In the hotel prostitution encountered by the police interrogation, 45-year-old man Li Ji (pseudonym) not only refused to cooperate, but also kicked and bit the police, causing a police officer minor injuries.
On July 16, a reporter from The Paper (www.thepaper.cn) learned from the criminal verdict of the case that a few days ago, the Shanghai Xuhui District People's Court made a first-instance judgment on the case: defendant Li Ji committed attacking the police and was sentenced to six months in prison.
Defendant Li Ji was originally an employee of an information technology company in Shanghai with an annual income of more than one million, and has never been married. At about 17:00 on March 18, 2021, Li Ji committed the illegal act of prostitution in a hotel room on Zhaojiabang Road in Shanghai. On the same day, the Xuhui Substation Xietu Road Police Station received reports from the masses that there were people engaged in prostitution in the hotel, and according to the command of the station, the police rushed to the scene to investigate the situation and locked down Li Ji, who was suspected of prostitution.
At about 18:00, two police officers received instructions to control, interrogate and inspect Li Ji outside the hotel. Two police officers took Li Ji to a booth in the parking lot near the hotel for questioning, and the police showed Li Ji the identity of the police in accordance with the law, showed the people's police card, and asked Li Ji to cooperate with the investigation. In order to get rid of the control, Li Ji kicked two policemen with his feet and bit the right middle finger of a police officer with his teeth, after which Li Ji was arrested by the reinforcement police on the spot.
After identification, a police officer was bitten and caused skin damage, constituting minor injuries.
During the review and prosecution stage, Li Ji truthfully confessed the main criminal facts. The Shanghai Xuhui District People's Procuratorate, a public prosecution organ, believes that the defendant Li Ji should be held criminally responsible for attacking the police. Defendant Li Ji has confessed the circumstances and is able to admit guilt and accept punishment, and may be given a lighter punishment in accordance with law; If Li Ji has a bad record of prostitution, he will be given a heavier punishment as appropriate.
During the trial, defendant Li Ji and his defender had no objection to the facts, evidence, charges, and sentencing recommendations of the charges.
According to the Shanghai Rule of Law Daily, in the final statement stage, Li Ji repented, he said, "Before being detained, I was a person with an annual income of more than 1 million yuan from a foreign company, I was prosecuted for attacking the police, I was sweating, in fact, I lost my job, but also humiliated my parents, my own life was rewritten, I hope to re-enter life, do not enter the fringes of society." ”
The Shanghai Xuhui court held that the facts of the public prosecution's accusation that defendant Li Ji committed the crime of assaulting the police were clear, the evidence was credible and sufficient, the charges were established, and the sentencing recommendation was appropriate and should be adopted. On June 18, the court rendered the aforementioned first-instance judgment.
In addition, Li Gene was placed under administrative detention for 10 days by the Xuhui Branch of the Shanghai Municipal Public Security Bureau for prostitution.
