From May 25 to 26, 2020, the Hanzhong Intermediate People's Court pronounced judgments in accordance with law on the case of Ye Lizhi and 43 other defendants involved in organized crime of a triad nature. The criminals in this case were involved in 6 crimes, including organizing, leading, and participating in a mafia-type organization, intentional injury (causing death), picking quarrels and provoking trouble, and opening a casino, and all 43 defendants, including Yelts, were sentenced.
There are 21 members of this mafia-type organization, and the ringleader Ye Lizhi committed the crimes of organizing and leading a mafia-type organization, intentionally causing injury (causing death), picking quarrels and provoking trouble, opening a casino, illegal possession of ammunition, and illegally invading a dwelling.
Three key members Wang Jian, Li Ke, Luo Cheng, and 5 active participants Zhou Huanyu, Luo Gang, Xie Hao, Even Zhiqiang, and Su Jianjian were sentenced to 10 to 20 years' imprisonment respectively, the other 4 active participants Cao Xu, Liao Mingchao, Lu Qingwu, and Li Ming were sentenced to 5 to 10 years' imprisonment respectively, and the 8 general participants Qin Xiao, Wei Qiang, Wang Xiaoyong, Li Yongchun, Zhu Zhengyu, Zhang Yan, Zhang Qiangsheng, and Mu Zhenhua were sentenced to two years and three months to 11 years and four months' imprisonment respectively.
In order to implement the criminal policy of blending leniency with severity, 7 of them with statutory mitigating or mitigating circumstances such as voluntary surrender, confession, and admission of guilt and acceptance of punishment were given lenient punishments and suspended sentences were applied in accordance with law.
A defendant who is a member of a non-mafia-type organization committed a minor crime and was exempted from criminal punishment. A defendant who has been sentenced to a sentence and is serving a sentence was acquitted in this case due to insufficient evidence, and the original sentence of intentional injury is continued. One defendant in the case was sentenced to confiscate all personal property, and 29 defendants were sentenced to fines totaling 2.012 million yuan, and ordered to continue to recover 2.69 million yuan of illegal gains.
After trial, the Hanzhong Intermediate People's Court ascertained that in April 2006, defendant Ye Lizhi was sentenced to 14 years' imprisonment by the former Nanzheng County People's Court for committing robbery, and then served his sentence in Hanjiang Prison in Shaanxi Province.
Subsequently, defendant Ye Lizhi gathered and recruited defendants Wang Jian, Li Ke, Luo Cheng, and others to rely on the establishment of casinos to absorb and arrange a large number of people with previous criminal records and social idleness to work in casinos, provide food, lodging, and pay salaries, and gradually formed a criminal organization with Ye Lizhi as a clear leader, a relatively large number of people, fixed backbone members, and a certain organizational scale and organizational level, and relatively stable.
Under the leadership of the defendant Yelts organization, the criminal organization either collected high illegal profits by opening casinos, or used violent or threatening means to control the gambling industry in the region, wantonly obtaining illegal benefits, or by means of the state functionaries of individual organizations, enhancing the influence of the organization, creating momentum for people on the spot, collecting money, or "using black escort businessmen" to "escort" the smooth construction of the projects it contracted, earning profits, and illegally profiting more than 4 million yuan.
Since October 2013, he has carried out illegal and criminal activities many times, and on December 19, 2015, defendant Ye Lizhi, in order to control the organization, instructed his subordinates to intentionally injure and kill Qu Mou, who had a greater influence in the organization. The criminal organization and its members often prepared wooden sticks, machetes and other crime tools, and illegally possessed firearms and ammunition, and successively carried out 31 illegal and criminal activities, causing 1 death, 3 minor injuries, and more than 10 minor injuries.
Through a series of organized violations and crimes using violence and threats as a means, Ye Lizhi and members of his organization ran rampant in the townships, dominating one side, committing wrongdoing, bullying and maiming the masses, and forming obvious psychological coercion for the masses within a certain scope and region.
It has seriously undermined the order of local economic and social life and caused particularly serious social harm consequences. After trial, the Hanzhong Intermediate People's Court held that the criminal organization headed by defendant Ye Lizhi constituted a mafia-type organization, and that the defendants' conduct violated the relevant provisions of the Criminal Law of the People's Republic of China and should be punished according to law, so the above judgment was made.
Due to the impact of the new crown pneumonia epidemic, the verdict was pronounced in 5 detention centers in the defendant's custody.
