After arriving at the case, the three suspects all confessed to the crime of using illegal methods to catch aquatic products during the fishing ban period and in the fishing ban area.
According to the suspect's account, on June 7, The man fang mouchang of Meixi and his friends Zhou Moulin and Su Mouxing revealed that there should be a lot of farmed fish rushing into the river during the rising water period this year, and wanted to use an electric fish machine to try in the small river to see if there could be a catch, and if the electricity reached the fish, it would be boiled to eat. Three hit it off. On the afternoon of June 8, Su Mouxing took the electric fish machine he bought from the Internet and came to Fang Mouchang's home with Zhou Moulin. 3 people came to a river channel in the tributary of the resources, and Fang Mouchang carried an electric fish machine and Zhou Moulin took a bucket of electric fish along the river.
On June 17, three suspects were arrested by the Resources County People's Procuratorate on suspicion of illegal fishing for aquatic products.
Case 2: For the sake of the mouth and stomach to go down the river electric fish, 2 men were criminally detained
At about 11:00 p.m. on June 18, the fishery administration staff of the Agricultural and Rural Bureau of Resources County found that someone in the tributary of the Zijiang River in the direction of meixi was suspected of illegal electric fish, and then 2 men were caught by the staff on the spot, and seized an electric fish tool gun and 12 aquatic products.
On June 19, fishery officials handed over the two men to the Chengbei police station for further investigation.
Later, after being interrogated by the police of the Chengbei Police Station according to law, the men Mo and Wang confessed to the illegal facts of illegal fishing for aquatic products with electric spears in the tributary of the Zijiang River.
On June 20, Mo and Wang were criminally detained by the resources police on suspicion of illegal fishing for aquatic products.
According to Article 340 of the Criminal Law of the People's Republic of China, whoever, in violation of the laws and regulations on the protection of aquatic resources, catches aquatic products in a prohibited fishing area, during a fishing ban period, or uses prohibited tools or methods, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or a fine.
Regardless of the amount of catch, anyone who uses the methods of electric fish, fried fish and poisonous fish prohibited by law to catch aquatic products during the fishing ban period is suspected of being a crime.
