission.
From June 2017 until the investigation, Qin Tao successively served as the general manager of Guizhou Guimin Property Management Co., Ltd. and the current department-level cadre of Guizhou Financial Holding Group Co., Ltd. (Guizhou Guimin Investment Group Co., Ltd.). Unlike before, these companies are all wholly owned by the Guizhou Provincial Department of Finance.
Cadres of provincial state-owned enterprises shall be investigated by the municipal supervision organs
The circular said that Qin Tao was suspected of serious violations of the law, and that he had been designated by the Guizhou Provincial Supervision Commission to have jurisdiction over him, and was currently under supervision and investigation by the Qiandongnan Prefecture Supervision Commission.
Qin Tao is a cadre of a provincial state-owned enterprise, but the supervision and investigation of suspected serious violations of the law was carried out by the Supervision Commission of Qiandongnan Prefecture in Guizhou Province. Among them, it involves "designated jurisdiction".
The so-called "designated jurisdiction" refers to the organ with jurisdiction that determines supervision matters on the basis of the designation of the supervision organ at a higher level.
According to article 17 of the Supervision Law of the People's Republic of China, a higher level Supervision Organ may designate a supervision matter under its jurisdiction to a lower level Supervision Organ for jurisdiction, and may also designate a supervision matter over which the Lower Level Supervision Organ has jurisdiction to other Supervision Organs for jurisdiction.
Why there is only "supervision and investigation" in the circular and not "disciplinary review"
The wording of a notice suspected of violating discipline and law and being investigated is usually "subject to disciplinary review and supervision and investigation." As for the wording of Qin Tao's circular, only "violating the law" does not see "violating discipline," and only "supervision and investigation" does not see "disciplinary review."
Let's start with the concepts of "disciplinary review" and "supervision and investigation".
Article 16 of the Regulations on the Case Inspection Work of the Discipline Inspection Organs of the Communist Party of China stipulates that "where there are indeed facts of violation of discipline by Party members or Party organizations that have been initially verified and the Party discipline needs to be pursued, the formalities for filing a case shall be handled in accordance with the prescribed authority and procedures." ”
Supervision and investigation refers to a measure by which the Supervision Commission conducts an investigation into suspected violations or crimes abusing public office by the subjects of supervision in accordance with law. Article 11 of the Supervision Law stipulates that "the Supervision Commission shall, in accordance with this Law and relevant laws and regulations, perform its duties of supervision, investigation, and disposition: investigate violations and crimes abusing public office, such as suspected corruption and bribery, abuse of power, dereliction of duty, power rent-seeking, conveyance of benefits, favoritism and fraud, and waste of state assets." ”
Qin Tao is a party member, and the relationship between party organizations should be in the party organization of state-owned enterprises. If he is suspected of violating discipline, his party organization shall make a party disciplinary sanction.
At present, Qin Tao is under the supervision and investigation of the Qiandongnan Prefecture Supervision Commission under the designated jurisdiction. If they are suspected of violating discipline, they will be handed over to the party organization of the unit where their party organization is related to them for party disciplinary punishment according to the results of the supervision investigation.
