It is reported that on March 24, 2019, Ganma Moulin transported bear paws, bear bile and other items from Shangri-La City, Yunnan Province, to Qujing City, Yunnan Province, to complete the transaction with Huang Moupan. Huang Moupan drove a vehicle to transport bear paws, bear biles and other items back to Zhejiang Province, passing through the Shanghai-Kunming Expressway Pu'an Tea Farm service area was caught by the police, and 31 bear paws and 1 bear bile of the National Grade II key protected wild animal Asian black bear were seized at the scene. After identification, a total of 31 bear paws were worth 256,000 yuan, and 1 bear bile was worth 20,000 yuan. "During the investigation of the case, we visited the local ecological environment and the crime scene to investigate, at the scene of the crime, the hunting method adopted by the criminal suspect was to dig traps and place iron clips, and we found a large number of wires, iron clips and fallen bear hair at the crime scene." Pan Shandong, director of the office of the Pu'an County Forest Public Security Bureau, said.
The case was a case of inter-provincial acquisition and transportation of precious and endangered wildlife products, and after the Pu'an County public security organs arrested the defendant Huang Moupan, through cooperation with the Yunnan public security organs, the criminals who sold wild animal products were arrested and brought to justice. The Pu'an County Court sentenced defendants Huang Moupan and GanMa Moulin to fixed-term imprisonment of 10 to one year and fines ranging from 200,000 yuan to 5,000 yuan for the crime of illegally purchasing, transporting, and selling rare and endangered wildlife products, and confiscated a car with a tool for committing the crime, 67,000 yuan of illegal gains, and the seized bear paws and bear bile.
"Sentencing We consider and standardize the sentencing based on the circumstances of the offender's crime, the number of endangered wild animals trafficked and killed, and the value of the assessment, and the degree of harm caused to the country and society." Pu'an County Court Executive Bureau post judge Hou Ye said.
After the judgment took effect, in accordance with the provisions of the Wildlife Protection Law, the management and disposal of property involved in criminal cases, and other relevant laws and regulations, the three organs of the Public Prosecutor's Office, the Procuratorate, and the Law of Pu'an County recently jointly destroyed and disposed of bear paws and bear biles of the wildlife products involved in the case in accordance with the law.
