On December 9, the Renshou County People's Court in Sichuan Province publicly pronounced a verdict on the case of Peng Xiao, Peng Liang, and 20 others suspected of organizing, leading, or participating in a mafia-type organization. Among them, the criminal organizations organized and led by defendants Peng Xiao and Peng Liang were lawfully identified as mafia-type organizations. The main offenders, Peng Xiao and Peng Liang, were convicted of 25 and 20 years' imprisonment and confiscation of all personal property, including organizing and leading a mafia-type organization, suspected of picking quarrels and provoking trouble, illegal detention, intentional injury, extortion, gathering crowds to fight, gambling, organizing others to sneak across the national border, and sneaking across the national border. The remaining 18 defendants were sentenced to prison terms ranging from two to twelve years.
The scene of the trial
After trial, it was ascertained that the defendants Peng Xiao and Peng Liang were brothers. Around 2000, Peng Xiao, Chen Li and others became brothers and began to mix in society. Between 2000 and 2005, Peng Xiao and Chen Li deliberately injured others many times, so that their "social reputation" soared. In 2006, Peng Xiao was cracked down on according to law, and after his release from prison, he and Peng Liang jointly funded and engaged in usurious lending in casinos, gradually accumulated economic strength, successively recruited Huang Dejun, Zhou Degang and others, assisted in usurious lending, violent debt collection, and in 2008, he repeatedly illegally detained a public official and became famous.
In January 2011, Peng Xiao and Peng Liang were sentenced for picking quarrels and provoking trouble and illegal detention in the course of violent debt collection. After being released from prison, Peng Xiao and Peng Liang once again gathered Huang Dejun, Li Jun, and others to carry out many illegal and criminal activities such as usurious lending and amassed money.
There are many members of the organization, the organizers and leaders are clear, the backbone members are fixed, the hierarchy is clear, and unwritten rules and disciplines such as "must absolutely obey the command and arrangement of Peng Xiao and Peng Liang" and "beat, scold or expel members who do not abide by the rules and disciplines of the organization" have been formed. This criminal organization systematically carried out illegal and criminal activities by means of beatings, harassment, pestering, threatening, and other means, deliberately injuring others on many occasions, making usurious loans in casinos, and violently collecting debts; they repeatedly illegally detained state public officials for collecting debts, causing them to be forced to resign from public office and separating their wives and children, seriously interfering with and undermining the normal living order of the people in Renshou County and the normal business activities of companies and enterprises, causing an extremely bad social impact.
At trial, the court held that the criminal organization headed by Peng Xiao and Peng Liang possessed the organizational, economic, behavioral, and harmful characteristics of a mafia-type organization, and should be identified as a mafia-type organization in accordance with law. As organizations and leaders, Peng Xiao and Peng Liang shall bear responsibility for all crimes committed by their organizations, and the other members shall bear corresponding responsibility for the crimes committed by each of them. Based on the facts, nature, circumstances, degree of harm to society, and attitude toward admitting guilt, the court made the above judgment in accordance with law.
